CITY COUNCIL STAFF REPORT
Meeting Date: May 06, 2024
TO: THE HONORABLE MAYOR AND CITY COUNCILMEMBERS
SUBJECT: ADOPT RESOLUTION NO. __-24 ACCEPTING THE SUBDIVISION IMPROVEMENTS FOR SUBDIVISION 9552 (OAK PARK PROPERTIES)

AS COMPLETE

SYNOPSIS
Davidon Homes (Developer) has constructed the improvements for Subdivision 9552 (Oak Park Properties) in accordance with the terms of the Subdivision Agreement with the City. It is now appropriate for the City to accept these improvements as complete.

DISCUSSION
On May 11, 2020, the City Council adopted Resolution No. 34-20, approving the Vesting Tentative Map (PLN 18-0383) for the Oak Park Properties Residential Major Subdivision at 1750 Oak Park Boulevard. The Major Subdivision created 34 new residential parcels within the fiveacre project site. The residential lots range in size from 3,936 square feet to 4,920 square feet with two-story single-family detached homes, associated open space areas, and related landscaping and private site improvements. Seven of the homes contain Accessory Dwelling Units (20%). In addition to the residential parcels, the subdivision also created five common parcels owned and maintained by the homeowners association and preserved a 0.35-acre parcel of land as a park dedicated to the Pleasant Hill Recreation and Park District.

The Developer entered into a Subdivision Improvement Agreement with the City of Pleasant Hill on June 7, 2021, for the construction of street and other subdivision improvements associated with Subdivision 9552. Public improvements were constructed along the project frontage of Santa Barbara Road. The public improvements included new sidewalk, curb, and gutter. Private improvements included new streets, sidewalks, utilities, landscaping, and storm drain improvements with stormwater treatment facilities.

The Developer provided a Faithful Performance Bond and a Labor & Material Bond to guarantee the construction of the improvements. The subdivision improvements are now complete, and the developer requests that the bonds for this work be released.

The work was secured with the following bonds:
• Faithful Performance & Labor and Material Bond #070214035 for on-site improvements in the amount of $2,750,000;
• Faithful Performance Bond & Labor and Material Bond #070214036 for off-site improvements in the amount of $31,000.

Prior to the release of the Faithful Performance Bonds, the Developer will provide a Warranty Bond in the amount of $417,150, which is 15 percent of the total cost of the on-site and off-site improvements. The warranty bond will be held for 12 months after acceptance of the improvements. The Labor and Material Bond will be released six months after the acceptance of the improvements. The release of all improvement securities is in accordance with Pleasant Hill Municipal Code Section 17.35.070.D.

FISCAL IMPACT
The requested action has no impact on the City’s General Fund in annual maintenance costs, as all improvements and landscaping are maintained by the homeowners association. There will be an increase in property tax revenue because of the higher value of the housing development compared to the previous land use conditions. The constructed private improvements (street, sidewalks, and landscaping) will be maintained by the abutting property owners or homeowners association.

PUBLIC CONTACT
Public contact was made through posting of the City Council agenda on the City’s official notice bulletin board, at the Pleasant Hill Senior Center, and at the Pleasant Hill Police Department.

The agenda and staff report are posted on the City’s web page.
