Engineer’s Report
Assessment District No. 20
City of Pleasant Hill
Fiscal Year 24/25
4 PART I – BACKGROUND
The City of Pleasant Hill (the “City”) has contracted with Harris & Associates (“Harris”) to complete the Engineer’s Report (“Report”) for the proposed increase to the assessment rate for Landscape and Lighting Assessment District No. 20 (Commercial Landscaping and Lighting) (“AD 20” or “District”) for Fiscal Year 2024/25 (“FY 24/25”), FY 2025/26, and FY2026/27, including an annual inflationary adjustment to allow for future increases to the assessment rate. AD 20 includes six (6) individual Zones located throughout the City.

Reason for the Proposed Increase in Assessment Rates
Each Zone in the District is currently underfunded or will be. Additionally, at the time Zones 1-5 were formed (1998), a “range of assessments” was established for each Zone. That range of assessments established an initial assessment and a maximum assessment. Each year, the assessment could be increased by the Consumer Price Index (“CPI”), but only up to the established maximum assessment. While the costs of labor, maintenance and utilities have increased over the years due to inflation, the maximum assessment rates within the original five zones have not been increased since 1996. Assessments within Zone 6 are limited to the maximum amount noticed and approved following the Proposition 218 proceeding in 1999.

Every Zone in the District has reached its established maximum assessment and a new maximum assessment must be determined. In addition to the base increases to address underfunding, it is proposed that an annual inflationary adjustment be included with the new maximum assessment, allowing for future increases without the need for another Proposition 218 proceeding. The proposed maximum assessment for each Zone is shown in Part III of this Report (Estimate of Costs). The proposed annual inflationary adjustment is detailed in Part V of this Report (Method of Assessment).

As part of reassessment of the District, the general benefits related to the maintenance and servicing of streetlights and street landscaping have been identified and no assessments will be levied for improvements identified as general benefit. Assessments have been apportioned to the parcels based on the proportional special benefits received. This Report outlines and details our allocation of assessments on the basis of the special benefit received by parcels rather than on the costs of maintaining and servicing of the landscaping improvements.

If the proposed reassessment of the Zones is not approved by property owners, the existing zone assessments will remain in place and the parcels will continue to be assessed as in previous years.

Proposition 218 Requirements
Article XIII D requires that:
 General benefits must be identified and separated from special benefit,  Assessments proposed to be levied on a parcel may only be imposed for special benefit: and  Assessments must be proportional to the special benefit conferred on a parcel.

On November 5, 1996, California voters adopted Proposition 218 creating Article XIII D of the California State Constitution which established requirements for the creation of new assessments or increasing existing assessments.

Proposition 218 also established exemptions to its provisions for districts created prior to its passage.

With the adoption of Proposition 218 in November 1996, any proposed increase in the assessments, including the Engineer’s Report
Assessment District No. 20
City of Pleasant Hill
Fiscal Year 24/25
5 addition of a CPI or other annual inflationary adjustment to the existing assessment rate, requires an assessment ballot be mailed to each property owner subject to the increased assessment, and those property owners must approve the proposed increase or annual adjustment.

In addition to the requirements shown above, any other changes to the Method of Apportionment, resulting in an increased assessment to any particular parcel, must also comply with the requirements of Proposition 218.

Approval Process
Article XIII D of the California Constitution requires that any proposed assessment increase or change to the assessment amount resulting in an increased assessment must go through an approval process which includes the creation of an Engineer’s Report and a property owner ballot procedure. The procedure is briefly detailed below:

Notice and Ballot
The City Council approves a Resolution of Intention giving notice of a Public Hearing and directing the Notice of Public Hearing and Assessment Ballot be mailed to all property owners in the District. An Assessment Ballot will be provided for each parcel subject to the proposed increase and/or annual inflationary adjustment. Assessment Ballots and Notices of Public Hearing will be mailed to the record owner(s) of the parcels at least 45 days prior to the date of a Public Hearing. At the close of the Public Hearing, returned ballots will be tabulated (the public will have the opportunity to view the tabulation process) and interested persons can “hear and be heard” concerning the ballot process and the proposed increases and adjustments.

The results of the ballot tabulation will be announced and presented to the City Council following the completion of the tabulation. The Council may adopt the proposed increases if there is no majority protest. A majority protest exists if the number of returned ballots opposing the increase outweigh the number of returned ballots in favor of the increase, weighted by assessment amount. If there is a majority protest, then the process will stop and the increased assessment and annual inflationary adjustments will not be imposed.

If approved, the increased assessments will be collected on the annual County property tax bills commencing with Fiscal Year 2024/2025.

8 PART III – ESTIMATE OF COST
Estimate of Costs
The estimated budget for the annual maintenance and servicing of the improvements and the proportionate share of administration costs for the District has been prepared based on the estimated and historical costs to provide said services. The District budgets are shown below and includes a comparison between the prior year costs and the proposed costs for FY 24/25. Additionally, due to the fact that the proposed assessment rates will be ramped-up over three (3) years, the FY 25/26 and FY 26/27 budgets are also shown. The proposed costs represent the estimated costs required to maintain the improvements at the level expected by property owners. The City and takes into account replacement costs and an annual inflationary adjustment.

Operating Reserve
The Act requires that a special fund be set up for the revenues and expenditures of the District. Funds raised by collection of assessments shall be used only for the purpose as stated. A contribution to the District by the City may be made to reduce assessments or fund costs exceeding revenue from the assessments, as the City Council deems appropriate. The estimated beginning and ending Operating Reserve fund balances for FY 23/24 are shown in the Cost Estimate table.

Streets and Highway Code Section 22569(a) of the Act allows the District assessments to “…include a reserve which shall not exceed the estimated costs of maintenance and servicing to December 10 of the fiscal year, or whenever the city expects to receive its apportionment of special assessments and tax collections from the county, whichever is later.”
Capital Reserve
In addition to the Operating Reserve as detailed above, the City may create a capital reserve to fund items that will require replacement at some point, due to limited useful life. These items may include but are not limited to the sidewalks, street trees, streetlights, etc. The estimated beginning and ending Capital Reserve fund balances for FY 24/25 are shown in the Cost Estimate table.

Any additional surplus funds, in excess of the 50% Operating Reserve or identified Capital Reserve costs are carried over to the next fiscal year.

Individual budgets for each Zone are shown on the following pages.

16 PART IV – QUANTIFICATION OF BENEFIT
Quantification of Benefit
Each of the improvements have been carefully reviewed and the corresponding assessments have been proportionately spread to each parcel based on the benefit received. The improvements and services provided within each Zone provide differing levels of benefit to those Zones, due to the nature and extent of the landscaping and lighting improvements provided.

General Benefit
Although the improvements may be visible to passersby or to the public at large, the improvements were installed as a requirement of the development of the tract and are for the sole benefit of properties within the District. It has been determined however, due to limited access or use by individuals outside the District, the City will contribute an amount to account for the incidental general benefits conferred. The City contributions for each Zone are shown on the Cost Estimate pages in Part III of this Report.

Street Lighting General Benefit. The city recognizes that a portion of the maintenance, operation and servicing of those Street Lighting Improvements that are a part of the city’s arterial lighting improvements provide a general benefit to the public at large, which equates to the higher level of lighting required on arterial roads for through traffic.

The general benefits associated with arterial lighting are attributable to the higher level of lighting required for an arterial roadway. That higher level of lighting provides a measure of safety for the additional width of the street. Local roadways require approximately 9,500 lumen lights (typically 40-watt LED lights) and arterial roadways require approximately 20,000 lumen lights (typically 100-watt LED lights). It is standard practice that street lighting on local roads is 100% special benefit to the properties along those roadways. Therefore, a portion of the arterial lights is special benefit to the adjacent properties and a portion is general benefit for the through traffic.

The amount of general benefit is established by deducting the local road lumens of 9,500 from the arterial road lumens of 20,000 and dividing the difference by 20,000 lumens. This gives a general benefit percentage of 52.5% (20,000 – 9,500 = 10,500; 10,500/20,000 = 52.5%). Therefore, 52.5% of the street lighting cost estimate must be funded from a source outside the assessment district. Street lighting totals $72,337. $37,976.93 (52.50%) must come from other source and cannot be assessed to District properties.

Street Trees and Landscaping General Benefit. There are no general benefits associated with local street trees and there are no local street trees within any of the Zones.

Street trees along arterial roadways provide aesthetic benefits to people walking through the City. Per the 2005 Traveler Opinion and Perception Survey conducted by the Federal Highway Administration, approximately 10.90% of all trips are considered walking trips. Therefore, 10.90% of the landscaping Improvements along the arterial roadways are considered general benefit, and only 89.10% of these landscaping Improvements will be used to estimate the special benefit costs. Landscaping improvement total $383,591. $41,811 (10.90%) must come from other source and cannot be assessed to District properties.

Engineer’s Report
Assessment District No. 20
City of Pleasant Hill
Fiscal Year 24/25
17 Landscaping and hardscaping within medians in the arterial roadways provide only incidental aesthetic benefits to motorists traveling to, from or through the City. Therefore, it is deemed that there are no general benefits associated with the landscaped medians.

City Contributions for General Benefit
The total cost of the improvements in each zone has been reduced by a contribution from the City, as shown on the individual budget pages. Maintenance costs are monitored every few years and City contributions are adjusted accordingly.

Benefit Assumptions
Parcels outside the district boundaries that receive special benefits from the improvements are shown in Appendix D. These assessment amounts have been shown as a contribution from the City in the budget tables for each Zone.

Definition of Special Benefit
The method of apportionment described in this Report is based on the premise that each assessable parcel or unit receives distinct and special benefits from the improvements and services provided, including the visual desirability provided by well-maintained landscaping. In accordance with Article XIII D, Section 4 of the California Constitution:
“Special benefit means a particular and distinct benefit over and above general benefits conferred on real property located in the District or the public at large” The special benefits associated with local landscaping improvements are specifically:
 Enhanced desirability of properties due to proximity and accessibility of the improvements.  Reduction of dust and debris
 Improved aesthetic appeal provided by a positive representation of area  Increased sense of pride in ownership from well-maintained improvements.

The special benefits associated with local streetlighting improvements are specifically:
 Mitigates property damage due to criminal activity
 Serves as a deterrent to graffiti and vandalism
 Alleviates the fear of crime, which increases the desirability of property  Increased nighttime visibility for access of emergency vehicles  Improved ingress to and egress from property
 Reduced vandalism and other criminal acts and damage to improvements or property  Promotes a reassuring entry into the neighborhood
 Provides a positive nighttime visual image

18 PART V – METHOD OF APPORTIONMENT
General
Street and Highways Code Section 22573 requires that maintenance assessments be levied according to benefit rather than according to assessed value. This section states:
“The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel from the improvements.”
— Streets and Highways Code Section 22573
The Act permits the designation of areas of benefit within an assessment district by different zones where "by reason of variations in the nature, location, and extent of the improvements, the various areas will receive different degrees of benefit from the improvements." (Section 22574).

Proposition 218, which amended Articles XIII C and XIII D of the California Constitution, placed substantive and procedural requirements on taxes, assessments, and property-related fees imposed by local governments.

The method of apportionment described in this Report utilizes commonly accepted engineering practices in accordance with the Act and the California Constitution for the allocation of special benefit assessments. The calculation of assessments is based upon the parcel type and the services and improvements provided to equitably apportion the costs based on the special benefit received by each lot or parcel. The special benefit received by each lot or parcel is over and above any general benefit conferred upon said lots or parcels or to the public at large.

Each Zone in the District assesses developed, benefitting properties on the basis of acreage or linear feet, for the maintenance and operation of the District improvements. District costs include all incidentals and appurtenances related to maintaining, operating or servicing the improvements described herein.

There are also certain parcels within Zone 2 that are assessed an additional amount based on linear foot (“LF”) of parcel frontage. The parcels affected in Zone 2 are shown on the Assessment Roll. The additional assessment for frontage funds the Measure J improvements installed along Monument Boulevard and Buskirk Avenue.

In November 2004, Contra Costa County voters approved Measure J. The measure provided for the continuation of the County's half-cent transportation sales tax measure for 25 more years. As with Measure C (the original 1988 transportation sales tax measure); Measure J revenues are used to fund a voter-approved Expenditure Plan of transportation programs and projects.

The total estimated cost of the improvements has been divided among the several parcels of land within the District in proportion to the estimated special benefits received by the parcels benefiting from the improvements.

Calculation of Assessments and Proposed Increases:

The net cost of the improvements within each Zone has been divided among the several parcels of land within the Engineer’s Report

19 District in proportion to the estimated special benefits to be received by the parcels benefiting from the improvements.

The method used to calculate the assessment for each Zone follows:

Zone 1: Assessable parcels are assessed based on EDU. The parcel acreage is converted to Equivalent Dwelling Units (“EDU”) and the EDU for each parcel is multiplied by the proposed maximum assessment rate. For the current FY 2023-24, an assessment rate of $1,155.60 /EDU was applied. The FY 2024-25 proposed maximum assessment rate is $1,966.50/EDU. Due to the large increase, it is proposed that the increase be instituted over the course of three (3) years, with a 3.5% increase added to the proposed maximum assessment during that time, as shown in the table below.

Zone 2: Assessable parcels are assessed based on EDU. Vacant parcels are assigned one-half the EDU per acre due to lower benefit received. The parcel acreage is converted to Equivalent Dwelling Units (“EDU”) and the EDU for each parcel is multiplied by the proposed FY 2024-25 maximum assessment rate of $1,003.95. The FY 2023-24 an assessment rate of$744.00 was applied. Due to the large increase, it is proposed that the increase be instituted over the course of three (3) years, with a 3.5% increase added to the proposed maximum assessment during that time.

There are also 10 parcels within Zone 2 that are assessed for linear footage along Hookston Road. The increases for those properties and the proposed maximum assessment rate and annual assessment rate for three years, based on an EDU per linear foot, are shown below. Those parcels are listed in the Assessment Roll.

Zone 3: Assessable parcels are assessed based on EDU. The parcel acreage is converted to Equivalent Dwelling Units (“EDU”) and the EDU for each parcel is multiplied by the proposed FY 2024-25 maximum assessment rate of $331.20.

The FY 2023-24 applied assessment rate was $279.97. Due to the large increase, it is proposed that the increase be instituted over the course of three (3) years, with a 3.5% increase added to the proposed maximum assessment during that time.

22 Annual Inflation Adjustment
It is generally recognized that most budgetary items will be impacted by inflation in future years. In accordance with the California Constitution and Government Code Section 53739(b)(1), assessments “may be adjusted for inflation pursuant to a clearly defined formula…” A formula for an inflationary adjustment will be included as part of the maximum assessment for this District and for approval by the property owner(s). The formula, as described below, allows for annual adjustments to the budget and the assessments.

Annual Adjustment to Maximum Assessment
In an effort to minimize the impact inflation has on the District, a formula for inflationary adjustments will be included as a part of the proposed maximum assessment for all Zones in AD 20 for FY 24/25 in addition to the three-year increases shown in the budget tables above.

An inflationary adjustment will allow the Maximum Assessments established during the reassessment of the District to increase each year so assessment revenues can continue to fund the costs of the maintenance and services as costs of materials and services rise in the future.

For Fiscal Year 2024/25, 2025/26, and 2026/27, the Maximum Assessments established with this Report for each Zone shall be adjusted annually by 3.5%.

Beginning in Fiscal Year 2027/28, it is proposed that the Maximum Assessments established with this Report for each Zone, be adjusted annually based on the Annual Change Consumer Price Index of the San Francisco-Oakland-Hayward Area All Urban Consumers Index (CPI-U), from December to December. Adjustments are based on the change of the CPI for the prior year as compared to the year assessments are determined.

The actual annual assessment rate and actual assessments levied in any fiscal year shall be as approved by the City Council and may not exceed the Maximum Assessment rate for that specific fiscal year without a Proposition 218 proceeding.

The Maximum Assessment rate established during the reassessment of the District will be adjusted by the following formula:
 For Fiscal Year 2024/25, 2025/26, and 2026/27, the Maximum Assessments established with this Report for each Zone shall be adjusted annually by 3.5%.
 Beginning in Fiscal Year 2027/28, after the 3-year stepped up increases shown in the tables above, the CPI increase shall be applied to the Maximum Assessment rate established the previous fiscal year to calculate the appropriate Adjusted Maximum Assessment rate for the then current fiscal year.

The Adjusted Maximum Assessment rate will be calculated independent of the annual budget and proposed assessment rate for the given fiscal year.

23 APPENDIX A – ASSESSMENT ROLL
Parcel Identification for each lot or parcel within the District shall be based on available parcel maps and other property data from the Contra Costa County Assessor’s office as they existed at the time this Report was prepared and adopted by the City Council.

A listing of parcels assessed within the District for FY 24/25, along with the corresponding assessment amounts, is included on the following pages. If any parcel submitted for collection is identified by the County Auditor/Controller to be an invalid parcel number for the current fiscal year, a corrected parcel number and/or new parcel numbers will be identified and resubmitted to the County Auditor/Controller. The assessment amount to be levied and collected for the resubmitted parcel(s) shall be based on the method of apportionment and assessment rate approved in this Report.

Therefore, if a single parcel has changed to multiple parcels, the assessment amounts applied to each of the new parcels shall be recalculated and applied according to the approved method of apportionment and assessment rate rather than a proportionate share of the original assessment.

Non-assessable lots or parcels include areas of public streets and other roadways (typically not assigned an APN by the County); dedicated public easements, open space areas and rights-of-way, including public greenbelts and parkways; utility rights-of-way; common areas; landlocked parcels; small parcels vacated by the County, bifurcated lots, and any other property that cannot be developed or has specific development restrictions. These types of parcels are considered to receive little or no benefit from the improvements and are therefore, exempted from assessment.
