Packet Pg. 32
6 If you wish to minimize the risk of losing valued belongings, you should try to keep those belongings on your person at all times, in a storage facility, or in visible, sanitary, and safely accessible bags or bins.

If you think your belongings were stored, you can claim them by following the directions on the Impound Notice after the clean-up is complete. You may retrieve any stored belongings without being asked about your immigration status.
(2) After 72 hours, the City Manager shall be authorized to conduct abatement or clean-up of the site on the date posted on the Notice of Clean-Up. If abatement is delayed or rescheduled, the City Manager may conduct abatement within 72 hours of the posted Notice of Clean-Up without reposting a new Notice of Clean-Up. If abatement is delayed for a longer period of time, the City Manager shall repost a Notice of Clean-Up with a new date.
(B) The City Manager shall follow these additional procedures when persons are present at an encampment during abatement:
(1) The City Manager shall evaluate reasonable requests for additional time or assistance to remove items and may accommodate those requests to the extent practicable.

(1) circumstances indicate that the item belongs to a person, (2) the item has apparent utility in its current condition and circumstances, and (3) the item can be safely retrieved from the site.

9.4.a
Packet Pg. 33
7 Examples of items potentially eligible for storage include identification and associated paperwork, medication stored in medication bottles with identifying information, art, art supplies, musical instruments, and items that reasonably appear to have sentimental value in their current condition. An item need not be in a new or perfect condition to have apparent utility.
(E) An eligible item found during an abatement shall be put into storage, unless it meets one the following disqualifying conditions:
(1) hazardous, including items contaminated with human waste or bodily fluid, soiled items likely to expose others to disease, animal waste, insects, explosives, weapons, liquids, drug paraphernalia, or mold; (2) likely to become hazardous in storage, including perishables, wet materials that might become moldy, and items covered in mud;
(3) practically un-storable, due to large size, weight, or other similar characteristic;
(4) contraband or stolen property; or
(5) is on the City Manager’s current list of common types of items that, in the experience of City staff, individuals regularly abandon during abatement, and there is no contrary indication as to the specific item. (F) The City Manager shall record each eligible item to be stored, including the location it was found and the date of storage. Any stored items shall be kept in storage at least 30 calendar days and then may be disposed of, recycled, or reused following the process in this Chapter (Abandoned Personal Property). (G) After abatement has concluded and when eligible items are collected and will be placed in storage, the City Manager shall post notices, in English and Spanish, at the location of the abatement that includes information on how a person may claim stored items. A person may retrieve stored items based on a description with sufficient specificity to demonstrate ownership. A person may retrieve stored items without inquiry into the person’s immigration status.
(H) Expedited Abatement:
(1) In an expedited abatement, the City Manager shall follow the same abatement and storage procedures in this Chapter (Abatement of Encampments), but shall post a Notice of Clean-Up, in English and Spanish, giving a minimum of three (3) hours for all persons to remove their personal property.
(2) The City Manager shall prioritize and expedite the removal of an encampment if:
(a) the City receives direction from Contra Costa County or other governmental authority that abatement of the encampment is necessary to preserve public health or safety, including to address known or suspected outbreaks of diseases; or

9.4.a
Packet Pg. 34
8 (b) the City Manager observes or reasonably suspects the encampment creates a condition that presents a significant risk of property damage, bodily injury or death.

Section 9.75.070 Abandoned Personal Property.
(A) Any personal property or possessions located on Public Property that are unattended and whose owner cannot be readily identified are presumed to be abandoned and, pursuant to Civil Code section 2080.7, any contrary provisions regarding procedures for unclaimed property in this Code do not apply.

Enforcement Officials shall make a reasonable effort to ascertain whether the unattended personal property or possessions have been abandoned and, if so, to thereafter cause their removal. Any personal property or possessions found during the abatement process shall first be stored as required by this Chapter. (B) Unattended personal property or possessions that are unsanitary, soiled contain evidence of vermin may be summarily abated and destroyed. Unattended personal property or possessions that are not summarily abated or destroyed under this section may be disposed of or recycled by the City Manager or donated for reuse.

Section 9.75.080 Enforcement.

It is unlawful for a person to violate or to fail to comply with any provision of this Chapter. The City may enforce any provision of this Chapter by any one or more of the following methods:
(A) Any person who violates any provision in this Chapter is guilty of an infraction, punishable by a one hundred dollar fine.
(B) Any person cited for a second violation of the same section of this Chapter within a twelve-month period is guilty of an infraction, punishable by a two hundred dollar fine. (C) Any person found in violation of any section of this chapter for the third time within a twelve-month period is guilty of a misdemeanor, punishable by a fine not to exceed five hundred dollars, or imprisonment not to exceed six months. (D) This Chapter also may be enforced as an administrative violation under Pleasant Hill Municipal Code Chapter 1.35 and any other civil remedies as authorized by law. “ Section 4. Severability. If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect any other provisions or applications, and to this end the provisions of this Ordinance are declared to be severable.

Section 5. Effective Date. This ordinance shall be effective thirty (30) days after the date of its adoption.

9.4.a
Packet Pg. 35
9 Section 6. Posting. Within fifteen days after the passage of this ordinance, the City Clerk shall cause it or a summary of it to be posted in the three places designated by resolution of the City Council.

Section 7. Compliance with CEQA. CITY COUNCIL STAFF REPORT
Meeting Date: October 21, 2024
TO: THE HONORABLE MAYOR AND CITY COUNCILMEMBERS
SUBJECT: ADOPT RESOLUTION NO. ____-24 AUTHORIZING THE CITY

MANAGER TO EXECUTE A DESIGN PROFESSIONAL SERVICES

AGREEMENT WITH NCE FOR ENGINEERING DESIGN SERVICES

FOR THE TAYLOR BOULEVARD SIDEWALK GAP CLOSURE

PROJECT

SYNOPSIS
This item requests authorization for the City Manager to execute a Design Professional Services Agreement with NCE to perform engineering design services for the Taylor Boulevard Sidewalk Gap Closure Project (Project). The area identified for the Project is along the south side of Taylor Boulevard between Lucille Lane and Civic Drive.

A new shared use path (for use by people walking and biking) will be designed as part of the proposed scope of work, as well as ADA curb ramps and minor irrigation modifications. This path will connect the recently completed traffic signal at Taylor Boulevard/Civic Drive to the new shared use path on the south side of Taylor Boulevard west of Lucille Drive, completing an ADA compliant path of travel along Taylor Boulevard between Contra Costa Boulevard and Morello Avenue, consistent with the City’s Bicycle and Pedestrian Master Plan.

DISCUSSION
Background
In November 2016, Pleasant Hill voters approved local Measure K, a twenty-year, one-half cent transaction and use tax to address the infrastructure needs of the City. The measure generates needed revenue each year, a portion of which may be allocated to help supplement the Pedestrian/Bike Program.

As part of the recently adopted FY 2024-2029 Capital Improvement Plan (CIP), this Project was identified to utilize available Measure K funds for design in FY 2024-2025. The Project is a high priority location for pedestrian and bicycle improvements based on proximity to schools, number of nearby destinations, and traffic volume and speed. The Project will connect residents to popular nearby destinations, including the YMCA, the Pleasant Hill Community Center, Valley View Middle School, College Park High School, and the Contra Costa Canal Trail.

10.1 Packet Pg. 41
Construction funding has not yet been identified for the project; however, completion of design will provide necessary information to pursue grant opportunities.

Analysis
On July 15, 2024, the Public Works Department issued a Request for Proposals to solicit engineering design services for this Project. In addition to posting the information on the City’s website and within the construction exchanges, staff specifically solicited proposals from three local civil engineering design consulting firms known to perform this type of work. The City received two responsive proposals by the August 30, 2024 due date from LCC Engineering and Surveying, Inc. (LCC) and NCE.

To obtain the most qualified firm for this project, staff reviewed each proposal and conducted oral interviews with each firm. The two firms were ranked as follows:

1. NCE Richmond, CA

2. LCC Martinez, CA
NCE was ranked highest based on the following evaluation criteria: qualification of the project team and members, project understanding, innovative project design, and ability to meet the project schedule.

NCE provided a complete proposal for the scope of work and was ranked the higher of the two responsive bids by the selection committee. NCE has stated they can complete the design services within the given timeframe. The NCE team has previously completed a number of design projects for the City, including the Contra Costa Boulevard Complete Streets (Beth Drive to Harriet Drive) and Geary Road Complete Street Improvements – Phase 3.

Staff believes that the NCE team has the expertise and professional competency to deliver a successful project within the project schedule and budget.

FISCAL IMPACT
The design budget for the Taylor Boulevard Sidewalk Gap Closure Project identified in the CIP was $85,000.

NCE’s proposal is in the amount of $102,900. The proposal is complete and acceptable considering the complexity and scope of design services of the project, including upgrading the proposed sidewalk to a shared use path. This exceeds the design budget identified in the CIP of $85,000. Additional Measure K Pedestrian/Bike Program funds in the amount of $17,900 may be used to finance the design engineering costs identified. The Finance Division has confirmed that these funds are available.

CITY COUNCIL STAFF REPORT
Meeting Date: October 21, 2024
TO: THE HONORABLE MAYOR AND CITY COUNCILMEMBERS
SUBJECT: ADOPT RESOLUTION NO. __ -24 ACCEPTING PRE-APPROVED

ACCESSORY DWELLING UNIT ARCHITECTURAL PLANS FOR A

PERMIT READY ACCESSORY DWELLING UNIT PROGRAM

SYNOPSIS
The City Council is requested to review and accept Pre-Approved Accessory Dwelling Unit Architectural Plans for a “Permit Ready Accessory Dwelling Unit Program” (“PRADU”) program consisting of three individual, pre-approved ADU floor plans, each with three unique elevation styles for homeowners to choose from. This effort to streamline ADU production within the City is a requirement of State law and must be implemented by January 1, 2025.

DISCUSSION
Background
The City is required to comply with the provisions of Assembly Bill 1332 (AB 1332), which requires local agencies to develop a program for the pre-approval of ADU plans to assist with the streamlined production of housing. The residents of the City are expected to be the primary beneficiaries of this action, as it will make plans available for their use without the cost of preparation by a licensed professional. AB 1332 does not specify a minimum number of ADU plan types that must be made available; however, in the interest of providing variety and options, City staff is recommending three floor plan options be made available, all measuring 800 square feet or less in size. The program must be adopted by January 1, 2025.

On April 1, 2024, Staff issued an RFP seeking qualified firms for the creation of a PRADU program. Staff selected RRM Design Group as the most qualified firm.

On March 20, 2024, the City Council authorized the City Manager to execute a Professional Services Agreement with RRM Design Group to preform planning and building services associated with the creation of a Permit Ready Accessory Dwelling Unit Program. Over the past seven months, Staff has worked with RRM Design Group to create floor plans, elevations, and renderings for the PRADU program.

10.2 Packet Pg. 46
PRADU Program
Architectural Design Plans
As part of the project initiation, RRM Design Group conducted a context study of the City’s typical residential parcel sizes and shapes, and residential building forms and roof styles to determine what ADU plans would be most utilized by homeowners. Elements from the context study have been incorporated into the final proposed floor plans within the program.

The proposed PRADU Program will contain three individual, pre-approved ADU floor plans as follows (see Exhibit 1):
• Plan 1: 350-square-foot, studio ADU
• Plan 2: 636-square-foot, one-bedroom/one-bathroom ADU • Plan 3: 798-square-foot, two-bedroom/one-bathroom ADU Each floor plan measures less than 800 square feet in floor area and therefore qualifies for a streamlined, “building permit only” review per State Law and the City’s ADU Ordinance. The range of floor areas and bedroom options is intended to provide flexibility for homeowners. Staff and RRM Design Group worked to ensure the maximum use of space within each unit to accommodate a full kitchen, living area, and laundry facility.

The initial context study of existing residential styles within the City found a mix of stucco, horizontal lap siding, and board and batten siding with various roof forms including street facing gable or Dutch gable roof elements or shed roofs. Additional design features typically include shutters, front porches with railings, wainscoting and window grids. These elements have all been incorporated into at least one of the three design styles within the program. While Pleasant Hill does not currently have many modern-style residential structures, Staff has seen an increase in modern design for ADU’s, and therefore opted to include a third, more modern option for flexibility. Each design style also features a variety of high-quality, durable materials, trim detailing, and other architectural features, as recommended by the City’s Residential Design Guidelines.

The three unique elevation styles feature in the program are:
• Bungalow: horizontal fiber cement siding, Dutch gable roof element, wood port columns (optional), and asphalt shingle roof
• California Ranch: fiber cement board and batten siding, decorative gable pediment details, stone veneer wainscot, optional front porch with horizontal wood railing, and asphalt shingle roof
• Modern: stucco façade, porch and window awning elements, horizontal wood siding entry element, asphalt shingle roof, optional front porch
Homeowners can choose an option based on personal preference. Each ADU plan also includes an optional front porch element. Front porches are optional because they are reviewed under separate

10.2 Packet Pg. 47
accessory structure provisions and, therefore, may not be feasible on certain lots with setback or lot coverage constraints.

Building Permit Technical Plans
As part of this program, the next steps will include staff working with RRM Design Group to complete building permit technical plans, including plumbing, electrical, structural and other necessary technical details.

Program Implementation
Once adopted, these architectural plans, including necessary construction-level technical plans for each floorplan and elevation style, will be made available online for download use by anyone wanting to construct a building permit ADU. In addition to the plans, applicants must provide their own site plan for their specific lot, submit a building permit application, and pay required permit fees.

CEQA
Pursuant to Section 15061(b)(3) of the Guidelines for the Implementation of the California Environmental Quality Act (CEQA) of 1970, as amended, the lead agency has determined that the proposed activity is exempt from CEQA. The City, as the lead agency, has determined with certainty that the proposed activity will not have a significant effect on the environment as the proposed pre-approved accessory dwelling unit architectural plans do not directly approve any physical development and are intended to comply with applicable State provisions.

FISCAL IMPACT
The creation of the PRADU program is funded through the American Rescue Plan Act (ARPA).

Individual homeowners will be responsible for all permit fees and construction costs.

RECOMMENDED CITY COUNCIL ACTION
Adopt the attached resolution accepting the Pre-Approved Accessory Dwelling Unit Architectural Plans for the Permit Ready Accessory Dwelling Unit Program.

ALTERNATIVES TO RECOMMENDED ACTION

1. Continue the item to a later date with direction provided to Staff.

2. Do not adopt the resolution.
