CITY COUNCIL STAFF REPORT
Meeting Date: January 13, 2025
TO: THE HONORABLE MAYOR AND CITY COUNCILMEMBERS
SUBJECT: ADOPT RESOLUTION NO. ___-25 AUTHORIZING THE CITY

MANAGER TO EXECUTE A DESIGN PROFESSIONAL SERVICES
AGREEMENT WITH LCC ENGINEERING & SURVEYING, INC. FOR

ENGINEERING DESIGN SERVICES FOR THE SHELLY DRIVE AND

RUTH DRIVE STORM DRAIN REHABILITATION PROJECT

SYNOPSIS
Staff requests that the City Council adopt the proposed resolution authorizing the City Manager to execute a Design Professional Services Agreement with LCC Engineering & Surveying, Inc. to perform engineering design services for the Shelly Drive and Ruth Drive Storm Drain Rehabilitation Project (Project).

This project will rehabilitate and convert private storm drain systems to publicly maintained systems on Shelly Drive and Ruth Drive.

DISCUSSION
Background
In November 2016, Measure K, a half-cent transaction and use tax (or sales tax), was approved by Pleasant Hill voters. The tax took effect April 1, 2017, for a 20-year period. The Measure generates approximately $5.5 million in needed revenue each year, and a portion of these funds has been allocated to the Storm Drain Improvement Program (SDIP).

The FY 2024 – 2029 Capital Improvement Plan (CIP) includes the Storm Drain Improvement Program (SDIP), which funds the installation of new storm drain facilities or needed upgrades to existing facilities. Projects that are funded through this program are implemented per the City’s 2018 Storm Drain Master Plan Study Report (Master Plan) that developed the Storm Drain Improvement Priority List, and address locations of poor drainage or areas with localized flooding problems. Projects are prioritized based on safety, effectiveness, and cost. The Shelly Drive and Ruth Drive Storm Drain Rehabilitation Project (MK-002) was identified in the CIP and Master Plan as the next set of improvements to be completed.

There are several private storm drain lines identified in the Storm Drain Master Plan that connect to the public system throughout the City. On Shelly Drive, two storm drain pipes run between homes on private property and discharge into Murderer’s Creek. On Ruth Drive, there are three private storm drain pipes that run between homes on private properties and discharge into the Contra Costa County Flood Control Channel. The City is not responsible for the replacement or maintenance of these private storm drain lines.

The City has a history of working with individual property owners in areas of high localized flooding, and converting private storm drain systems to public systems. The City has offered to convert the two pipes on Shelly Drive and the three storm drain pipes on Ruth Drive to public systems, through the City’s Private to Public (PTP) conversion program. The City has obtained the necessary signed agreements from the individual property owners, which provide access for design and rehabilitation, grant the City a permanent storm drain easement, and fund all project and future maintenance costs, excluding landscape restorations. Similar PTP storm drain conversion projects the City has completed include: a) Wendell Lane Phase I and Phase II Storm Drain Improvement Project (2006); b) Ruth Drive Storm Drain Improvement Project (2015); and c) the Gregory Gardens Storm Drain Improvement Project (2022).

Analysis
On November 5, 2024, the Public Works Department released a Request for Proposal (RFP) via the City’s website to solicit engineering design services for this Project. The RFP was also sent directly to three civil engineering design consulting firms that have completed this work for the City in the past. The City received a proposal from one firm by the due date of November 27, 2024: LCC Engineering and Surveying, Inc. (LCC). Staff reviewed LCC’s proposal and conducted an oral interview with their team.

LCC provided a complete proposal for the scope of work, which included the qualifications of the project team members and project understanding. In addition, LCC has stated they can complete the design services within the given timeframe. The LCC team has previously completed several similar design projects for the City, including the previously mentioned Ruth Drive Storm Drain Improvement Project and the Gregory Gardens Storm Drain Improvement Project. Staff believes that the LCC team has the expertise and professional competency to deliver a successful project within the project schedule and budget.

FISCAL IMPACT
LCC’s proposal is in the amount of $134,956. The proposal is complete and acceptable, considering the complexity and scope of design services of the project, including rehabilitating the existing private storm drain lines. It is reasonable to include a contingency of $20,243 (15%), bringing the total design cost to $155,199. These costs are to be funded using Storm Drain Improvement Program funds. The Finance Division has confirmed that these funds are available.

PUBLIC CONTACT
Public contact was made through posting of the City Council agenda on the City’s official notice bulletin board, at the Pleasant Hill Senior Center, and at the Pleasant Hill Police Department.

The agenda and staff report are posted on the City’s web page.
