CITY COUNCIL STAFF REPORT
Meeting Date: February 3, 2025
TO: THE HONORABLE MAYOR AND CITY COUNCILMEMBERS
TITLE: Adopt Resolution No. ___- 25 Authorizing Signatures for Withdrawal of City Funds, Performing Banking Administration, and Rescinding Resolution No. 01-23

SYNOPSIS
A resolution is required to authorize positions to draw or sign City checks for payment of City funds and banking administration to conduct City business. Staff recommends that the City Council adopt the proposed resolution authorizing signatures for withdrawal of City funds, authorizing personnel to perform banking administration, and rescinding Resolution No. 01-23

DISCUSSION
Background
On December 16, 2024, the City Council elected a new Mayor and Vice Mayor. In the past, an amended resolution was needed to incorporate the names of the newly elected Mayor and Vice Mayor, as well as any staff changes as authorized signors. In January 2023, the City Council adopted Resolution No. 01-23, which authorizes staff to amend the check signors with the Bank of Montreal (BMO) based on the position within the City and no longer needed to be amended for elections or staff turnover. Since the last update in 2023, the City Manager has reorganized staff positions to be more responsive to the needs of the City. Therefore, some of the authorized staff positions have been amended or currently made unavailable and need to be updated. The proposed changes below will reflect the authorized positions to draw or sign City checks upon City funds for payment of legal demands against the City and execute signature cards at the local depository:

Proposed Revision:

1. Mayor

2. Vice Mayor

3. City Manager

4. Chief Financial Officer/City Treasurer

5. Director of Public Works
Item 9.3.

CITY COUNCIL STAFF REPORT
Meeting Date: February 3, 2025
TO: THE HONORABLE MAYOR AND CITY COUNCILMEMBERS
TITLE: ADOPT RESOLUTION NO. __-25 DIRECTING THE PREPARATION AND FILING OF THE 2025/2026 ANNUAL REPORT FOR
ASSESSMENT DISTRICT NO. 20 (COMMERCIAL AREA
LANDSCAPE AND LIGHTING) AND ADOPT RESOLUTION NO. __-
25 REQUESTING CONSENT FROM THE CITY OF CONCORD FOR

ORDERING OF IMPROVEMENTS AND ASSESSMENTS OF COSTS
FOR BENEFITED PROPERTY IN ASSESSMENT DISTRICT NO. 20

SYNOPSIS
An assessment district is a financial mechanism that is levied on a specific geographic area or parcels of real estate which have been identified as receiving a direct and unique “benefit” from a public improvement. Assessment District No. 20 (AD 20) enables the City to provide landscape maintenance and street lighting at an enhanced level along certain commercial streets. These landscape and lighting improvements are considered to be of direct benefit to the properties within AD 20 boundaries. The funding for the maintenance and services is provided through annual assessments paid by benefiting property owners within AD 20. A total of 17 properties within AD 20’s boundaries are located in the city of Concord. The City annually requests consent from the city of Concord to levy assessments on these benefiting properties.

In order for the City to continue to levy and collect assessments within AD 20 for the 2025/2026 fiscal year, an Annual Report is required. The Annual Report must include a description of the improvements to be made during the fiscal year; an estimate of costs to maintain the improvements; an allocation of costs to each parcel; confirmation of each benefiting parcel and levy of assessments; current expenditures; and proposed budget for services.

DISCUSSION
Background
AD 20 was formed in 1988 pursuant to the provisions of the Landscape and Lighting Act of 1972 and the California Streets and Highways Code. AD 20 was amended in 1999 by creating a new zone (Zone 6) that includes the Downtown area (see attached map). The District enables the City to collect assessments from property owners in order to provide landscape maintenance and street lighting at an enhanced level and quality along certain commercial streets. These services are considered to be of direct benefit to the properties within AD 20’s boundaries. The costs to provide these services have been paid annually by these benefiting property owners.

Item 10.1.

City Council Meeting Agenda - Page 41 of 84 - Monday, February 03, 2025 There are 17 properties within AD 20’s boundaries that are located in the city of Concord. Eight of these properties are located east of Contra Costa Boulevard and south of Sun Valley Boulevard.

The Sun Valley Mall Shopping Center contains six properties. The remaining three properties are east of Contra Costa Boulevard and south of Concord Avenue at the on-ramp to Interstate 680.

The city of Concord has granted the city of Pleasant Hill authority to levy assessments on these properties since AD 20 was established. This authority must be requested and granted annually. A resolution requesting consent from the city of Concord for the 2025/2026 fiscal year is attached.

Analysis
The collecting of assessments from properties within the boundaries of AD 20 will ensure continued maintenance of lighting and landscape improvements. The maintenance activities include weekly mowing and edging of turf; maintenance and repair of irrigation systems; pruning; debris removal; graffiti removal; street light repair, and maintenance and weeding, as well as utility charges for water and electricity. In order for the City to continue to levy and collect assessments within AD 20 for the 2025/2026 fiscal year, the District Engineer has to prepare an Annual Report. The Annual Report must include descriptions of the improvements to be made during the fiscal year, an estimate of costs, and the levy of assessments upon the benefiting properties.

The City issued a Request for Proposals for district engineering services in December 2024, as the same engineering firm had served as the Engineer of Work for AD 20 since 2019. The City received proposals from four qualified firms and selected SCI Consulting Group. Under this proposal, SCI Consulting Group would prepare the Annual Report and submit the assessments to the County Auditor for placement on the 2025/2026 Property Tax Roll. A not-to-exceed fee of $13,940 will provide for these and other requested services.

Once the Annual Report is complete, the City Council will review and approve it (if appropriate); be asked to approve a resolution announcing the intent to levy assessments for the current year and issue a notice of intent to levy and collect assessments within the District; and hold a public hearing on the levy of the assessments.

FISCAL IMPACT
The cost of preparing all necessary reports required for the levy and collecting of assessments will be borne by the property owners within AD 20. The not-to-exceed amount for the engineering services specified in the Scope of Services and Compensation attachment is $13,940, which will be paid by the Assessment District.

PUBLIC CONTACT
Public Contact was made through posting of the City Council agenda on the City’s official notice bulletin board, at the Pleasant Hill Senior Center, and at the Pleasant Hill Police Department. The agenda and staff report are posted on the City’s web page.

Item 10.1.

City Council Meeting Agenda - Page 42 of 84 - Monday, February 03, 2025

RECOMMENDED CITY COUNCIL ACTION
Adopt resolutions

ALTERNATIVES TO RECOMMENDED ACTION
Should Assessment District 20 not be renewed for the 2025/2026 fiscal year, there would be a loss of approximately $439,345 in assessment revenues to fund maintenance activities within AD 20.

The City would then need to fund these maintenance activities or maintenance would be suspended.

CITY COUNCIL STAFF REPORT
Meeting Date: February 3, 2025
TO: THE HONORABLE MAYOR AND CITY COUNCILMEMBERS
TITLE: ADOPT RESOLUTION NO. __-25 DIRECTING THE PREPARATION AND FILING OF THE 2025/2026 ANNUAL REPORT FOR
ASSESSMENT DISTRICT NO. 22

SYNOPSIS
An assessment district is a financial mechanism that is levied on a specific geographic area or parcels of real estate, which have been identified as receiving a direct and unique "benefit" from a public improvement. Assessment District No. 22 (AD 22) enables the City to provide landscape maintenance and street lighting at an enhanced level within the scenic easements in the Grayson Woods and Gallery Walk Subdivisions. These landscape and lighting improvements are considered to be of direct benefit to the properties within AD 22’s boundaries. The funding for the maintenance and services is provided through annual assessments paid by these benefiting property owners within AD 22.

In order for the City to continue to levy and collect assessments within AD 22 for the 2025/2026 fiscal year, an Annual Report is required. The Annual Report will include a description of the improvements to be made during the fiscal year; an estimate of costs to maintain the improvements; an allocation of costs to each parcel; confirmation of each benefiting parcel and levy of assessments; current expenditures; and proposed budget for services.

DISCUSSION
Background
AD 22 (Grayson Woods) was formed in 1997 pursuant to the provisions of the Landscape and Lighting Act of 1972 and the California Streets and Highways Code. AD 22 was amended in 2002 to include Subdivision 8304, Gallery Walk. AD 22 enables the City to collect assessments from property owners in order to provide landscape maintenance and street lighting at an enhanced level and quality within the Grayson Woods and Gallery Walk Subdivisions (see maps). These services are considered to be of direct benefit to the properties within the AD 22 boundaries. The costs for providing these services have been paid annually by these benefiting property owners.

Analysis
The collecting of assessments from properties within the boundaries of AD 22 will ensure continued maintenance of lighting and landscape improvements. Since July of 2007, City staff has provided Item 10.2.

City Council Meeting Agenda - Page 61 of 84 - Monday, February 03, 2025 maintenance services for Grayson Woods (previously contracted out to a private landscape company), and City staff continues to provide maintenance services for Gallery Walk through the collection of assessments. The maintenance activities include weekly mowing and edging of turf; maintenance and repair of irrigation systems; pruning; debris removal; graffiti removal; street light repair; maintenance and weeding, as well as utility charges for water and electricity.

In order for the City to continue to levy and collect assessments within AD 22 for the 2025/2026 fiscal year, the District Engineer must prepare an Annual Report. The Annual Report will include descriptions of the improvements to be made during the fiscal year, an estimate of costs, and the levy of assessments upon the benefiting properties.

The City issued a Request for Proposals for district engineering services in December 2024, as the same engineering firm had served as the Engineer of Work for AD 22 since 2019. The City received proposals from four qualified firms and selected SCI Consulting Group. Under this proposal, SCI Consulting Group would prepare the Annual Report and submit the assessments to the County Auditor for placement on the 2025/2026 Property Tax Roll. A not-to-exceed fee of $13,940 will provide for these services.

Once the Annual Report is complete, the City Council will review and approve it (if appropriate), be asked to approve a resolution announcing the intent to levy assessments for the current year, issue a notice of intent to levy and collect assessments within the District, and hold a public hearing on the levy of the assessments.

FISCAL IMPACT
The cost of preparing all necessary reports required for the levy and collecting of assessments will be borne by the property owners within the AD 22 boundaries. The not-to exceed amount for the engineering services specified in the Scope of Services and Compensation attachment is $13,940, which will be paid by the Assessment District.

PUBLIC CONTACT
Public Contact was made through posting of the City Council agenda on the City’s official notice bulletin board, at the Pleasant Hill Senior Center, and at the Pleasant Hill Police Department. The agenda and staff report are posted on the City’s web page.

RECOMMENDED CITY COUNCIL ACTION
Adopt the proposed resolution

ALTERNATIVES TO RECOMMENDED ACTION
Should AD 22 not be renewed for the 2025/2026 fiscal year, there would be a loss of approximately $72,480 in collected assessments to fund revenue maintenance activities within AD 22. The City would then need to fund these maintenance activities or maintenance would be suspended.

CITY COUNCIL STAFF REPORT
Meeting Date: February 3, 2025
TO: THE HONORABLE MAYOR AND CITY COUNCILMEMBERS
TITLE: Approve the Appropriation of Street Resurfacing Funds to Fund the Resurfacing of Contra Costa Boulevard (Harriet Drive to Viking Drive), Taylor Boulevard (Contra Costa Boulevard to Terry Way), and Sun Valley Boulevard (Contra Costa Boulevard to Santa Monica Drive) as part of the Contra Costa Boulevard Improvement Project No. 02-23 and Authorize the Public Works Director to Execute a Construction Change Order with Redgwick Construction Company

SYNOPSIS
The Contra Costa Boulevard Improvement Project (Viking Drive to Harriet Drive) No. 02-23 (Project) provides for complete streets enhancements along Contra Costa Boulevard (CCB) between Viking Drive and Harriet Drive. The purpose of this item is to consider the appropriation of available Street Resurfacing Funds to pay for the inclusion of asphalt pavement restoration in the project scope and to seek authorization to execute a construction change order with Redgwick Construction Company for the work.

The Budget Committee reviewed staff’s proposal at its meeting of January 28, 2025, and approved forwarding a recommendation to City Council to approve the appropriation of the funds and issuance of the change order to Redgwick Construction Company.

DISCUSSION
Background
The Contra Costa Boulevard Improvement Project (Viking Drive to Harriet Drive) No. 02-23 (Project), is an approved project in the Fiscal Year 2024-2029 Capital Improvement Plan (FY 24- 29 CIP), and will construct "complete streets" enhancements along Contra Costa Boulevard, (CCB) between Viking Drive and Harriet Drive.

In June 2017, the Contra Costa Transportation Authority (CCTA) approved and programmed $4,792,000 in a combination of Measure J grant funding for the construction of the Project, which was subsequently appropriated in May 2023. These funds will expire in May 2026.

The final project design consisted of “complete streets” improvements along approximately 0.25 miles of CCB between Harriet Drive and Viking Drive. Project improvements include safety and access for all users (pedestrians, transit riders, bicyclists, and motorists) and modernization of street aesthetics. Key project elements include street lighting; bike/pedestrian upgrades; modifications to Item 10.3.

City Council Meeting Agenda - Page 79 of 84 - Monday, February 03, 2025 the traffic signals and intersection geometry at CCB and Taylor Boulevard; a new traffic signal at CCB and Alan Drive; replacement of ADA curb ramps; traffic striping modifications; bicycle lanes; median re-configuration; LED street lighting; and drought-tolerant landscaping.

The project was competitively bid in April 2023, and three responsive bids were received on June 6, 2023. Staff analyzed the bids and revealed that the lowest bid received was approximately 25% over the approved construction cost. Staff recommended rejecting all bids, modifying the bid documents to incorporate cost-saving measures, and rebidding the project. On June 26, 2023, the City Council approved Resolution No. 49-23, approving staff’s recommendations.

Staff worked closely with CCTA and Bellecci, the design consultant, to revise the project scope while still providing the necessary improvements to meet the City’s project goals of enhanced safety along the corridor, as well as the CCTA grant requirements. One major revision included the elimination of the resurfacing of Contra Costa Boulevard within the project limits and including it in a later Street Resurfacing Project.

As part of our Pavement Management Program, the City of Pleasant Hill evaluates the condition of each street in the City every two to three years to determine overall condition of the roadways.

Staff uses this information to help identify the City's pavement resurfacing schedule. The City completed this street survey in the spring of 2022, at which time each street was ranked on a scale from 1 (worst) to 100 (new road). This is called the Pavement Condition Index (PCI). The average PCI for CCB (between Harriet Drive and Viking Drive) at that time was a 70 or “Good.” This information was the basis for the decision to eliminate the resurfacing within the project limits.

The project was subsequently rebid, and on April 15, 2024, the City Council awarded the project to Redgwick Construction Company.

Analysis
During construction staff identified several asphalt pavement failures along the project limits. As the City is currently working with a consultant to perform the 2025 street survey, we requested our consultant expedite the analysis of the current roadway condition and provide an updated PCI for this section of CCB. The new average PCI for this section of roadway is now a 57 or “Fair.” Once a PCI falls below a 65, the deterioration of the roadway accelerates, and the asphalt pavement will quickly continue to fail. As the PCI goes down, the cost to repair the roadway increases.

An aspect of the CCB project is new striping along the project corridor including new bike lanes, green bike markings, as well as high visibility crosswalks at the Contra Costa Boulevard/Taylor Boulevard intersection. The estimated value of these striping improvements is $310,000. Due to the deterioration of the asphalt pavement, staff has determined the project limits should be resurfaced prior to installing the new roadway striping. This will maximize the City’s resources and ensure the integrity of the roadway and new striping.

The total cost of the resurfacing work is $1,233,865 (see attached). Staff is recommending an appropriation of $1,233,865 from available FY2024-25 Street Resurfacing Funds to the Contra Costa Boulevard Improvement Project No. 02-23, and that Redgwick Construction Company be issued a change order for the work. Staff has confirmed with the Finance Division that there are sufficient Street Resurfacing funds to finance the change order work.

Item 10.3.

City Council Meeting Agenda - Page 80 of 84 - Monday, February 03, 2025 A portion of this change order work is on Willow Pass Road (between Contra Costa Boulevard and Santa Monica Drive) within the city of Concord’s right-of-way. Staff has met with the city of Concord’s City Engineer and informally agreed upon Concord’s “fair share cost” of $125,000, which equates to all the proposed change order work within the city of Concord’s limits. A formal agreement between the city of Concord and the city of Pleasant Hill is currently being finalized, and the city of Concord will reimburse the city of Pleasant Hill for this portion of the work.

FISCAL IMPACT
The total cost of the resurfacing work is $1,233,865. Staff is recommending an appropriation of $1,233.865 from available FY 2024-25 Street Resurfacing Funds to the Contra Costa Boulevard Improvement Project No. 02-23 and the issuance of a change order to Redgwick Construction Company for the work. Staff has confirmed with the Finance Division that there are sufficient Street Resurfacing funds to pay for the change order work. The city of Concord has agreed to reimburse the City $125,000 for its fair share of the change order work.

At its January 28, 2025 meeting, the Budget Committee recommended Council’s approval of the proposed appropriation of available funds and the issuance of the change order.

Adopt a resolution approving the appropriation of Street Resurfacing Funds to fund the resurfacing of Contra Costa Boulevard (Harriet Drive to Viking Drive), Taylor Boulevard (Contra Costa Boulevard to Terry Way), and Sun Valley Boulevard (Contra Costa Boulevard to Santa Monica Drive) as part of the Contra Costa Boulevard Improvement Project No. 02-23 and authorizing the Public Works Director to execute a construction change order with Redgwick Construction Company.

ALTERNATIVES TO RECOMMENDED ACTION
Alternatively, City Council may choose not to authorize the proposed change order work for the Contra Costa Boulevard Improvement Project No. 02-23 and provide direction to staff.
