RESOLUTION NO. ______-25
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANT HILL
FINDING AND DECLARING THAT AN EMERGENCY CONDITION EXISTS ARISING FROM DAMAGE TO THE CITY’S POLICE DEPARTMENT ROOF AND
AUTHORIZING EMERGENCY REPAIR TO THE ROOF WITHOUT PUBLIC BIDDING; AUTHORIZING THE TRANSFER OF AVAILABLE PEDESTRIAN AND
BICYCLE PROGRAM FUNDS TO THE POLICE DEPARTMENT ROOF REPLACEMENT PROJECT; AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONSTRUCTION CONTRACT WITH STATE ROOFING, INC.
WHEREAS, Sections 22035 and 22050 of the Public Contracts Code authorize the City of Pleasant Hill (“City”) to proceed with awarding a public works contract to perform emergency work upon adoption by the City Council by a four-fifths vote of a resolution declaring that the public interest and necessity demand the immediate expenditure of public funds to safeguard life, health, or property;
WHEREAS, the City of Pleasant Hill’s Police Department facility roof is in need of emergency repair as a result of a termite infestation;
WHEREAS, the repairs are necessary to preserve the health, safety and welfare of the City and the City’s residents utilizing the Police Department; WHEREAS, the need for replacement of the entire City of Pleasant Hill’s Police Department facility roof requires immediate action that will not permit undergoing the formal competitive bidding process because of a termite infestation in the roof sheeting of the structure’s roof. The Police Department is a designated emergency building that is open 24/7, and cannot be tented to complete the fumigation process to eradicate the termites; therefore, the Chief Building Official has determined that the Police Department’s building roof is in need of immediate repair, in its entirety, and that the termites should be fumigated immediately, as once they infiltrate a structure, the infestation will continue to spread, continuing to damage the structural integrity of the roof, and if left unabated, potentially the entire Police Department building.
WHEREAS, the City’s engineering staff solicited proposals from State Roofing, Inc., SF Roofing Company and Pioneer Roofing and received a written acceptable proposal to perform the emergency work from State Roofing, Inc., and the City now wishes to award an emergency contract for the Police Department Emergency Roof Repair Project to State Roofing, Inc.; and WHEREAS, Public Contract Code section 22050 also provides that the City Council may, by resolution, delegate the authority to order any action required by the emergency and to procure the necessary equipment, services, and supplies for those purposes, without giving notice for bids to let the contracts, to the City Manager, or designee, or any other officer.
WHEREAS, Pursuant to section 15301 of the Guidelines for Implementation of the California Environmental Quality Act (CEQA) of 1970, as amended, the Zoning Administrator has determined that this project is determined to be a Class 1 (Existing Facilities) categorical exemption because the project includes the repair of an existing facility.
WHEREAS, the Police Department Roof Replacement Project is a funded project in the approved FY2024/2029 Capital Improvement Program as the roof has reached the end of its useful life: and
WHEREAS the Police Department Roof Replacement Project initially provided for the reroofing of the existing roof; and WHEREAS, the Police Department Emergency Roof Replacement Project provides for the removal and replacement of the existing roof in its entirety; and WHEREAS, the total cost of construction for the Police Department Emergency Roof Replacement Project, including 10 percent contingency, will be approximately $558,558, which exceeds the original project budget and;
WHEREAS, there are available Measure K funds in the FY 2024/2025 Pedestrian and Bicycle Program funds to bridge the project budget shortfall; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANT HILL, CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. Recitals. The above recitals are true and correct.
Section 2. Findings. The City Council finds that the public interest and necessity demand the immediate expenditure of public funds for emergency work for the Police Department Emergency Roof Repair Project to safeguard life, health and property. The City Council further finds that the emergency will not permit a delay that would result from a competitive solicitation for bids and that action is necessary to respond to the emergency related to the damaged condition of the City’s Police Department roof. The City Council further finds that based on the foregoing, the approvals herein authorized are necessary to protect the public health, safety and welfare.
Section 3. Award of Contract; Delegation of Emergency Contracting Authority. • A contract to perform the necessary emergency repair work to the City’s Police Department roof is hereby awarded to State Roofing, Inc. for $507,780, and the City Manager, or designee, is hereby authorized to execute said contract, and to order any other action required to remedy the emergency relating to the damaged condition of the Police Department facility roof, and to procure the necessary equipment, services, and supplies for those purposes, without giving notice for bids to let contracts. • A 10% contingency ($50,778) is also authorized for the work. • The City Council authorizes the appropriation and transfer of Measure K funds from the FY2024/2025 Pedestrian and Bicycle Program funds to the Police Department Roof Replacement Project and increase the Police Department Roof Replacement Project budget in the amount of $258,558 (including 10% contingency) to complete the Police Department Emergency Roof Replacement Project.
• The City Manager, or designee, is directed to report to the City Council at the next regularly scheduled meeting and at every meeting thereafter until the action is terminated to determine if there is a need to continue the action.
