RESOLUTION NO. -26
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANT HILL ACCEPTING THE 2025 POTHOLE REPAIR AND ASPHALT CONCRETE (AC) PATHWAY OVERLAY PROJECT NO. 01-25 AS COMPLETE AND AUTHORIZING THE PUBLIC
WORKS DIRECTOR TO ISSUE AND RECORD A NOTICE OF COMPLETION WHEREAS, the 2025 Pothole Repair and AC Pathway Overlay Project No. 01-25 is an identified and approved project in the 2024-2029 Capital Improvement Plan; and WHEREAS, the 2025 Pothole Repair and AC Pathway Overlay Project No. 01-25 provides for the repair of pavement on arterial, collector and residential streets, as well as surface treatment for selected AC pathways throughout the City; and
WHEREAS, the 2025 Pothole Repair and AC Pathway Overlay Project No. 01-25 is categorically exempt from environmental review under the California Environmental Quality Act pursuant to California Code of Regulations Title 14, Chapter 3, Section 15301 as a Class 1 categorical exemption (operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination) and Section 15302 as a Class 2 categorical exemption (replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced such as the replacement or reconstruction of existing utility systems and/or facilities involving negligible or no expansion of capacity); and WHEREAS, on August 18, 2025, the City Manager, pursuant to the authority vested in City Council in Resolution No. 41-25, executed a contract with Rapid Grading Services, Inc. to perform work described in contract documents 2025 Pothole Repair and AC Pathway Overlay Project No. 01-25; and
WHEREAS, the work has been performed to the satisfaction of the City, and Rapid Grading Services, Inc. is requesting final payment for the completed work; and WHEREAS, the California Public Contract Code requires the City to notify the public of acceptance of a project prior to making a final payment.
NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Pleasant Hill that the work performed as the 2025 Pothole Repair and AC Pathway Overlay Project No. 01-25 is complete to the satisfaction of the City and is hereby accepted as complete.
BE IT FURTHER RESOLVED, that the Public Works Director is authorized to execute a Notice of Completion and record it with the Office of the Recorder of the County of Contra Costa, State of California, within 10 days from the date thereof. [Signatures on the Following Page]
