CITY COUNCIL STAFF REPORT
Meeting Date: March 16, 2026
TO: THE HONORABLE MAYOR AND CITY COUNCILMEMBERS
TITLE: ADOPT RESOLUTION NO. ___-26 ACCEPTING THE SUBDIVISION IMPROVEMENTS FOR SUBDIVISION 9520 (401 TAYLOR BOULEVARD)

AS COMPLETE

SYNOPSIS
CDP PH Holding LLC, a Delaware Limited Liability Company (Catalyst), and Shea Homes have constructed the improvements for Subdivision 9520 (401 Taylor Boulevard) in accordance with the terms of the Subdivision Agreement with the City. It is now appropriate for the City to accept these improvements as complete.

DISCUSSION
On August 16, 2021, the City Council adopted Resolution No. 57-21, approving Vesting Tentative Map (PLN 21-0028) for the 401 Taylor Boulevard II – Small-Lot Single Family Residential Major Subdivision (Tract 9520). The Major Subdivision created 31 new residential parcels within the

4.96-acre project site. The residential lots range in size from 3,105 square feet to 5,669 square feet with two-story, single-family detached homes, associated open space areas, and related landscaping and private site improvements. Six of the homes (20% of the subdivision) contain Accessory Dwelling Units. In addition to the residential parcels, the subdivision also created four common parcels that are owned and maintained by the homeowner’s association.

Catalyst entered into a Subdivision Improvement Agreement with the City of Pleasant Hill on August 11, 2022, for the construction of street and other subdivision improvements associated with Subdivision 9520. Public improvements were constructed along the project frontage at Lucille Lane and Taylor Boulevard. The public improvements included new sidewalk, curb, and gutter, paving and undergrounding of existing overhead utilities on Lucille Lane, along with new landscaping and an 8-foot-wide meandering asphalt walking path along Taylor Boulevard. Private improvements comprised new streets, sidewalks, utilities, landscaping, and storm drain improvements with stormwater treatment facilities.

Catalyst provided a Faithful Performance Bond and a Labor and Material Bond to guarantee construction of the improvements. On October 16, 2023, Catalyst notified the City that the remaining portions of the project had been sold to Shea Homes. As part of the acquisition agreement, Catalyst agreed to retain responsibility for the Faithful Performance Bond and the Labor and Material Bond covering both the onsite and offsite improvements.

The Subdivision improvements are now complete, and the developer is requesting the bonds for this work be released.

The work was originally secured with the following bonds:
 Faithful Performance & Labor and Material Bond #0810749 for on-site improvements in the amount of $1,531,233;
 Faithful Performance Bond & Labor and Material Bond #0810742 for off-site improvements in the amount of $1,180,344.

On February 14, 2024, the City allowed for a reduction of securities to the following amount:
 Faithful Performance & Labor and Material Bond #0810749 for on-site improvements in the amount of $500,000;
 Faithful Performance Bond & Labor and Material Bond #0810742 for off-site improvements in the amount of $500,000.

Prior to the release of the Faithful Performance Bonds, Catalyst will provide a Warranty Bond in the amount of $150,000, which is 15% of the total cost of the on-site and off-site improvements.

The warranty bond will be held for twelve months after acceptance of the improvements. The Labor and Material Bond will be released six months after the acceptance of the improvements.

The release of all improvement securities is in accordance with Pleasant Hill Municipal Code Section 17.35.070.D.

FISCAL IMPACT
The requested action has no impact to the City’s General Fund in annual maintenance costs, as all improvements and landscaping are maintained by the homeowners’ association. There will be an increase in property tax revenue because of the higher value of the housing development as compared to the previous land use conditions. The constructed private improvements (street, sidewalks, and landscaping) will be maintained by the abutting property owners or homeowners’ association.

PUBLIC CONTACT
Public Contact was made through posting of the City Council agenda on the City’s official notice bulletin board, at the Pleasant Hill Senior Center, and at the Pleasant Hill Police Department. The agenda and staff report are posted on the City’s web page.

RECOMMENDED CITY COUNCIL ACTION
Staff recommends the City Council adopt the proposed resolution accepting the improvements for Subdivision 9520 (401 Taylor Boulevard) as complete.

ALTERNATIVES TO RECOMMENDED ACTION
None recommended. The City is required to accept the constructed improvements once the applicant complies with the terms of the Subdivision Agreement. The Warranty Bond ensures the constructed improvements will be guaranteed through the one-year maintenance and warranty period.
