A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANT HILL
APPROVING PARTICIPATION IN THE CONTRA COSTA COUNTY REGIONAL
ALTERNATIVE COMPLIANCE JOINT POWERS AUTHORITY (RAC JPA) AND
AUTHORIZING THE CITY MANAGER TO IMPLEMENT THE PROGRAM
WHEREAS, the City is a Permittee under the Municipal Regional Stormwater National Pollutant Discharge Elimination System (NPDES) Permit (MRP), which requires the City to implement post‑construction stormwater treatment through Low Impact Development (LID)/Green Stormwater Infrastructure (GSI) pursuant to Provision C.3; and WHEREAS, many development and redevelopment sites within the City face physical, topographic, utility, or space constraints that limit their ability to construct on‑site LID/GSI facilities to meet the full requirements of Provision C.3; and WHEREAS, the Contra Costa County Regional Alternative Compliance (RAC) System was developed as a legally authorized alternative compliance mechanism under MRP Provision C.3.e to provide flexibility and cost‑effective stormwater treatment options; and
WHEREAS, the RAC System allows for the construction of certified Off‑Site Green Stormwater Infrastructure projects that generate “compliance units,” which may be purchased by developers or public agencies when on‑site compliance is infeasible; and WHEREAS, the Contra Costa County RAC Joint Powers Authority (RAC JPA) has been formed pursuant to Government Code Section 6500 et seq. for the purpose of administering the RAC System, including certification of Off‑Site GSI projects, management of compliance transactions, funding of long‑term operations and maintenance, and oversight of reporting requirements; and
WHEREAS, participation in the RAC JPA provides the City with a cost‑effective and regionally coordinated approach to meeting stormwater regulatory requirements, including MRP Provisions C.3.d, C.3.j, and pollutant load reduction obligations such as PCBs TMDL C.12.c.
NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Pleasant Hill that,
SECTION 1. The City Council hereby approves the City’s participation in the Contra Costa County Regional Alternative Compliance Joint Powers Authority (RAC JPA) and authorizes the City Manager, or designee, to execute the Joint Powers Agreement in substantially the form presented, subject to minor modifications approved by the City Attorney.
SECTION 2. The City Council hereby directs the City Manager, or designee, to collaborate with the RAC JPA in its implementation, including participation in RAC System governance, Off‑Site GSI project certification and verification, use of the RAC Tracking Tool, annual reporting, and any local ordinance or procedural updates necessary to utilize the RAC System.
SECTION 3. The City Council hereby authorizes the City Manager, or designee, to take all administrative, procedural, and operational steps necessary to implement participation in the RAC System and maintain compliance with Municipal Regional Permit requirements.
SECTION 4. This resolution shall take effect immediately upon adoption ADOPTED by the City Council of the City of Pleasant Hill at a regular meeting held on the 1st day of June, 2026, by the following vote:
