CITY COUNCIL STAFF REPORT
Meeting Date: June 15, 2026
TO: THE HONORABLE MAYOR AND CITY COUNCILMEMBERS
TITLE: ADOPT RESOLUTION NO. __-26 AUTHORIZING THE CITY

MANAGER TO EXECUTE THE AMENDED AND RESTATED CONTRA
COSTA CLEAN WATER PROGRAM AGREEMENT (2026-2041)

SYNOPSIS
To assist in achieving compliance with the provisions of the Municipal Regional Permit (MRP), the City of Pleasant Hill is a participant in the Contra Costa Clean Water Program (CCCWP), which enables Contra Costa cities, towns, and unincorporated areas—collectively referred to as “permittees”—to implement local and countywide stormwater programs in a coordinated manner.

The current joint program agreement has expired and is being replaced with a new, amended and restated Agreement effective July 1, 2026, through June 30, 2041.

The purpose of this item is to consider adopting a resolution authorizing the City Manager to execute the amended and restated Contra Costa Clean Water Program Agreement (2026-2041).

DISCUSSION
Background
The CCCWP was established in 1991 to enable Contra Costa County, its cities, and the Flood Control District to comply with stormwater regulations jointly under the National Pollutant Discharge Elimination System (NPDES) permit. Over the years, the Program Agreement has been periodically updated to reflect evolving regulatory requirements. The current CCCWP Agreement was adopted in 2010 and expired in 2025. Due to the expiration of the current agreement, CCCWP has continued operating on a month‑to‑month basis, maintaining existing provisions and program responsibilities to ensure ongoing compliance with the Municipal Regional NPDES Permit until a new long-term agreement is approved.

Since January 2025, CCCWP Management Committee has reviewed a draft renewal agreement that introduces significant updates to administrative processes, committee structures, and compliance frameworks. Additionally, the amended and restated agreement for July 1, 2026 – June 30, 2041, outlines long-term obligations, cost-sharing formulas, and governance provisions for all co-permittees.

Key updates in the draft renewal include:
 Administrative Updates – Updating contracts to better match Contra Costa County procedures and clarify legal responsibilities.
 Committee Organization – Creating a simpler committee structure with participation levels based on city size and clearer roles for subcommittees.  Continuity of the Program – Adding procedures for member withdrawal while ensuring the program continues without interruption during agreement renewals.  Staffing Flexibility – Allowing additional staffing support when needed to avoid disruptions in program operations.
 Cost Sharing – Dividing future program costs among agencies using a population-based formula.

FISCAL IMPACT
There is no immediate fiscal impact. Future costs will be allocated proportionally based on population, as outlined in the Agreement’s cost-sharing formula. SUA assessments will continue to offset program costs for participating agencies.

If the City does not to execute the amended agreement, it will no longer participate as a permittee in the CCCWP and would face uncertainty surrounding funding and resources required to the meet future MRP requirements. Failure to comply with the MRP requirements could result in enforcement action by the Water Board, including a cease-and-desist order and fines of up to $10,000 per day.

PUBLIC CONTACT
Public Contact was made through posting of the City Council agenda on the City’s official notice bulletin board, at the Pleasant Hill Senior Center, and at the Pleasant Hill Police Department. The agenda and staff report are posted on the City’s web page.

RECOMMENDED CITY COUNCIL ACTION
Move to adopt the proposed resolution authorizing the City Manager to execute the amended and restated Contra Costa Clean Water Program Agreement (2026-2041).
