REJECTING ALL BIDS FOR THE CITY HALL POND AND FOUNTAIN
REHABILITATION PROJECT, PROJECT NO. 01-24; AND DIRECTING STAFF TO
MODIFY THE BID DOCUMENTS AND RE-BID THE PROJECT USING
DESIGN OPTION 1
WHEREAS, the City has adopted the FY 2024–2029 Capital Improvement Plan (CIP), which includes the City Hall Pond and Fountain Rehabilitation Project, Project No. 01-24, (Project CP-24-004 in the CIP) as a funded project; and
WHEREAS, On October 2, 2023, per Resolution No. 70-23, the City Council authorized the City Manager to execute a Design Professional Services agreement with Robert Nebolon Architects (consultant) for several different conceptual renovation proposals that would illustrate needed updates to the pond and fountain area based on project cost; and WHEREAS, On February 26, 2024, the City Council reviewed two conceptual design options; and
WHEREAS, Design Option 1 includes fountain and plaza tile replacement, minor fountain plumbing upgrades, and retains the marine life in their current locations; and WHEREAS, Design Option 2 separates the pond into a split system where the large pond will become an urban ornamental “lake”, and the marine life will be transferred to the new “koi pond”; and
WHEREAS, the City Council expressed interest in separating the water bodies into two systems and directed staff to pursue Design Option 2; and WHEREAS, the City Hall Pond and Fountain Rehabilitation Project, Project No. 01-24 was awarded to the low bidder at the December 2, 2024 City Council meeting and the project agreement was not executed; and
WHEREAS, on May 1, 2026, engineering staff rebid the project; and WHEREAS, on May 27, 2026, at 2:00 p.m., Engineering staff publicly opened and read aloud one bid for the City Hall Pond and Fountain Rehabilitation Project, Project No. 01-24; and WHEREAS, the bid proposal of $8,698,744.00 from the lowest responsible bidder is approximately three times greater than the construction budget; and WHEREAS, the California Uniform Construction Cost Accounting Commission requires that the City award a contract to the lowest responsive bidder or reject all bids; and WHEREAS, staff concluded that the costs associated with separating the two ponds entirely added a significant cost to the project, and that removing this portion from the scope will help ensure that future bids will land within the $2.2 million budget; and WHEREAS, the Public Works Director recommends that the City Council of the City of Pleasant Hill reject all bids received for the City Hall Pond and Fountain Rehabilitation Project, Project No. 01-24, and direct staff to modify the bid documents and re-bid the project using design option 1.
NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Pleasant Hill that,
