Honor able Mayo r Br own and City Co uncil Member s Ar kin, Tes ta, Nibe r t and Balch,
I have been following the r econfigur a tion of the City’ s Commis s io ns clos ely s ince or iginally pr o pos ed for a number of r eas ons . As a pas t Com m is s ioner on both the Libr ar y and Human Se r vices Com m is s ions for ten year s I am fam iliar with the pas t or ganization o f the Com m is s ion m eetings , the Commis s io ner s ' r es po ns ibilities a nd the s co pe o f their influence . The Co mmis s io ner s ar e tas ked with mee ting r egular ly to pr ovide as s is tance and r ecomm enda tions to the City Council. The Commis s io ner s tr aditiona lly br ing up pr ior ities to s taff to be conveye d to the City Council as member s of the co mmunity. I appr eciate the effor ts ma de to cr eate a 5 ye ar s tr ategic plan and the City Staff’ s effo r ts to ma nage thes e changes .

Some of the Co m mis s ions have lengthy Community Gr ants to r evie w which r equir e s s ever al hour s a nd ann entir e Commis s io n mee ting to dis tr ibute gr ant funding for a r ts and human s e r vices gr ants and additiona l m eetings to r eview thos e gr a nts .

When on the Comm is s ions , I met o nce a mo nth r outinely. The Libr ar y Com m is s ioner s wo uld fr equently br ing up items fo r the next mee ting' s a genda and ha d many r es po ns ibilitie s r elated to the Libr ar y and the co mmunity. We als o had m eetings to update us o n the unho us ed and and the nee ds o f the m o s t vulner able membe r s of the co mmunity.

S ince attending the ye ar ly Comm is s ion and Com m itte e Recognition Events , I ha ve been s tr uck by the s ignifica nt amount of wor k and co mpleted pr ojects that ar e a cco m plis hed beca us e of the ins pir atio n a nd ener gy of the Commis s io ner s and Comm is s ions , fr o m the B er nal Co m munity Par k, Public Ar t and Ar ts Facilities , s uch as the Fir ehous e Ar ts Center to affor dable Senior ho us ing, low cos t health ca r e and mea ls fo r the m os t vulner able in our comm unity. I under s tand and appr e ciate the City Staff’ s r o le in thes e a cco m plis hm ents as well.

Recently I have he ar d that s om e Comm is s ion member s feel they ar e no t being utilized as hoped when appointed to their r o le on the Com m is s ion due to canceled me etings or pr es entatio ns by s taff a nd o the r gr oups that don' t have much to do with the Comm is s ion' s r ole o r pr io r ities . This s ens e of fr us tr ation and feeling mar ginalized can lead to fewer individuals wanting to par ticipate in loca l gover nment o r feeling they ar e par t of s olutions to building a be tter co m munity. It ca n a ls o m ake it appea r that the Co mmis s io ns don’ t ha ve e nough a ction item s or need to meet as individual gr oups o r as r egular ly as they have in the pa s t year s .

As a member of the Pleas anton Cultur al Ar ts Council, I am fa miliar with the s ignificant le ngth o f tim e it take s to s chedule m eetings with the Civic Ar ts Com m is s ion to mo ve per ma nent public ar t pr ojects for war d for appr oval. City Council Meeting Date February 20, 2024
Agenda Item Number Agenda Item # 2 and # 13 in the Agenda Packet, Comments To our Mayor, Council members, and City Staff, I am writing in support of Kelly Cousin' s letter regarding the importance of continuing to have a Civic Arts Commission ( see below).

Although I have not yet served on any commissions, I hope to do so once I have sorted out business issues in the wake of my husband, Don Lewis' s, passing.

When we moved to Pleasanton in 1981 there wasn' t much going on in the the arts except a handful of residents with a vision to create opportunities for this community to shine and thrive with arts as part of our lifestyle. Wb have come so far with the help of incredibly strong hearted, talented, and generous citizens and support from the city and the Civic Arts Commission. It' s difficult to think that we' d even consider taking a step backwards by combining the arts and library commissions because both are equally important but have different needs and structure. 1/lb need an active Civic Arts Commission to continue to process the art projects being gifted to our city by the Harrington' s art bequests as well as continued growth in our city' s other arts programs.

I appreciate your time and consideration in making sure that our Civic Arts Commission stays intact and on track to keep moving forward to foster and protect the current arts projects and those of the future.

Sincerely,
Julie Lewis
Pleasanton, CA 94566
Hello Fellow Residents and Past Commissioners,
This coming Tuesday, February 20th, the Pleasanton City Council will be considering the City Staff and the Ad Hoc Committees' recommendations on reconfiguring some of the Commissions to decrease the numbers of commissioners, number of meetings and possible collaspe of some commissions. Some of the
recommendations that have already been made have helped with more effective meetings such as decreasing the numbers in the Economic Vitality Committee Members.

Please see Agenda Item # 2 and # 13 in the Agenda Packet, https:// pleasantonca. portal. civicclerk. com/ event/ 121/ files/ agenda/ 177).

I have also attached a pdf of agenda item # 13 below.

I have been following this issue closely since originally proposed for a number of reasons. As a past Commissioner on both the Library and Human Services Commissions for ten years I am familiar with the past organization of the Commission meetings, the Commissioners' responsibilities and scope of their influence. The Commissioners are tasked with meeting regularly to provide assistance and recommendations to the City Council. The Commissioners bring up priorities to staff to be conveyed to the City Council as members of the community. There have been some changes to past practices of addressing the Council in a Priority Meeting with Commissioners every two years since adopting the new Strategic Plan " ONE Pleasanton", however the responsibilities of the Commissioners remain the same.

If the Council votes to accept staff' s recommended " reorganization" of the Commissions, for example putting the Civic Arts with the Library Commissions to meet together, this would make it extremely difficult to get through each of the group' s action items and mandates within the scheduled meeting dates. Some of the Commissions have lenthy Community Grants to review which requires several hours and an entire Commission meeting to distribute grant funding for arts groups and for human services programs. The commissions each have different functions and therefore the impact of merging two different commissions would mean less effective and efficient adisory services to the community and the City Council.

When on the Commissions, I meet once a month routinely. The Library Commissioners would frequently bring up items for the next meeting' s agenda and had many responsibilities related to the Library and the community. k met once a year to make a presentation to the Council. I was additionally asked to served as a representative from the Library Commissioner on many task forces to help develop the Youth Master Plan, the Cultural Arts Plan and on other committees representing the interests of Pleasanton residents.

Since attending the yearly Commission and Committee Recognition Events, I have been struck by the amount of work and completed projects that are accomplished because of the inspiration and energy of the Commissioners and Commissions, from the Bernal Community Park, Public Art and Arts Facilities, such as the Firehouse Arts Center, to affordable housing and low cost health care and meals for the most vulnerable in our community.

Recently I have heard that some members of the commissions feel they are not being utilized as hoped when appointed to their role on the Commission due to staffing scheduling challenges and canceled meetings, presentations by groups that don' t have much to do with the Commission' s role or priorities. This sense of frustration and feeling marginalized can lead to fewer individuals wanting to participate in local government or that they are part of solutions to building a better community.

I also have seen first hand as a member of the Pleasanton Cultural Arts Council the significant length of time it takes to schedule meetings with the Civic Arts Commission to move permanent public art projects forward for approval. .

Please consider weighing in on the idea of collapsing the commissions and the other suggested changes to the advisory bodies who have helped shape Pleasanton over the years and enrich our quality of life.

You can write an email to the City Council at
CityCouncil@cityofpleasantonca. gov by noon on this Tuesday, February 20th. You can also attend the Council meeting in person at 200 Old Bernal Avenue or by going to the City' s portal address above for instructions on submitting a comment before 7: 00pm. The agenda item is # 13.

Thank you for your time and interest.

Kelly Cousins
Responses to City Council agenda items – February 20, 2024 Item 2
Q: How are the positions on the EVC being transitioned? A: The business, educational and City Council representatives are coming off the EVC; those include Alameda County Fair Association, Pleasanton Chamber of Commerce, Pleasanton Downtown Association, Hacienda, Stoneridge Shopping Center, Visit Tri-Valley, PUSD Board of Trustees, and the City Council. These partners have regular meetings with City staff and/or elected officials to discuss issues, including a monthly business partners meeting, the City- PUSD monthly liaison committee meeting, participating in the Chamber’s monthly EDGR meetings, and Hacienda’s general manager has several recurring meetings with staff, such that these individual partners are in direct and continuous communication with the City.

As some positions were not filled in anticipation of the restructuring, there are currently 12 members on the EVC, including 6 business and community representatives. With the proposed structure, 5 industry sector representatives and one citizen-at-large member will remain on the committee; 3 new members would be recruited as part of the upcoming spring commission and committee recruitment process. The industry sector positions were identified based on the leading industries in Pleasanton’s economy, and incorporated into the new Economic Development Strategic Plan (i.e., life sciences, downtown business, information technology).

The chart below outlines the transition between categories, as denoted by the positions in green font.

Q: Why are Sections 1-3 of PMC Section 2.30.02 B regarding the duties of the Planning Commission being updated?
A: Regarding the redline changes to items 1-3 in the PMC amendments for Planning Commission: The suggested changes are clean up items – the existing phrasing of the items implied that the Planning Commission itself adopts the General Plan and Specific Plans (etc.), whereas in fact the Commission makes a recommendation to adopt, and then the City Council is responsible for adoption of these types of regulatory documents. And, the City does not have a “master plan” and has not in the past adopted “precise plans” – rather, we have a citywide General Plan, and more typically adopt specific plans or more generically “area plans” for more specific geographies. The language changes align to our actual practices.

Item 4
Q: Is there any opportunity for additional discussion on this item, including the in-lieu fee? A: Under SB 330, the City does have to take action using 5 or fewer hearings; however, this item could be continued while staying within that 5 meeting limit.

Item 7
Q: What is Livermore’s timing to bring forward the annexation and SOI amendment request to LAFCo?
A: Per Livermore staff, the request for annexation and SOI amendment is not expected to go to LAFCo until spring/summer of this year. The project will go to Livermore’s Planning Commission on 3/5/24 and City Council on 3/25/24 – those actions would include initiating the application to LAFCO for annexation/SOI amendment thereafter.

Q; Are there other similar parcels (in Pleasanton’s SOI) that it is likely/possible Livermore may seek to annex in the future?
A: Staff reviewed Livermore’s existing SOI boundaries and did not identify any properties with similar characteristics to the properties under consideration in the SOI amendment (i.e., within Livermore’s UGB, but outside their current SOI). The exception is SMP-38, which as discussed in the agenda report, is within Pleasanton’s Sphere, and Livermore in the past has signaled a desire to similarly amend their SOI to include it. However, that is not part of the current application or request. Note: all 3 parcels – SMP 38, 39 and 40 are owned by the same private landowner.

Q: Can you confirm that Pleasanton’s agreement or authorization is not required for LAFCo to modify the respective SOIs?
A: W ith respect to the SOI amendment, the City of Pleasanton’s agreement or consent is not required for LAFCo to change the SOI. However, LAFCo procedures encourage outreach and efforts to “amicably resolve SOI issues and boundary disputes through dialog with affected agencies.”

Item 12
Q: How will/did the City spend the Opioid Settlement funds? A: No opioid settlement funds have been spent at this point.

Q: What is meant by “net increase of $125,000 to fund additional costs associated with contracts for general repairs and maintenance” as the report doesn’t identify the driver of the cost change?
A: This increase is based on cost increases and additional utilization of various building and facility maintenance and repair contracts, such as custodial services, HVAC repairs, pool services, and fire sprinkler services.

Q: Why is the new Emergency Fund not included in our reserve percentage calculation? How is it ‘restricted’ for exclusion when the General Fund reserve policy states ‘for emergencies’? Should the COVID response and recovery also be included in the calculated percentage? A: Based on the City’s Reserve Policy, any committed and assigned reserves are excluded from the unrestricted/unassigned reserve calculation.

Q; Regarding the sentence: ‘Once a debt has been issued, $2.6 million will be restored to the Water Operating Fund”. This does not address debt service or the additional capital costs that may be more to a driver of the need for the debt (now at $14M when initially at $6M in the water rate study analysis). Council would have to approve of any debt arrangement? A: To get the work started on several priority water capital projects mentioned in the staff report, the Water Operating Fund is providing the cash needed as a short-term solution. Yes, Council would approve any debt arrangement; staff will be providing an update at the March 5 Council meeting.

Q: What is meant by ‘including this $2.6 million, the estimated ending fund balance becomes $8.9 million…” – does this mean an increase in expenses? A: In this case, including means adding back $2.6 million into the Water Operating Fund balance once the debt has been issued.

Q: Does the sentence “An increase of $77,000 in the Golf Operating Fund to account for additional Water Costs is recommended” presume an increase in expenses? Why is there no discussion as to updated projected balance?
A: Yes, that is correct; it is an increase in water expenses due to rate adjustments. The report focuses on select enterprise operations; there is adequate fund balance to cover this cost increase.

Q: Please explain the Capital Outlay adjustment (shown in Table 3). Way was 2023 high ($1.8M) and 2024 low ($719k, then adjusted to $746k). And what work was done? A: FY 2023 actuals are high at $1.8M due to new GASB 96 requirements related to Subscription Based Information Technology Arrangements (SBITAs) that local governments are now required to report. These costs are primarily estimated based on eligible IT/software subscription costs and duration. There are corresponding revenue offsets, so there is essentially no fiscal impact. Staff will add similar adjustments as part of the year-end reconciliation.

Q: Was the Council Chamber renovation increased in expenses by $475,000 offset by a grant? If we’re only increasing the special fund’s expenses, are the special funds revenues increased by the grant? Where/how is that accounted for?
A: This project is funded out of the Community Access Television Fund. Revenues for this fund come from the City’s collection of 1% of gross revenues from cable operators in the city to support Public, Educational and Governmental (PEG) channel facilities. There is a sufficient balance in the fund account to cover the $475,000 in expenses.

Q: Regarding Hacienda Business Park Owners Association, the agenda report mentions the maintenance and repair costs increasing by $150,000 by Vista Universal in Hacienda. What are they doing, and what is driving these expenses?
A: The City has an agreement with Vista Universal to maintain and repair the City’s portion of streetlights, parking lot lights, and parks pathway lights in the Hacienda business park area. During staff’s review of the FY 2023/24 budget, it weas determined that funds were not budgeted; based on prior year actuals and current year-to-date actuals, staff recommended budgeting $150,000 for the current fiscal year.

Q: The Repair and Replacement table (on page 7) contains Electric Leaf Blowers ($90,000) and then the next line contains Storage for Charging Stations ($100,000), is this meaning the gas- powered leaf blower ordinance estimated costs of $180,000 per the staff report that went to Council are now over budget by $10,000?
A: Yes, cost estimates were based on the information available at the time of the initial agenda report and are still being refined, which is reflected in the chart in this mid-year report.

Q: In the resolution, is the $8,000 general fund surplus discussed in the staff report the $7,710 in the resolution to move to the Unrestricted General Fund reserve? A: Yes, that is correct as figures were rounded in the staff report.
