SOME CROSSING GUARD OBSERVATIONS RE: CROSSWALK ON CASE
AVE IN FRONT OF HEARST ELEMENTARY SCHOOL: (I AM THE CROSSING GURARD AT THIS LOCATION.)
While all kindergartners who use this crosswalk come accompanied by adults, there are many first through fifth grade kids that are not accompanied by adults.
From time to time a child will dash out into the street and if not for an alert parent and/or crossing guard this is potentially dangerous.
Vehicles on Case Avenue, especially southbound (going toward Valley Ave) frequently exceed the posted 25 mph speed limit endangering pedestrians in crosswalk.
The number of vehicles just blowing through the crosswalk seems to be increasing thus further endangering pedestrians in crosswalk.

Workshop
Receive a report outlining a contingency menu of potential service reductions that would be discussed further as part of addressing the forecasted structural budget deficit
1. I s it accurate that the City doesn’t charge for credit card processing fees or doesn’t pass them along to the buyer? If so, how much is the City paying for processing fees? A. The City currently does not charge for credit card processing fees. The annual costs are about $441K including $233K for the General Fund and $208K for non- General Funds mainly related to the water and sewer programs. Staff is planning to incorporate credit card fees into the master fee schedule as part of the citywide fee update in FY 2024/25.
2. I understand the city’s not looking to the transient occupancy tax, but what is the analysis or discussion related to if we could (aka, how much rate increase, how much revenues, etc.)
A. If the transient occupancy tax rate is increased by 4% from 8% to 12%, we expect to generate about $2M in additional revenues.
3. Is the City not charging for field usage currently?
A. The City is not currently charging for field use fees. Field use fees are included in the current fee study and will be brought forward to City Council for consideration in the fall.
4. Regarding Item E, is the permit center cost neutral? A. The permit center is not full cost recovery. Planning does not operate with full cost recovery as to fees vs staff time.
Regular Meeting
Agenda Item #4 Garbage Rates
1. Why are the recommendations / conversations from the Waste & Recycling Subcommittee, including potential alternatives, not included within the Item 4 staff report? Specifically, there appears to be no discussion regarding the potential alternatives discussed at the Subcommittee meeting, why? A. The subcommittee is a place to share ideas and discuss options, and staff received helpful feedback and benefited from the discussion at the subcommittee meeting. Although the Council subcommittee members didn't reach a consensus, the discussion did help further develop staff’s thinking on this matter, which is reflected in the recommendation.
2 2. Can you outline staff’s basis for a change their recommendation from the $1M Vehicle Impact Mitigation Fee initially presented to the now recommended $1,329,400 Vehicle Impact Mitigation Fee?
A. The initial $1M recommendation that was brought to the subcommittee for discussion was adjusted after feedback and discussion with subcommittee members. The increased amount of $1.329M reflects the additional Vehicle Impact Fee that could be included while maintaining an overall recommended rate increase of 3.9%, which is consistent with the Consumer Price Index (CPI).
3. I’d like to understand how much of the $2,909,800 calculated potential Vehicle Impact Mitigation Fee is currently being funded via General Fund dollars vs Grants received by the City – I think we discussed at the Subcommittee the General Fund impact was ~$780k annually?
A. There is no direct General Fund funding included in the $2.9M VIF. The additional $1.3M + from garbage vehicle impact fees will help cover the identified shortfall for the resurfacing program to maintain the current Paving Condition Index (PCI). Below is a screenshot of project funding for this year resurfacing project.
Agenda Item #10 Public Service Easement at 870 St. John Court
4. Confirmation of whether there is a mapping error, not an additional potential trail access point to the creek trail at this location?
A. The public service easement (PSE) proposed for vacation was dedicated to the City across 870 Saint John Court for utility purposes, not trail access purposes.
The dedication language states in part, "...the undersigned does hereby dedicate to the public forever a public service easement for the installation and maintenance of all public utilities..." Currently, no utilities exist within the easement, and the City's utility purveyors (PG&E, AT&T, Comcast, and others) confirmed no plan for future utilities. Staff suspect that the easement was created for a storm drainpipe discharge into Arroyo del Valle, but a storm pipe was instead installed within Parcel A, the HOA common area parcel between 772
3 and 806 Saint John Circle. No storm drain infrastructure is needed within the PSE area.
5. Are there concerns for potential trail access in the future through the existing access and therefore, even if the easement was for that purpose, not expected to ever be needed? A. A trail currently exists along the north side of Arroyo del Valle within this reach.
Access to the trail from Saint John Circle is available through Parcel A between 772 and 806 Saint John Circle. The trail connection is guaranteed by an 8-foot wide "Trail" easement granted to the City. The trail easement aligns with walkway features constructed within the common area parcel including a low-flow culvert across the creek. No trail easements currently extend along the south side of Arroyo del Valle, and the steep, wooded terrain of the creek bank would make trail construction in this area infeasible. Because the PSE across 870 Saint John Court conveyed no rights associated with a trail connection, any future desire for a trail connection at this location would require a right-of-way acquisition process including compensation to the owner.
Agenda Item #17 Mid-Term Update
6. On page 10/13 – It states the Foothill HS Left Lane occurred in 2003, I presume typo and meant to be 2023.
A. The traffic signal was constructed in 2003. In 2021 construction began to modify the intersection to add a second southbound left turn lane to revert the traffic flow to pre-2003 flow so that students would not have to cross in front or behind vehicles to get to the sidewalk. In 2022 the construction of the second turn lane was completed. This project is to reimburse PUSD for work already completed.
4 7. On page 10/13 – It states that Turnout #4 is on the CIP list – is this correct? Aka CIP or Water Enterprises CIP? Are any of these items Enterprise CIP items that do not utilize General Fund money transferred to our CIP?
A. Yes, the booster station is for Turnout #4. Turnout #4 funding request was not included in the Near-Term Water Improvements funding request that was submitted to the Council on 3/19. Water bond proceeds will be used to fund this project.
8. On page 11/13 – The staff reports notes that staffing costs being added to CIP projects, can you elaborate on what this means please – where and how were those costs tracked or budgeted in the past? Is this a change in accounting? A. These costs have historically been charged to the capital funds at year end. This is a change to budgeting practice and will provide a better process for tracking overall costs.
9. On page 11/13 – CIP Table 3 reflects $3.5M for City Ground Water Supply – is this Water Enterprise funded?
A. The project will be funded with water bond proceeds.
10. Please explain the $880k being allocated for an ADA Transition Plan? Where, what, etc.?
A. The last full assessment was completed in 2004, and the ADA transition plan was updated in 2008. The situation and the amount of time that has lapsed requires the City to complete a full inspection for all facilities, ADA ramps and sidewalks. The $880K is for the required fieldwork to update the plan and the information will be added to the Asset Management Plan and future facilities plan. Please note that the $880K will not cover the full cost, which will be closer to $1M and we will have a better understanding of the costs once the proposals are in.
11. On page 23/23 – Please explain the W. Las Positas funding variances between the periods / budgets presented.
A. West Las Posita is funded by three funding sources including $6M from the Miscellaneous CIP Grant Fund (a new grant funded by ACTA) and annual allocations from the Gas Tax Fund and Measure BB Fund for $900K and $300K.
