RE: Special Workshop Review of Inclusionary Zoning Ordinance Dear Mayor and City Council Members:
We understandthe needto review and updatethis ordinance asthe provision of affordable housing is an important consideration for the City of Pleasanton. Ponderosa Homes has in the past provided significant quantities of affordable housing via both the inclusion of units within specific projects and the payment of inclusionary fees where this method is more practical and fits within the planning scopeof the project.
Our main concern with the current proposal is the amount of the in-lieu fee proposed and how it is applied. We understand the logic behind the fee calculation and how this method was vetted in thecourts. However, we alsobelieve therearesomeshortcomings in this methodin the assumption that that the size of the homes to which this fee is applied represents the sum of demands for servicesby the presumptive residents. We believe there should be a cap on the per s.f. fee for, as proposed, someone building a 3,000 s.f. house would pay $ 136, 710 as an in- lieu fee and someone building a 4,000 s.f. housewould pay $182,280. It’s hard to understandthe nexus of this method as the family occupying the 3,000 s.f. home might have 2-3 kids in school while the retired couple using their 30 years of home equity to build their 4,000 s.f house on a modest income spends considerably less. This is just one way to look at this fee and we would suggest that a maximum fee of $100,000 per unit could be more appropriate. This would almost double the current fee and address the inherent nexus question in applying the fee regardless of the size of the home.
Thank you for your consideration.

Re: Lions Wayside and Delucchi Park Renovations – Bid Advisory Regarding Integra Construction Services, Inc.
This bid advisory is submitted by NorCal Construction Industry Compliance ( herein " NCIC"), a joint labor-managementorganization formed pursuant to the Labor ManagementCooperation Act of 1978 ( 29 U. S.C. Sec. 175a). NCIC is committed to ensuring a level playing field for contractors and workers by promoting equitable contracting and ensuring compliance with all applicable state and federal labor laws governing the construction industry.
INTRODUCTION
NCIC monitors local construction projects to help ensure that fair and open competitive bidding practices are utilized and that taxpayersget the best value for their tax dollars. This is important because the policies underlying our State's competitive bidding laws not only foster fairness among bidders, but also protect public trust.
Fair competitive bidding acts as a “guard against favoritism, improvidence, extravagance, fraud, and corruption; to prevent the waste of public funds; and to obtain the best result for the public.” 1 Competitive bidding laws are passedfor the benefit and protection of the taxpaying public, not for the benefit and enrichment of bidders." 2 Proper enforcement of these laws results in more responsible contractors bidding and performing public works jobs, reducesinstancesof health and safety problems, promotes the timely completion of the contracted work, and helps to ensure the final product is of the highest quality and value for the taxpayer dollar.
The City of Pleasanton (" City") opened bids for the Lions Wayside and Delucchi Park Renovations Project, Project No. 06716 ("Project") on June21st, 2024. Integra Construction 1 M & B Const. v. Yuba County Water Agency (1999) 68 Cal.App.4th 1353, 1360; seealso Domar Electric, Inc. v. City of Los Angeles ( 1994) 9 Cal. 4th 161, 170- 171. 2 Id.

2 Services, Inc. is the apparent lowest bidder on the Project. NCIC has a concern about the bid submitted by Integra Construction Services, Inc., which are set forth in detail below.
In consideration, NCIC urges the City to conduct a factual inquiry to determine whether Integra Construction Services, Inc. qualifies as a "responsive" and "responsible" bidder asrequired by law. As explained below, Integra Construction Services, Inc’s bid is not responsive because it listed a subcontractor in its bid with an expired Public Works Contractor Registration (PWCR) number.
DISCUSSION
The City must award public works contracts in excess of two hundred thousand dollars 200,000.00) to the lowest responsible bidder after competitive bidding. 3 For the reasonsthat follow, the City should conduct a further inquiry into whether Integra Construction Services, Inc. constitutes a responsiblecontractor whose bid is responsiveto the City’s solicitation.
Integra Construction Services, Inc.' s Bid is Non- Responsive Because the Bid Proposal Lists a Subcontractor with an Expired PWCR
A basic rule of competitive bidding is that bids must conform to specifications and that if a bid doesnot so conform, it may not be accepted."4 Failure to satisfy all bid specifications rendersa bid non- responsive as a matter of law. Such a non- responsive bid must be rejected.
Integra Construction Services, Inc. listed a subcontractor without an active PWCR at the time of bid submission and bid opening. The Subletting and Subcontracting Fair Practices Act (“ the Act”), requires contractors to list the registration number of eachsubcontractor listed in their bids. 5 Public Contract Code § 4104 further provides that failing to correct an error in listing a subcontractor’s registration number shall be consideredground for considering a bid non- responsive if the error is not corrected within 24 hours after the bid opening date. Additionally, Labor Code § 1725.5 requires that a contractor be registeredwith the Department of Industrial Relations (“ DIR”) “ to be qualified to bid on [ or] be listed in a bid proposal…” 6 Furthermore, the City’ s Notice, Proposal, Special Provisions, and Contract Documents for the Project provide that, “Pursuantto Labor Code Section 1771.1 and subject to exceptions set forth by that section, no contractor or subcontractor may be listed on a bid proposal unless registered with the Department of Industrial Relations pursuant to Labor Code Section 1725, and no bid shall be accepted nor contract or subcontract be entered into without proof of the contractor’ s or subcontractor’s current registration to perform public work pursuant to Labor Code Section 1725. 5.”
3 Cal. Pub. Cont. Code § 22032, subd. ( c).
4 Konica Bus. Machines U. S.A. Inc. v. Regents of Univ. of California ( 1988) 206 Cal. App. 3d 449, 454
5 Cal. Pub. Cont. Code § 4104.
6 Lab. Code § 1725.5 (emphasisadded).
3 Integra Construction Services, Inc. listed “ Altamont Electric and Lighting, LLC.” as a subcontractor to perform electrical work. According to the DIR PWCR Database, Altamont Electric and Lighting, LLC’ s PWCR ( 1001184725) expired on June 30, 2024, and has not yet beenrenewed.
The City is legally obligated to award construction contracts to the “lowest responsive and responsible bidder,” with only a few specific exceptions. The City hasthe authority to decide whether a low bidder is “responsive.” According to § 1103, a responsive bidder is defined as one whose bid adheresto the essentialterms and conditions outlined in the invitation for bids, including the specifications and requirements stated in the solicitation documents.
Integra Construction Services, Inc. is an experiencedcontractor and should be aware that, under the Public Contract Code, is required to include only registered subcontractors in its bid for a public works project. By listing a subcontractorwithout valid/ active DIR public works registrations ( PWCR) in its bid, Integra Construction Services, Inc. has failed to comply with the requirements, providing ample grounds to deem them a non-responsivebidder.
CONCLUSION
Thoroughly investigating issuesof responsivenessand responsibility is central to the City' s fiduciary duty to its taxpayers. Given the issue described above, NCIC respectfully requests that the City fulfill this responsibility by rejecting Integra Construction Services, Inc.'s bid for non- compliance with Public Contract Code section 1103.
Should the City determine that Integra Construction Services, Inc.'s bid is non-responsiveor that the company is not a responsible bidder, the City must either award the Project to the next responsiveand responsiblebidder, Guerra Construction Group, or reject all bids and initiate a new bidding process. Please respond to this bid advisory by August 20th, 2024, indicating the stepsthe City will take to meet its fiduciary obligations and ensurecompliance with state competitive bidding laws.
Thank you for your time and consideration of this critical matter.
Sincerely,
Matt Hilliard
