1. H
ow much was budgeted for this item and did it come back in line with our expectation on costs? Is this funded from enterprise or CIP funds?
A. The City’s Stormwater Program is currently funded through the General Fund and is not an enterprise-funded program. A key objective of the Storm Water Management Plan is to evaluate and recommend sustainable funding strategies to support the City’s stormwater infrastructure repair, replacement, and capital improvement needs.

The Storm Water Management Plan initiative is funded under CIP 25659, with a total budget of $2,200,000 — consisting of a $500,000 carryover from FY 2024/25 and an additional $1,700,000 approved in FY 2025/26. The proposed contract is fully funded and within the approved CIP 25659 budget.

ow do Pleasanton’s new water connection fees compare to Dublin’s? A. At the June 3, 2025 Council Meeting, the City’s water rate consultant discussed and shared a comparison of Pleasanton’s proposed and current water connection fees compared to Livermore and Dublin, based on an equivalent water meter (5/8” meter size). Pleasanton’s proposed water connection fee is $5,269 per equivalent meter while Dublin’s water connection fee is $15,670 per equivalent meter.

2 3. In the last connection fee study, what was the maximum amount Pleasanton can charge?

A. Attachment 4 to the Agenda Report includes the City’s proposed fees for a new water connection, which is based on the size of the meter. Customers will also continue to pay a separate, additional Zone 7 water connection fee based on the fees adopted by the Zone 7 Water Agency. Zone 7’s fees are based on meter size and type, with the City typically using Diehl meters up to 1-1/2” and OMNI 2” and greater. Customers should refer to the size and type of water meters on Zone 7’s water meter connection fee table to determine the Zone 7 fee. As an example, a customer requiring a new 3/4” domestic service water meter would be paying the following water connection fees starting on 1/1/2026:

Customers requesting new water meter connections may contact the City of Pleasanton’s planning and permitting office to receive actual cost estimates based on their specific water meter sizes.

4. If Pleasanton increased the connection fee, would that impact the rates?

A. Water connection fees are one-time capital charges assessed for new developments to connect to the City’s water system. These fees are used to recover the development’s proportional share of expanding the existing water system to serve the new customers or recoup costs for previously constructed investments to accommodate the new growth and its water needs.

Increasing connection fees does not typically impact water rates for existing users; instead, it affects the total cost for new customers requesting new water services and meters. While the proposed increase in connection fees during this study period will not change existing customer rates, it may influence future water rates by incorporating a “buy-in” component. The buy-in component reimburses existing customers for their prior investment in the water system related to unused capacity that can be used for future growth. This buy-in component thus provides additional revenue to help offset future rate increases as new growth occurs.

5. Why not use the State’s revolving loan fund, rather than market lending?

A. State Revolving Fund (SRF) loans are an excellent tool for large, long-term, or compliance-driven projects, but they are often too slow or restrictive for routine

3 capital improvement programs or projects that must move forward on a specific schedule.

Pleasanton and similar agencies often evaluate both options and may pursue the public financing option as necessary to ensure project delivery certainty, timing, and flexibility to meet the City’s water system needs.

6. How much was Pleasanton’s water revenue bond issuance?

A. The Pleasanton 2024 water revenue bond issuance was for $19M.

7. Are we still paying for the 2015 recycled water project loan, or did that get paid off before the issuance of the new debt? (P31 of the water rate study)?

A. There are two loans associated with the Recycled Water Fund. The City is still paying the loan with the State Water Resources Control Board. The City paid off the 2017 Recycled Water Bonds in April 2024.

8. How much new bond money are we planning to issue in the work plan?

A. Based on the water rate study, the City plans to issue new debt totaling approximately $35.7 million over the four-year study period, which will be used to fund $35.0 million in capital projects. The difference between the issuance ($35.7 million) and proceeds ($35.0 million) is due to the cost of issuing bonds.

9. How much do we expect the total cost of the bond issuance(s) to cost rate payers?

A. The total cost of bond issuance to ratepayers depends on three primary factors: total principal borrowed, interest rate and term of repayment, and issuance and administrative costs. The estimated debt terms used in the water rate study are as follows: $35.7 million borrowed, 6% interest rate, 30 year term, and 2% issuance costs (which are capitalized and included in the amount borrowed). Actual costs to the water enterprise can be calculated when the City issues bonds in each year and will depend on the debt terms specific to each issuance.

4 10. Why isn’t the meter size shown on the utility bill? A.

This is a good suggestion that supports the City’s goals for customer transparency and education. Staff will include this item for consideration in the next utility bill format update.

11. W
hat happens if we don’t get the assumptions right? (page 28 of the rate study, Table 212)
A. A
ssumptions are used throughout the study as a means to reasonably project future expenses using the best available data at the time the study was completed.

However, projected costs of future expenses may be different from the actual costs of those expenses.

I
f projections are higher than actual expenses (with all else equal), the City has the ability to implement lower rates than what was presented in the Proposition 218 notice and adopted at the Public Hearing, which represent the maximum water rates that the City can implement.

I
f the projections are lower than the actual expenses, the City can use its reserves to offset the increase in costs. The City’s reserve policy includes a target for an operating reserve, which allows the City to pay for unexpected increases to operating expenses and reduce the financial risk associated with those fluctuations.

5 If actual expenses greatly exceed the projections, then the City may have to revisit its financial plan and adjust accordingly (for example, beginning a new Proposition 218 rate adoption process).

12. Are we within a reasonable amount of water loss, relative to the state average or comparable agencies? (Water loss on Table 213)

A. The amount of water loss varies significantly between agencies, due to age of infrastructure, issues with billing and/or metering systems, etc. Water loss includes both real losses (such as from leaks) and apparent losses (such as from accounting/billing errors or theft). Most agencies assume a water loss percentage of approximately 5% to 10% for rate study projections; the average is approximately 7% based on data from the SWRCB. The City is currently in the process of procuring a consultant to evaluate the City’s water loss values versus recent performance standards set by the State Water Resources Control Board (SWRCB) and develop a plan for compliance.

13. How many water rate increases has the City implemented in the last 10 to 15 years?

A. For Pleasanton’s water rates, there were Consumer Price Index (CPI) increases from 2011 until 2016, then no CPI or water rate increase for 2017, then CPI increases for 2018, 2019 and 2020. Then there were no water rate increases for Pleasanton’s water rates for 2021 and 2022 and 2023. Then there was a Council approved rate increase of 30% for 2024 and 12% for 2025 for Pleasanton water rates. The City of Pleasanton also collects fees for services provided by outside agencies, including Zone 7 Water Agency for wholesale treated drinking water.

These fees are pass-through.

Subject: October 7, 2025 City Council Meeting, Agenda Item 4 - P25-0026, Accessory Dwelling Unit Amendments
This memorandum provides additional detail on the comments and issues raised by the California Housing Defense Fund (Cal HDF) in its communication to the City on the ADU Ordinance Amendments, and how the Ordinance has been subsequently amended to address them.

Cal HDF has sent two letters regarding the proposed amendments to Pleasanton Municipal Code (PMC) Chapter 18.106 – Accessory Dwelling Units (ADUs), on March 18 and August 26, 2025.

The March 18, 2025, letter detailed concerns with standards applied to “Statewide exemption accessory dwelling units,” or units that comply with Government Code Section 66323, defined in PMC 18.106.020 (E). There are several regulations that statewide exemption ADUs are exempt from, including parking standards, design standards, underlying zoning standards, and front setback standards. Following receipt of this letter, staff revised the ordinance to explicitly exempt “statewide exemption ADUs” from such provisions of the Draft Ordinance (contained in Sections 18.106.030 (E), 18.106.045 (A), (B), (C) and (D), 18.106.060, and 18.106.070).

Staff circulated this revised version to the California Housing and Community Development Department (HCD) for a courtesy review. HCD had minor comments, primarily focused on the number of ADUs permitted per lot under Government Code sections 66314 and 66323 (section 66314 is the broad Government Code section allowing ADUs and section 66323 defines statewide exempt units) and the combinations thereof (e.g. attached, detached, ADUs and Junior ADUs). HCD staff also provided minor comments about potentially subjective standards in the Ordinance, including visibility of address signs, appliance requirements for Junior ADUs and setbacks corner lot standards. Staff made additional revisions to reflect these comments.

Staff agendized the Draft Ordinance for the Planning Commission’s review, including HCD’s suggested amendments, on August 27, 2025. Following the publication of the Planning Commission agenda report, Cal HDF sent a letter on August 26, 2025, highlighting the requirement to allow for the separate sale of ADUs for qualified non-profit organizations, as defined by Government Code 66341, and the allowable size of detached ADUs on multi- family sites. Staff addressed this input in relevant Ordinance Sections 18.106.050 (C) and

18.106.070(A). Staff again circulated the revised ordinance to HCD prior to the publication of the current City Council agenda report and received additional comments clarifying the distinction between 66314 and 66323 units. These minor amendments are reflected in the Draft Ordinance before City Council for adoption.

Following adoption of the ADU Ordinance, the City will submit it to HCD for their formal review.

Dear Pleasanton Planning Commission,
The California Housing Defense Fund (“CalHDF”) submits this letter as a public comment concerning item 4 on the agenda for the Planning Commission meeting scheduled for August 27, 2025, an amendment to the City’s regulations for ADUs and JADUs. CalHDF would like to thank the City for amending the proposed ordinance in response to our previous letter.

However, there are still two legal issues with the proposed ordinance, and the City should address these problems before approving the ordinance.

Background
The law gives local governments authority to enact zoning ordinances that implement a variety of development standards on ADUs. (Gov. Code, § 66314.) The standards in these local ordinances are limited by state law so as not to overly restrict ADU development. (See id.) Separately from local ADU ordinances, Government Code section 66323 establishes a narrower set of ADU types that local governments have a ministerial duty to approve. “Notwithstanding Sections 66314 to 66322 ... a local agency shall ministerially approve” these types of ADUs. (Id. at subd. (a).) This means that ADUs that satisfy the minimal requirements of section 66323 must be approved regardless of any contrary provisions of the local ADU ordinance. (Ibid.) Local governments may not impose their own standards on such ADUs. (Gov. Code, § 66323, subd. (b) [“A local agency shall not impose any objective development or design standard that is not authorized by this section upon any accessory dwelling unit that meets the requirements of any of paragraphs (1) to (4), inclusive, of subdivision (a).”].) 2201 Broadway, PH1, Oakland, CA 94612

In addition, ADUs that qualify for the protections of Government Code section 66323, like other ADUs, must be processed by local governments within 60 days of a complete permit application submittal. (Gov. Code, § 66317, subd. (a).) State law also prohibits creating regulations on ADU development not explicitly allowed by state law. Government Code Section 66315 states, “No additional standards, other than those provided in Section 66314, shall be used or imposed, including an owner-occupant requirement, except that a local agency may require that the property may be used for rentals of terms 30 days or longer.”
Impermissible Size Limits on Detached ADUs on Multifamily Parcels Code section 18.106.050(C) limits detached ADUs to 850 or 1000 square feet, depending on the number of bedrooms. [Code section 18.106.045(B) allows attached ADUs created from existing space to exceed these size limits.]
However, the City should be aware that size restrictions are not permitted for new construction, detached ADUs on multifamily parcels. Government Code section 66323 subdivision (a)(4) allows up to eight detached ADUs on multifamily parcels without size restrictions.

Additionally, such size restrictions are not permitted for conversions of detached accessory buildings into ADUs pursuant to Government Code section 66323, subdivision (a)(1).

Size restrictions are plainly forbidden by Government Code, section 66323, subdivision (b), which explicitly exempts statewide exemption ADUs from all local standards: “(b) A local agency shall not impose any objective development or design standard that is not authorized by this section upon any accessory dwelling unit that meets the requirements of any of paragraphs (1) to (4), inclusive, of subdivision (a).” Government Code section 66323 subdivision (a) does not contain size limits for new construction, detached ADUs on multifamily parcels, nor does it contain size restrictions for conversions of accessory buildings into ADUs on single family parcels. Because this section of law does not contain such size limits, the City may not impose such size limits.

HCD reafǱirms this requirement of state law on page 20 of the January 2025 HCD ADU Handbook (emphasis added):

A local agency may not impose development or design standards, including both local standards and standards found in State ADU Law, on 66323 Units that are not speciǱically listed in Government Code section 66323. (Gov. Code, § 66323, subds. (a), 2 of 3
(b).) This includes, but is not limited to, parking, height, setbacks, or other zoning provisions (e.g., lot size, open space, ﬂoor area ratio, etc.).

The City must exempt ADUs developed pursuant to Government Code section 66323, subdivisions (a) from all size restrictions [other than the 800 square foot size restriction contained in section 66323, subdivision (a)(2) for new construction, detached ADUs on single family parcels].

Duty to Allow Separate Sales of ADUs
Code section 18.106.060(A) forbids the separate sales of ADUs. However, Government Code section 66341 mandates that the City must allow separate sales of ADUs under certain conditions (i.e. a nonproǱit developer and a qualiǱied buyer, etc.). The City must allow such sales pursuant to this section of state law.

of the responsibility shifts toward higher-use
customers. Because Zone 7’s ﬁxed costs are now
recovered through ﬁxed charges, less variable
revenue is at risk. As a result, the proposed drought
surcharge rates are lower overall than the current
drought rates, even with the reduced 8 CCF
allotment.

Regarding transparency, all revenues collected
through water rates can only be used for water
services and cannot exceed the cost of providing
those services. This includes daily operations,
system maintenance, and infrastructure
improvements. The City’s Water System

The Zone 7 Water Agency sets the wholesale water
rates and ﬁxed charges for Pleasanton, and the City
is required to pass these charges directly to its
customers. In past years, Pleasanton only collected
about 32% of Zone 7’s ﬁxed costs through ﬁxed
charges, with the remainder recovered through
variable charges. Under the proposed structure,
customers will now cover 100% of Zone 7’s ﬁxed
charges as a direct pass-through, rather than
subsidizing them through consumption-based
charges.

This change makes the Year 1 ﬁxed charge appear
higher because the full cost recovery is being shifted
into the ﬁxed portion all at once. However, beginning
in Year 2, the Zone 7 ﬁxed charges shown in the City’s
rate tables increase by no more than 5% per ye ar,
consistent with the assumptions in the Water Rate
Study and Proposition 218 notice.

It is also important to note that these Zone 7 ﬁxed
charges cover only Zone 7’s wholesale costs to
supply Pleasanton with treated water. They do not
fund Pleasanton’s capital improvements or
operations, which are recovered separately through
the City’s rates. Moving to full recovery of Zone 7’s
ﬁxed costs improves the City’s ﬁnancial stability and
reduces risk during periods of low water use.

Regarding the rate structure, AB 1827, which took
effect on January 1, 2025, clariﬁed that water
agencies may include incrementally higher costs in
rates when those costs can be demonstrated — for
example, when high-volume or peak usage creates
identiﬁable additional expenses for the system.

However, AB 1827 did not change the fundamental
requirements of Proposition 218: rates must still be
proportional to the actual cost of providing service
and supported by a cost-of-service analysis. In
Pleasanton’s case, the City decommissioned its
groundwater wells in 2022 and now purchases 100%
of its potable water from Zone 7 Water Agency at the
same unit cost. Because all water is purchased from
the same source at the same cost, the City cannot
legally demonstrate a cost difference for higher-
volume users. Therefore, a tiered rate structure
cannot be justiﬁed under Prop 218, even with AB
1827.

As a chiropractor with a practice on First Street for nearly 20 years and a longtime Pleasanton resident, I am writing to express my strong support for Natascha Thomson’s guest opinion in the Pleasanton Weekly opposing the proposed PDA fee increase. It is fundamentally unjust to mandate that service businesses like mine, located off Main Street, fund an organization that provides no tangible benefits to us. The Pleasanton Downtown Association (PDA) focuses almost exclusively on promoting Main Street restaurants and retail, ignoring the diverse needs of the majority of its 500+ members, who are not in these categories. My practice relies on referrals and targeted marketing, not PDA events, yet we are forced to pay fees based solely on our downtown address. I am genuinely curious what percentage of PDA members would choose to remain so if given the choice.

Requiring membership in an unaccountable organization that does not serve our interests violates the principles of fair representation. The PDA provides no transparency or data demonstrating value for service businesses like mine, yet demands our financial support. As a resident deeply invested in Pleasanton’s fiscal health, I also question whether city funds should be used to subsidize an organization that primarily benefits a small subset of businesses. Allocating taxpayer money to the PDA, raises concerns about responsible stewardship of public resources at a time when critical city services are vulnerable.

I urge the City Council to reject the proposed PDA fee increase, make membership voluntary, and reevaluate the use of city funds to support this organization. Downtown vitality relies on innovative businesses that create value for the public and profit for owners, not just a few annual events.

It is time for the PDA to stand on its own two feet. If it can not, that should be a sure sign that the time for change has come.

Comments 1. It’s unclear why the city water portal and calculator displays only a 1 year increase and claims a minimal $20 increase / bill in their “marketing” materials and public presentation.

2. The city council is voting for a 4-year increase and the full impact of that should be disclosed to residents as opposed to not showing the facts front and center

3. When one looks at the actual increases (in the small print tables for 5 years) one sees a very different case.
a. I see a 400% increase in Pleasanton fixed rate from $9.25 to $47.27 b. I see 170% increase in Zone 7 fixed rate from $50.81 to $134.36 This equates to a 200% increase in Fixed charges from $60.06 to $181.93.

Where is the “only” $20/bill increase? The total extent of the increase is hidden and not explained nor shared clearly.

3. I see a 50% increase in my Pleasanton variable charges from $2.47 to $4.5, a 80% increase.

This is ALL city-imposed increases shown by percentage impact. Zone 7 will add on and want their share which the city will “pass on”.

ASK:

Why should the full burden be thrust on current residents over a short period as opposed to being defrayed over the life of the projects (pay as you go).

Please consider the extent of increases being imposed unilaterally by the city and limit the same to 2 years and reassess the city funds and rate increases.

Be transparent in your increases as opposed to showing only Year 1.

Total Bill

1. For a median user (of 30ccf), we already had suffered a steep 50% increase in Total water bill in 2 years (2023-2025) due to the city’s increases.

2. This will add another 60% increase to the Total Water bill as proposed (2025-2029).

This is a whopping 140% increase in Total water rates per month as enacted by the city.

Comments Dear Mayor Balch and Members of the Pleasanton City Council, I am a Pleasanton resident writing to express my concern about the steep water rate increases over the past two years and the proposed future adjustments. While I understand the City’s need to maintain water security, the pace and scale of these increases are becoming difficult for many residents to afford.

According to the City’s plan, Pleasanton’s water rates increased by 30% in 2024 and are scheduled to rise another 12%. These compounded increases create a significant burden for households across our community.

I appreciate that Pleasanton already provides discounts for seniors. However, even with these discounts, many residents on fixed/low incomes are still struggling to keep up with rising utility costs, especially when combined with inflation in food and healthcare.

Water is a basic necessity, and affordability must remain central to all rate- setting decisions. I respectfully urge the Council to phase in future increases more gradually, expand outreach and accessibility to existing discount programs so eligible residents can benefit, and ensure transparency about how rate revenues are used to improve reliability and efficiency.

In addition, I would like to propose a feasibility study into connecting Pleasanton to the San Francisco Public Utilities Commission (SFPUC) water system. In 2016, the City purchased 3.18 acres of land from SFPUC for $4.2 million to build a park across the Alameda County Fairgrounds, yet the opportunity was never pursued. The SFPUC system provides some of the highest quality water in the nation, sourced from the Hetch Hetchy Reservoir, which is naturally drinkable at the source. It also benefits from large, resilient reserves that offer greater protection from drought-related price spikes which have been a problem in the past. Many Bay Area cities already receive SFPUC water through the Bay Area Water Supply and Conservation Agency (BAWSCA), gaining stable supply and predictable rates. Many Bay Area cities benefit from SF water. Exploring this option could provide long-term cost savings and improved water quality for Pleasanton residents.

I urge the Council to fully evaluate this potential alternative. Our community deserves a comprehensive look at all options to ensure a sustainable, fair, and affordable water future.
