RESOLUTION NO. 2022-16
SUSENDING SECTION 9.05.010 OF THE POINT ARENA MUNICIPAL CODE DURING THE INDEPENDENCE WEEKEND CELEBRATION ON JULY 2 & 3, 2022
WHEREAS, the City of Point Arena’s Street Fair and Fireworks Extravaganza is an annual event that draws thousands of people; and
WHEREAS, City of Point Arena Municipal Code Section 9.05.010 prohibits the drinking of intoxicating beverages and the possession of any open alcoholic beverage “on any street, sidewalk, alley, highway, green belt, public park or playground, or parking lot or in any public place;” and
WHEREAS, several local food service establishments serve beer & wine and plan to do so for this event; and
WHEREAS, Section 9.05.022 of the Point Arena Municipal Code grants the authority to issue a limited-term permit allowing consumption of alcoholic beverages in public spaces for special events; and
WHEREAS, the Mendocino County Sheriff’s Department requests such limited-term permit be issued to effectively outline their responsibilities during the Independence Weekend Celebration.
NOW, THEREFORE, BE IT RESOLVED AND PROCLAIMED that the City Council of the City of Point Arena does hereby suspend Section 9.05.010 of the Point Arena Municipal Code at Arena Cove between the hours of 4:00 p.m. and 11:00 p.m. on July 2, 2021 for the Street Fair & Fireworks Extravaganza, and between the hours of 11:00 a.m. and 2:00 p.m. on July 3. 2022 for the Independence Weekend Parade route.
