POINT ARENA CITY COUNCIL
AGENDA ITEM SUMMARY
AGENDA ITEM: IX A
MEETING DATE: 8/22/2023
TITLE
2023-2024 City of Point Arena Master Fee Schedule
RECOMMENDED ACTION
Review Proposed Fees and Approve Resolution 2023-14
ANALYSIS
At the July 25 City Council meeting staff presented an updated schedule of fees for City services. After discussion, the council directed staff to revise some of the fees and bring the item back for consideration as this meeting.
The City of Point Arena uses a Master Fee Schedule to establish fees to offset the cost of providing certain services. The current Master Fee Schedule was last updated in 2021 and an update is needed to ensure all fees are accurately capturing the cost to provide any specific service provided.
Fees are set in accordance with parameters set by Article 13C of the State Constitution and by Section 66014 of the California Government Code. Costs allocated to the payer should bear a fair and reasonable relationship to the payer’s burdens on or benefits received from the governmental activity. Fees should not exceed the reasonable cost of providing the services for which the fee is charged.
The City of Point Arena Master Fee Schedule includes Exhibit A (Business License Fees), Exhibit B (City Sewer Fees), Exhibit C (Pier Fees) and Exhibit X (Planning Fees).
Administrative Fees
Administrative fees include facility rentals, administrative services and local taxes such as the Transit Occupancy Tax. Staff recommends increasing the charge for electric vehicle charging from $1.50 per hour to $2.00 per hour and increasing the xx charge from $4.50 to $5.00. Electricity costs have increased over the past four years since the rate was established.
Business License Fees (Exhibit A)
The authority to charge business license fees is outlined in Section 3.10.020 (4) of the Municipal Code:
There is hereby imposed upon each of the businesses, shows, exhibitions, and games in this chapter mentioned, for the purpose of revenue, a license fee at the respective rates hereinafter set forth, and every person who transacts or carries on any of the businesses, shows, exhibitions, or games in this chapter mentioned shall pay a license fee so to do at the said rate. [Ord. 119 § 15, 1986.] Business license fees range from $30 for a home occupation to $1500 for a cannabis business. The majority of business licenses issued are $50 or below.
Staff have scrutinized the current license types and fees. There was good deal of discussion regarding some of the charges and staff was asked to revise the schedule based on those comments. The following updates to the Business License fee are:
• Consolidated “hotel/motel,” “bed & breakfast inn,” “vacation home rental” and “vacation home share” into a new category of “Lodging” with a license fee of $120.00.
• Created a “Contractor” category to cover electrical, plumbing, landscaping and general contracting with a license fee of $100.00. All building permits will require a valid business license from contractors.
• Created a “Utilities” category to cover electricity; water; propane; telephone; and satellite and internet providers with a license fee of $250.00. • Increased the fee for “Distributors” to $150.00.
• Added a “street vendor” category with a license fee of $30.00. • Consolidated “men’s wear” and “ladies/children’s wear” into a new category of “clothing store”
• Removed the outdated categories of coin/video business, frozen food locker, stenographer, box factory & cooperative, and video rental.
Wastewater Fees (Exhibit B)
The authority to charge wastewater fees is outlined in Section 3.10.020 (4) of the Municipal Code:
(4) Increases in Basic Sewer Service Rates. By September 1st of every year the city council shall make a determination as to whether there has been an increase
in the cost of operating, maintaining, replacing and improving the wastewater system facilities during the preceding fiscal year. If the city council determines that such increases have occurred and that expenses exceed revenues, the council shall set new rates accordingly. [Ord. 211 § 1, 2010; Ord. 207 § 1, 2008; Ord. 204 § 1, 2007; Ord. 195 § 1, 2006; Ord. 191, 2004; Ord. 185 § 2.01, 2004.] Updating wastewater rates requires a rate study to justify increases fees. The last Wastewater rate study was conducted in 2016 and is out of date. Wastewater fees have not risen in the past two years. A new rate study needs to be conducted this year.
Pier Fees (Exhibit C)
The authority to charge pier fees is outlined in Section 12.25.130 of the Municipal Code:
The city council shall establish, by resolution, rates for services, rents, fees and such other charges as may be necessary for the orderly operation of the pier facility. [Ord. 125 § 1.13, 1987.]
Pier fees were last adjusted in 2021. Pier expenditures generally outpace revenues twoto-one. Pier fees are part of larger discussion about its overall operation. Discussions with Pier staff and input from the Arena Cove Advisory Committee and commercial fishermen have resulted in the following modifications to the Pier Fees:
Increasing boat storage from $50 to $75. The annual pass would increase to $750 which includes two free months. Since the last increase in 2018, the Consumer Price Index has uncreased 20%. This is reflected in higher utility and staffing costs. Some in the fishing community suggested a higher-resolution camera system and an additional camera are needed to make the facility more secure.
Increasing landing fees for urchin from $.10 to $.15 per pound. During the last round of rate adjustments, which saw other fish increase to $.15, it was decided to leave urchin at $.10 to encourage fishing urchin out of Point Arena. Urchin is experiencing a revival of urchin, with large quantities being caught. Currently, 1000 lbs. of urchin would provide $100 in revenue. With the increase, that 1000 lbs. would bring $150 in revenue.
So far this season, approximately With the closure of salmon season, the City has an opportunity to recoup some revenue with urchin. Some in the fishing community questioned why there was a disparity in fees.
Instituting an After Hours Fee of $50 per hour. Staff is at the Pier from 7am to 4pm daily.
With some frequency, pier staff stay later than 4pm to complete operations such as
retrieving vessels or assisting the fish buyer operation. These additional staff hours do not capture any additional revenue in support of these operations. This would apply to any operations occurring after 4pm; however, discretion and judgment will be used by Pier staff in applying the fee.
Instituting a Buyer Deck Access Fee The purpose of this fee is to recoup funding for staff time and wear-and-tear to the pier surface. The buyer is allowed to park on the pier deck near the hoist to perform its operations; the only other vehicles permitted on the Pier are commercial vehicles for a limited time. In the past, the Pier offered exclusive access to Ocean Fresh for the use of the yellow hoist, so there is some precedent for such a fee.
Forklift and Hoist Use Fees A fee of $50 per hour would be charged for any use of the yellow hoist that does not involve launch operations. This could include strap adjustments or mechanical work such as engine removal. $50 per hour would also be charged for use of the forklift that supplements commercial operations, mostly during crab season Staff spend a large amount of time loading and unloading pallets of crab pots, which is an intensive operation. The fee would cover full staff cost, fuel and wearand-tear of the forklift.
Cost Recovery
Planning Fees (Exhibit X)
The authority to charge planning fees is outlined in Section 18.30.210 of the Municipal Code:
The city council shall by resolution establish a schedule of fees, charges and expenses for variances, conditional use permits, planned residential development permits, coastal development permits or design review, coastal development permits for signs which may be found categorically exempt under CEQA, and amendments to the text of this title and the zoning map and other matters pertaining to this title. The schedule of fees may be changed or modified only by resolution of the city council. [Ord. 179 § 6.18, 2001.] The City has adopted a “cost recovery” mechanism used for planning and code enforcement fees. The applicant is responsible for paying for staff time and materials associated with processing a planning application or for a code enforcement action.
Planning projects require a deposit based on current planning estimates.
Costs for staff time are based on fully-loaded hourly rates (total compensation plus overhead); this includes the City Planner and administrative staff. Costs for consultants are based on the City’s actual cost incurred in accordance with the professional service agreement rates. This includes the City Attorney and Engineer.
The applicant provides a deposit based on the fee schedule. Staff and consultant time are charged against the deposit. When 75% of the deposit has been used, staff requests an additional deposit based on an estimated cost of the time needed to complete the processing of the application. In the event of a balance remainder, the remaining funds are refunded once the project has been completed.
The City originally adopted the County’s planning fees in 2016, utilizing the amounts for deposits. In 2021, the County increased their fees substantially and the Council decided not to adopt the revised fee structure.
The majority of planning applications are for Coastal Development Permits and Use Permits. Deposit amounts have been adjusted based on actual costs for prior permits.
The most common planning application the City receives is for a CDP, which now requires a $2,600 deposit. Each application provides a $200 administrative fee separate from cost recovery.
Staff recommends increasing the fee for an encroachment permit to $150, increasing the fee for sign permits to $100, increasing the administrative fee that applies to all projects to $200, and instituting a $100 building permit review fee.
FISCAL IMPACT
Increased revenues to the General Fund and Pier Fund.
