RECOMMENDED ACTION
Review Proposed Fees and Approve Resolution 2023-14
ANALYSIS
The update to the Point Arena Master Fee Schedule was discussed at the July 25 and August 22 City Council meetings. The attached schedule reflects changes made at both meetings. Adjustments made since the August 22 meeting:
• EV Charging rates increases $.50 from $1.50 to $2.00 per hour • Fee for parking more than four hours increases from $4.50 to $5.00 • City event food vendor fee Increases from $100 to $150 • Added a $150 Kitchen Use Fee (subject to approval & for events only) • Distributors and delivery services business license set at $300 for a two-axle truck, $100 each additional axle.
• Equestrian show with up to 50 entrants business license fee set at $150. • Boat storage increases to $75 per month or an annual pass for $750. • Urchin landing fee increases to $.15 per pound.
FISCAL IMPACT
Modest increases in business license and planning fees.

RESOLUTION NO. 2023-14
RESOLUTION OF THE POINT ARENA CITY COUNCIL
UPDATING THE “CITY OF POINT ARENA MASTER FEE SCHEDULE”
WHEREAS, the City Council has determined that all fees, established in the Point Arena Municipal Code and adopted by Resolution, should be centralized and incorporated into a single resolution to be updated each April, and shall serve as due process for the budget preparation for the next coming fiscal year; and
WHEREAS, the City Council hereby adopts the schedule of fees for the various actions, permits, applications, and appeals which are described in the “CITY OF POINT ARENA MASTER FEE SCHEDULE” which includes Exhibits A, B, C and X, which are incorporated herein by this reference as if set forth in full; and
WHEREAS, relative to costs and expenses, it is noticed that in addition to the fees set forth in this Resolution, the City shall be entitled to recover from planning and building applicants any and all costs and expenses incurred by the City related to the application, including, but not limited to, outside consultants and attorneys’ fees; and WHEREAS, relative to costs and expenses for municipal code enforcement activities and nuisance abatement, it is noticed that in addition to the fees set forth in this Resolution, the City shall be entitled to recover from the party or parties responsible for the code violation(s) any and all costs and expenses incurred by the City related to the violation, including, but not limited to, outside consultants and attorneys’ fees; and
WHEREAS, Resolution No. 2011-04 set forth the initial Master Fee Schedule for the City of Point Arena and now, each year Exhibit A will be reviewed by staff for revision and ratified by Resolution if revision is needed; and
WHEREAS, Resolution No. 2012-07 adopted the Master Fee Schedule of Mendocino County for fees applicable to Planning & Building which are described in Exhibit X and now, each year Exhibit X will be reviewed by staff for revisions by the County and ratified by Resolution if revision is needed; and
WHEREAS, this resolution incorporates Exhibit A (Business License Fees), Exhibit B (City of Point Arena Adopted Sewer Service Fee Schedule) and Exhibit C (Point Arena Pier Fees) to the Master Fee Schedule, each year these Exhibits will be reviewed by staff for any necessary revision and ratified by Resolution if revision is needed. - 2 -
NOW, THEREFORE, BE IT RESOLVED AND PROCLAIMED that the City Council of the City of Point Arena does hereby adopt the attached “POINT ARENA MASTER FEE SCHEULE” including Exhibits A, B, C and X and until amended or updated is effective immediately.

CODE ENFORCEMENT
Contract Consultants including the City Attorney, City Engineer, City Planner, City CPA, City Code Enforcement are billable at current contract rate plus a 10% billing and adminstrative fee.

ENFORCEMENT PROCEDURE FEES
Costs for City Staff are assessed at the actual hourly rate for the designated employee including the City's employment costs of the employee, plus the City's established overhead costs. All City contracted services are billable at current contract rate plus a 10% billing/adminstrative fee. These Fees are in addition to Citation Fees. Citation Fees are assessed daily while violation continues.

City of Point Arena Planning Fee Schedule (Exhibit X)
Point Arena Planning Fees are estimated costs for the process listed. Point Arena operates on a “cost recovery” model. All projects require the deposit amounts below upon submission of an application. Applicants will be charged associated costs against the deposits. Additional deposit funding may be requested for work beyond the deposit amount. There are also administrative charges for each project. Potential applicants receive one free hour of consultation with the City Planner regarding their project. Subsequent hours are charged at the rate of $150 per hour.
