POINT ARENA CITY COUNCIL

AGENDA ITEM SUMMARY
AGENDA ITEM: IX A
MEETING DATE: 03/26/2024
TITLE
City Attorney Contract

RECOMMENDED ACTION
Approve Contract for City Attorney Services with Jones-Mayer

ANALYSIS
Since August 2020, Attorney Ginevra Chandler had provided Point Arena City Attorney services. For a variety of reasons, the City terminated its agreement with Chandler in December. Interim City Manager Peggy Ducey recommends Jones-Mayer, a public agency law firm focused solely on representing public entities throughout California.

Mr. Bettenhausen is a Partner with Jones-Mayer and currently serves as City Attorney to the City of Fort Bragg and Assistant City Attorney for the City of Fullerton. He is experienced in managing the legal needs of California public agencies. His practice includes advising and training City Councils and Planning Commissions regarding legislative updates, the Brown Act, Conflict of Interest, land use, and environmental issues.

He has advised numerous city departments, commissions and staff on compliance with the ever-changing regulatory landscape public agencies face. He is well versed in CEQA, public works, real estate, and in researching and preparation of municipal code sections, drafting and reviewing agreements, handling Public Record Act requests, and preparing legal opinions and analysis on a variety of issues affecting public entities.

Interim City Manager Ducey worked with Mr. Bettenhausen while she was the Fort Bragg City Manager and found him to be approachable, responsive to City needs, and well informed about municipal issues.

Jones-Mayer has agreed to an hourly rate of $225/hour, which is $40, or 21.5% more than Attorney Chandler charged the City. However, other firms interviewed are charging up to $500/hour. Given the breadth and depth of Jones-Mayer professional staff, a rate of $225 is very reasonable.

FISCAL IMPACT
Increase of 21.5% over previous City Attorney rates.
