POINT ARENA CITY COUNCIL

AGENDA ITEM SUMMARY
AGENDA ITEM: VIII A
MEETING DATE: 4/22/2025
TITLE
Point Arena Jib Hoist and Trolly Direct Replacement Project

RECOMMENDED ACTION
Approve Resolution 2025-07 declaring an emergency and awarding a contract to Allied Crane for the repair of the Point Arena Pier Jib Hoist.

ANALYSIS
In December 2024, the City issued a Notice of Bid for the Point Arena Jib Crane Hoist and Trolley Replacement Project. HECO Pacific Manufacturing was the sole respondent, submitting a bid of $101,640—approximately $50,000 over the anticipated budget. City staff contacted HECO to explore the possibility of a cost reduction, but the company declined. As a result, on April 6, 2025, the City issued a Notice to Reject All Bids.

The very next day, on April 7, 2025, the Pier Jib Hoist failed due to an electrical malfunction that rendered the hoist cable inoperable. All boat launches were suspended pending further analysis. The Hoist was returned to service on April 9, 2025.

This incident is the latest in a series of malfunctions affecting the Hoist, which has significantly exceeded its expected service life. Since September 2024, these recurring issues have increasingly disrupted pier operations. In response, the Interim City Manager and City Attorney reviewed available options and concluded that replacing the Hoist qualifies as an emergency under California Public Contract Code Section 20168. This provision allows the City Council, by a four-fifths vote, to adopt a resolution authorizing immediate expenditure of public funds to protect life, health, or property—bypassing the standard bid process, which would delay replacement by an estimated 3–4 months.

Given the urgency, staff requested a bid from Allied Crane—the contractor who originally installed the Hoist and has performed most repairs and inspections since 2011.

Allied Crane submitted a bid of $64,844.46. The City currently has $60,000 in approved funding for this project through the Pier Resiliency Grant.

The attached Resolution includes the following findings:

1. The failure of the Jib Hoist constitutes an emergency, and any delay in its replacement would pose a threat to public health, safety, and welfare. Proceeding without a formal bid process is necessary under the circumstances.

2. The contract for the purchase and installation of a new Jib Hoist is hereby awarded to Allied Crane without further competitive bidding, pursuant to California Public Contract Code Sections 20168 and 22050.

Approval of this Resolution requires a four-fifths vote of the City Council.

RESOLUTION NO. 2025-07

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POINT ARENA

DECLARING AN EMERGENCY AND AWARD A CONTRACT FOR THE REPAIR

OF THE POINT ARENA PIER JIB HOIST
WHEREAS, California Public Contract Code 21068 provides that in case of an emergency, the City Council may by a four-fifths vote adopt a resolution declaring that the public interest and necessity demand the immediate expenditure of public money to safeguard life, health, or property; and
WHEREAS, Public Contract Code 1102 defines an emergency as "a sudden, unexpected occurrence that poses a clear and imminent danger, requiring immediate action to prevent or mitigate the loss or impairment of life, health, property or essential public services." WHEREAS, on April 7, 2025, the Point Arena Pier 6-ton Jib Hoist stopped working, and no longer permitted the hoist cable to move up or down with the result that commercial fishing boats could not be launched or removed from the water; and
WHEREAS, the inability to launch or remove commercial fishing boats poses a clear and imminent danger and requires immediate action to prevent the loss or impairment of life, health, property, and an essential public service and failure to address will result in a severe financial hardship to a significant number of members of the Point Arena community; and WHEREAS, the failure of the Jib Hoist was sudden and unexpected, and the lack of a functioning Jib Hoist poses a significant safety risk to City staff, boat operators and crew, and to the pier and an essential public service; and
WHEREAS, it is critical the Jib Hoist be replaced as soon as possible and a price quotation for a replacement system has been obtained as follows: Allied Crane quote $64,844.46.

NOW THEREFORE THE CITY COUNCIL OF THE CITY OF POINT ARENA FINDS, DETERMINES, AND RESOLVES AS FOLLOWS:

1. The Recitals set forth above are true and correct and incorporated herein as findings.

2. The failure of the Jib Hoist is an emergency and a delay in the purchase and installation of a new Jib Hoist is necessary to preserve health, safety, and welfare. The award of this contract without notice for bids is necessary.
