BACKGROUND
The property currently includes one 1,486 SF single family home and one 979 SF garage, for a total of 2,464 SF. The project proposes adding 4,086 SF of residential structures, so upon development the site would have 6,550 SF of residential development in 4 primary residences, 3 ADUs and four garages on four lots.

GENERAL PLAN CONSISTENCY
The table below analyzes the projects consistency with relevant policies of the City’s General Plan.

Policy Number Project Conformance to Policy
Goal #1: Preserve the Small-Town Rural
Character of Point Arena
Goal #5: Promote Affordable Housing.

The proposed project is consistent
with these goals. The creation of six
additional small residential units will
result in more “affordable” market
rate housing units in Point Arena and
they are in keeping with the small
town rural character of Point Arena
Land Use Policy 1. The City shall encourage
and allow new development in those areas of the
city where adequate water supply, sewage
disposal capacity, and traffic capacity exist to
The applicant’s proposed project is
located in an area with existing
services.

serve both the new development and future
priority uses planned throughout the City. .

LU 12. Individual mobile homes qualify as
permissible single-family dwellings, and are
permitted by right in all residential zones
except in the Multi-Family Residential (MR)
Zone. Mobile home parks or projects (two or
more mobile homes on one parcel of land)
may be permitted in the Highway Commercial
(HWC) zone only, and are subject to securing
a use permit and to the City's mobile home
regulations (Zoning Ordinance Section 5.30)
and to coastal development permit
requirements and all applicable policies of the
LCP, including, but not limited to visual
resource protection policies and water quality
policies.

The proposed project includes two
mobile homes on each of three
parcels, one for the primary
residential unit and a second for the
ADU. This project does not qualify as
a mobile home park, because the
units are on different parcels.

LU 21. A second dwelling unit ordinance shall
be prepared and enacted into law in
accordance with State planning law. Second
dwelling units may be allowed by use permit on
legally-conforming residential properties,
where there is an existing single-family home,
but only in accordance
with State planning law and all applicable
provisions of the LCP.

State Law prohibits local jurisdiction
from requiring a Use Permit for an
ADU. Therefore no Use Permit is
required.

LU 35. New developments shall be
encouraged to use native plant species that
are more drought resistant for landscaping.

New commercial development shall be
required to use native species for all
landscaping.

No landscaping plan has been
included in the application. See
Special Condition 4.

LU 41. To mitigate exterior sound levels, due
to transportation or other sources, for new
residential or other new projects,
consideration shall be given to an increased
setback distance; use of property line, patio,
and deck barriers; orientation of buildings to
achieve a sound shielding benefit at outdoor
use areas.

The proposed project complies with
this policy as the residential units
would be located behind existing
residential units which will result in a
natural sound barrier.

LAND USE AND ZONING
Zoning / General Plan: The parcel is both zoned and designated in the Point Arena General Plan as Urban Residential (UR), which describes the purpose of this zoning district as follows:
“… The urban residential zone applies to properties designated on the zoning map which are suitable for single-family residential uses, including co-housing projects. These areas shall be served by municipal sewer and water. Securing all appropriate and adequate services is a condition precedent to approval of development in these areas. This land-use designation promotes the infilling of development and provides for concentration of development in the downtown and adjacent areas.”
The proposed project complies with the designation as it would include single family homes and accessory dwelling units that would be connected to the City’s sewer and water systems. Per the zoning code Single Family Homes are permitted by right (no use permit is required) and while the zoning code allows a granny unit with a Use Permit, state law does not allow local jurisdictions to require a Use Permit to add an ADU.

Therefore, no Use Permit is required.

DEVELOPMENT STANDARDS – PARCEL SIZE
Lot Line Adjustment. The applicant proposes to adjust the lot lines to reconfigure the dimensions and orientation on four lots. The zoning code provides the minimum parcel size standards for new parcels within the UR zoning district. The Table below illustrates the parcel size standards in UR zoning and the project’s compliance with these standards:

The proposed lot line adjustment complies with all of the City’s zoning and subdivision requirements in Urban Residential regarding the lot width, depth and parcel size.

Site Access. Per section § 18.25.080 “Access to public road”. All new lots are required to have 25 feet of frontage to a public road or a public easement of at least 25 feet wide.

All lots created subsequent to the adoption of these regulations shall have 25 feet of frontage on a public road, or 25 feet of frontage on a public easement at least 25 feet wide from the lot to a public road. Lots existing on the effective date of these regulations not having such access to a road may be used for the purposes provided in these regulations if a use permit is first obtained incorporating such conditions as the planning commission deems necessary to ensure sufficient access to a public road.

As proposed, the project does not include 25 feet of frontage on a public road but it does include a non-exclusive public road easement of 25 feet (20 feet for the road and 5 feet for the sidewalk). Therefore, the project complies with the minimum access requirements.

Additionally, the City of Point Arena “Streets, Roads & Driveway Standards” includes driveway standards for subdivisions, with which the project must comply. In the Streets, Roads & Driveway Standards this road qualifies as a cul-de-sac street (page 2) the definition is included below:
“Cul-de-sac street” shall have the primary purpose of serving abutting land use and connecting to the nearest minor street or collector street. It is not intended to pass traffic through to another street and is a local street with only one outlet.

The minimum standards for a cul-de-sac street (Table 1VA page 5) are as follows:

Public Utility Easement – 5 feet in back
of property line or as required. The City
Engineer determined that a 3 foot wide
utility easement is sufficient.
3 feet on either side of
the road for 6 feet total
Yes as
determined by
City Engineer.

The proposed project includes sidewalk improvements on only one side of the new proposed cul-de-sac road. The City’s street standards require sidewalks on both sides of the road. Given that the road is not a through-road and traffic would be light and slow, the sidewalks on the east of the road may not be necessary from a safety perspective.

Special Condition 1: Parcel descriptions shall be submitted to the City Planner for review and approval prior to recordation by the Mendocino County Recorder. These new deeds, along with the below described maintenance agreements, shall be recorded prior to issuance of any building permits.

Required documentation includes:
a. Full description of each new parcel, to be recorded as part of the deeds; b. Any indemnification clauses needed, which shall become a part of the recorded deeds.
c. Permanent driveway, drainage, and utility easement clearly illustrated on a plat accompanying the deeds as a permanent exhibit. The easement shall illustrate a two-foot-wide curb lane on both sides of the road, a five-foot wide sidewalk easement on the west side of the private road, and two three foot wide utility easements on either side of the road.
d. A statement on the deeds that clearly indicates that the parcels are subject to all the conditions of CDP 2025-3, in perpetuity.
e. Permanent maintenance agreements between parcels for the maintenance of the private road, to be recorded prior to submittal of any building permit. f. Reference to all relevant documents deemed necessary by the City Engineer, including, but not limited to locations of sewer, water, and drainage infrastructure, and private easements.

OTHER DEVELOPMENT STANDARDS
The project is consistent with the various applicable development standards of the UR zoning district as follows:

Requirement Conformance
Setbacks: front
20 feet; rear 15
feet; side 10 feet.

The project does not comply with setback requirements, as the project includes the establishment of a road easement. Setback are measured from the back of sidewalk, and both ADUs of parcels 2 and 4 are located too close to the back of
street/sidewalk. The ADU on Lot 2 is located 7 feet from the back of sidewalk. The ADU on Lot 4 is located 4 feet from the back of STAFF REPORT CDP 2025-03, Boundary Line Adjustment 2025-01 December 16, 2025

the hammerhead turn around. Therefore, Special Condition 2 is required.

Height: 35 feet All existing and proposed buildings are less than the maximum height.

Minimum lot area:
8,625 SF
Complies, as the lot sizes range from 11,136 to 25,213 SF Minimum lot
width: 60 feet.

Complies, as all lots are much wider than 60 feet.

Sidewalks are
Required
See special condition 1 (above).

Special Condition 2: Prior to submittal of any Building Permit for Lot 4 and Lot 2, the applicant shall submit a revised site plan for the approval of the City Planner which relocates the ADU on Lot 2 such that it is 20 feet from the edge of the culde-sac sidewalk (the front yard) and the ADU on Lot 4 such that it is 10 feet from the edge of the road on the eastern side of the parcel (the side yard).

Fencing. No fencing is proposed for the project.

Special Condition 3: If fencing is constructed at a later date it shall comply with the City’s fencing requirements of section 18.25.110 which limit fence height to 4’ for front yards and 8’ for rear yards.

Parking Standards. The project is consistent with zoning code parking requirements.

Per Sec. 18.25.280 the project is required to provide two parking spaces for each primary unit and one parking space for each ADU. There is one parking space in each garage and a paved area adjacent to the garage that can serve as parking for an additional two cars space for each Single-Family Home, and one parking space in the garage and one paved space in front of the garage which can serve as sufficient parking for two cars for each ADU.

Landscaping and Screening (18.25.140). The Project application did not include a project landscaping plan. Special Condition 4 has been added.

Special Condition 4: Prior to submittal of any building permit applications for any of the parcels, the applicant shall submit a landscaping plan for said parcel that conforms with the requirements of 18.25.140 for the review and approval of the City Planner.

Site Development and Architectural Review (18.25.150): The proposed project is consistent with most relevant Site Development and Architectural Review requirements as follows:
• Siting Criteria 18.25.150 3. The project is not located in a scenic area.

STAFF REPORT CDP 2025-03, Boundary Line Adjustment 2025-01 December 16, 2025
8 | Page
• Design Criteria 18.25.150 4 a & b. The project does not include alterations of natural landforms and is not adjacent to open space.
• Design Criteria 18.25.150 4h. The scale, bulk, orientation, architectural character of the proposed single family homes and ADUs are diminutive and are compatible with the rural, uncrowded, rustic, unsophisticated, small, casual, open character of the community.
• Design Criteria 18.25.150 4o. The lengths of the six on-site driveways are minimal.
• Land Division Criteria 18.25.150 4t. The project complies with these criteria as the Lot Line Adjustment would result in clustered buildings on short driveways.

The length of the access road cannot be minimized more.

The project does not comply with the following Site Development and Architectural Review requirements and special conditions have been added to achieve compliance. • Design Criteria 18.25.150 4 c. The applicant has not proposed building materials or colors for the project.

Special Condition 5: The applicant shall submit color swatches and material choices with the building permit application for approval by the City Planner. Selected colors shall be natural colors.
• Design Criteria 18.25.150 4f. The applicant has not proposed to install underground utility service connection. The Special Condition below is included to require that the utilities are undergrounded.

Special Condition 6: All project utilities shall be undergrounded. • Design Criteria 18.25.150 4k. The developments has not been planned to avoid removing trees. A stand of Monterey Pines would have to be removed to construct the SFH and the ADU on Lot 3. Therefore, the applicant will need to replace these trees on a 2 to 1 ratio. See special Condition below.

Special Condition 7: The applicant shall submit a landscaping plan that includes the replacement of all tree removed to accommodate new development on parcels 2, 3 and 4 on a 2 to 1 ratio. Native trees species, such as bishop pine and sargent cypress are preferred.

Additionally, the installation of the road has the potential to destabilize the large Monterey Cypress trees that are on the neighbor’s property line. The code requires that at least two trees be planted for every one removed. City Council can choose to require the Special Condition below:

STAFF REPORT CDP 2025-03, Boundary Line Adjustment 2025-01 December 16, 2025
9 | Page
Special Condition 8: The applicant shall either: 1) relocate the road access 5 feet to the north along the south property line to avoid impacting the neighbor’s trees; or 2) submit a report by an arborist detailing that the installation of the road will not result in tree death.

PROJECT UTILITIES
The applicant proposes to retain an existing well and connect each property to the City water treatment system. Therefore, the project will require a backflow device to prohibit well water from flowing into the City’s water system. Special Condition 9 is included below. As noted above the project is required to underground all utilities and establish a 5 foot wide utility easement through all three parcels with new proposed development.

Special Condition 9. Prior to final of the building permit, the applicant shall install a backflow devise.

PUBLIC ACCESS
The City’s LCP does not identify any public access trail routes through these properties and none are required.

HAZARDS
Flooding: The property is located outside the 100-Year Flood Zone, according to the FEMA flood map (Flood Insurance Rate Map 060185-1740-G). Flood hazards are not anticipated to be an issue for this project.

Geology: The project is located in an area more than 100 feet from a bluff edge.

According to the General Plan’s Natural Hazards Map the project is not located on areas with steep slopes. The project will include grading and construction of new foundations and as such a soils report is required for the project.

Special Condition 10: The applicant shall submit a soils report prepared by a Civil Engineer as part of the building permit application. The engineering and construction shall comply with all requirements of the soils report.

Fire. The proposed project will not result in new fire risks as the project would be required to sprinkler all new residential buildings.

VISUAL RESOURCES
STAFF REPORT CDP 2025-03, Boundary Line Adjustment 2025-01 December 16, 2025
10 | Page
The proposed project is not located within the City’s mapped viewshed, as depicted on the Point Arena Scenic Corridors map. Therefore, a visual analysis of the project is not required.

NATURAL RESOURCES
Section 18.25.220 provides standards for development to protect natural resources. This section includes regulations that prohibit/regulate new development (including vegetation removal) within or adjacent to environmentally sensitive habitat areas (ESHAs), and ESHA buffer zones are required between proposed development and identified ESHA.

The applicant submitted a Biological Survey Report, authored by Wynn Coastal Planning. The report identified an ESHA on a neighboring site which is within 100 feet of the proposed development. The ESHA is Coastal brambles (Rubus spectabilis - Rubus ursinus Shrubland Association) and illustrated in the figure below with the 50 foot and 100 buffer (red and yellow line).
“The study area is vegetated primarily with non-native invasive and ornamental plants. (Figure 4). Tall stands of planted Monterey cypress trees are present along the southern boundary of the parcels and along the eastern boundary primarily west of Windy Hollow Road, but also east of the road in some locations. The primary vegetation within the interior of the parcels is non-native grasses and forbs and overgrown landscaping plants. Two small stands of young Monterey pines are present near the center of the study area. No areas of vegetation within the boundaries of the parcel are dominated by native plants, with the exception of some small patches of California blackberry….At the southeast corner of the study area, on the opposite side of the road from the subject parcels, is a patch of coastal brambles that is dominated by shrubby native plants that was determined to have the potential to support Point Arena mountain beaver, although it is somewhat isolated from other potential habitat.” Special Status Wildlife Species
Per the Biological Survey Report the site has been reviewed for the presence of Point Arena Mountain Beaver, nesting birds, northwestern pond turtle, Western Bumblebee, Obscure bumblebee Behren's silverspot butterfly, lotis blue butterfly, and California redlegged frog. However, no special-status wildlife was observed during the field biological surveys but suitable habitat for special status wildlife species above was identified.

STAFF REPORT CDP 2025-03, Boundary Line Adjustment 2025-01 December 16, 2025
11 | Page
The project was designed to avoid all
presumed special status resources by
greater than 100ft. The proposed
development is not expected to have
any significant negative impact on any
of the special status natural resources
present.

The biological report includes a number
of protective measures to ensure that no
resources are impacted by the project
and these are included in the Special
Condition below.

Special Condition 11: The
applicant shall comply with the
following:
a) Birds. If vegetation removal
occurs during the bird
breeding season (February to
August), a pre-construction
bird survey is recommended
within 14 days of the onset of
vegetation removal or
construction to ensure that no
nesting birds will be disturbed
during development. No
nesting bird surveys are recommended if activity occurs in the nonbreeding season (September to January). If active native bird nests are observed, no vegetation removal or construction activities with the potential to disrupt nesting shall occur within a 100-foot exclusion zone. These exclusion zones may vary depending on species, habitat and level of disturbance. The exclusion zone shall remain in place around the active nest until all young are no longer dependent upon the nest. b) Bats. To minimize impacts on bats, construction may only occur during daylight hours to limit disturbing construction noise and minimize artificial lights. Pre-construction bat surveys should be performed by a qualified biologist 14 days prior to the onset of development activities, unless trees are removed between November 1 and August 31.
c) Amphibians. Prior to the start of construction, a biologist shall train project contractors in the identification of the frogs and salamanders that occur along the Mendocino County coast. Workers will be trained to differentiate between special status and common species and instructed on actions and communications required to be conducted in the event that special status STAFF REPORT CDP 2025-03, Boundary Line Adjustment 2025-01 December 16, 2025
12 | Page
amphibians are observed during construction. During ground disturbing activities, construction crews will begin each day with a visual search around the staging and impact area to detect the presence of amphibians.

During construction and debris removal, any wood stockpiles shall be moved carefully by hand in order to avoid accidental crushing or other damage to amphibians.
d) Native Landscaping. Within 100’ of the Sensitive Natural Community (coastal brambles, as identified during the biological surveys and described in the biological report), all proposed landscaping shall be comprised of locally, appropriate native species within the buffer area.

ARCHAEOLOGICAL RESOURCES
No cultural resources inventory was conducted for this infill site. The following Special Conditions are required.

Special Condition 12. Unanticipated Discovery of Cultural Resources. If previously unidentified cultural resources are encountered during project implementation, avoid altering the materials and their stratigraphic context. A qualified professional archaeologist shall be contacted to evaluate the situation.

Project personnel should not collect cultural resources. Prehistoric resources include, but are not limited to, chert or obsidian flakes, projectile points, mortars, pestles, and dark friable soil containing shell and bone dietary debris, heataffected rock, or human burials. Historic resources include stone or abode foundations or walls; structures and remains with square nails; and refuse deposits or bottle dumps, often located in old wells or privies.

Special Condition 13. Encountering Native American Remains. Although unlikely, if human remains are encountered, all work must stop in the immediate vicinity of the discovered remains and the County Coroner and a qualified archaeologist must be notified immediately so that an evaluation can be performed. If the remains are deemed to be Native American and prehistoric, the Native American Heritage Commission must be contacted by the Coroner so that a “Most Likely Descendant” can be designated and further recommendations regarding treatment of the remains is provided.

BE IT FURTHER RESOLVED that the Point Arena City Council does hereby approve the Coastal Development Permit (2025-3) to allow:

A Lot Line Adjustment as follows:
• Lot 1 = 027-092-03 will change from 0.16 acre to 0.25 acre • Lot 2 = 027-092-04 will change from 0.11 acre to 0.40 acre • Lot 3 = 027-092-22 will change from 0.45 acre to 0.33 acre • Lot 4 = 027-092-24 will change from 0.83 acre to 0.57 acre Construction of one 361 sq ft single family residence and one 361 sq ft accessory dwelling unit and two detached 320 sq ft detached garages (one for each dwelling unit) on each of Lots 2, 3 and 4. Construction of a private street, driveways and parking; and connection of all three undeveloped lots to City utilities. This permit is subject to the following standard and special conditions:

SPECIAL CONDITIONS
a) Parcel descriptions shall be submitted to the City Planner for review and approval prior to recordation by the Mendocino County Recorder. These new deeds, along with the below described maintenance agreements, shall be recorded prior to issuance of any building permits. Required documentation includes:
b) Full description of each new parcel, to be recorded as part of the deeds; c) Any indemnification clauses needed, which shall become a part of the recorded deeds.
d) Permanent driveway, drainage, and utility easement clearly illustrated on a plat

Page 4 of 7 ends

accompanying the deeds as a permanent exhibit. The easement shall illustrate a twofoot-wide curb lane on both sides of the road, a five-foot wide sidewalk easement on the west side of the private road, and two three foot wide utility easements on either side of the road.
e) A statement on the deeds that clearly indicates that the parcels are subject to all the conditions of CDP 2025-3, in perpetuity.
f) Permanent maintenance agreements between parcels for the maintenance of the private road, to be recorded prior to submittal of any building permit. g) Reference to all relevant documents deemed necessary by the City Engineer, including, but not limited to locations of sewer, water, and drainage infrastructure, and private easements.

2. Prior to submittal of any Building Permit for Lot 4 and Lot 2, the applicant shall submit a revised site plan for the approval of the City Planner which relocates the ADU on Lot 2 such that it is 20 feet from the back of the cul-de-sac sidewalk (the side yard) and the ADU on Lot 4 such that it is 10 feet from the back of the road on the eastern side of the parcel (the side yard).

3. If fencing is constructed at a later date it shall comply with the City’s fencing requirements of section 18.25.110 which limit fence height to 4’ for front yards and 8’ for rear yards.

4. Prior to submittal of any building permit applications for any of the parcels, the applicant shall submit a landscaping plan for said parcel that conforms with the requirements of 18.25.140 for the review and approval of the City Planner.

5. The applicant shall submit color swatches and material choices with the building permit application for approval by the City Planner. Selected colors shall be natural colors.

6. All project utilities shall be undergrounded.

7. The applicant shall submit a landscaping plan that includes the replacement of all tree removed to accommodate new development on parcels 2, 3 and 4 on a 2 to 1 ratio. Native trees species, such as bishop pine and sargent cypress are preferred.

8. The applicant shall either: 1) relocate the road access 5 feet to the north along the south property line to avoid impacting the neighbor’s trees; or 2) submit a report by an arborist detailing that the installation of the road will not result in tree death.

9. Prior to final of the building permit, the applicant shall install a backflow device.

10.The applicant shall submit a soils report prepared by a Civil Engineer as part of the building permit application. The engineering and construction shall comply with all requirements of the soils report.

11.The applicant shall comply with the following:
a) Birds. If vegetation removal occurs during the bird breeding season (February to August), a pre-construction bird survey is recommended within 14 days of the onset of vegetation removal or construction to ensure that no nesting birds will be disturbed during development. No nesting bird surveys are recommended if activity occurs in the non-breeding season (September to January). If active native bird nests are observed, no vegetation removal or construction activities with the potential to disrupt nesting shall occur within a 100-foot exclusion zone. These exclusion zones may vary depending on

Page 5 of 7 ends

species, habitat and level of disturbance. Workers will be trained to differentiate between special status and common species and instructed on actions and communications required to be conducted in the event that special status amphibians are observed during construction.

12.Unanticipated Discovery of Cultural Resources. If previously unidentified cultural resources are encountered during project implementation, avoid altering the materials and their stratigraphic context. A qualified professional archaeologist shall be contacted to evaluate the situation. Project personnel should not collect cultural resources. Prehistoric resources include, but are not limited to, chert or obsidian flakes, projectile points, mortars, pestles, and dark friable soil containing shell and bone dietary debris, heat-affected rock, or human burials. Historic resources include stone or adobe foundations or walls; structures and remains with square nails; and refuse deposits or bottle dumps, often located in old wells or privies.

13.Encountering Native American Remains.

STANDARD CONDITIONS

1. This action shall become final on the date of approval. No appeal periods apply. The permit shall expire and become null and void at the expiration of two years after the effective date, except where construction and use of the property in reliance on such permit has been initiated prior to its expiration.

To remain valid, progress towards completion of the project must be continuous. The applicant has sole responsibility for renewing this application before the expiration date.

The City will not provide a notice prior to the expiration date.

Page 6 of 7 ends

2. The use and occupancy of the premises shall be established and maintained in conformance with the provisions of Title 18 of the Point Arena Municipal Code.

3. The application, along with supplemental exhibits and related material, shall be considered elements of this permit, and that compliance therewith is mandatory, unless an amendment has been approved by the City of Point Arena Planning Commission or its successor agency.

4. This permit shall be subject to the securing of all necessary permits for the proposed development from City, State and Federal agencies having jurisdiction.

5. The applicant shall secure all required building permits for the proposed project as required by the Building Inspection Division of the Mendocino County Department of Planning and Building Services.

6. This permit shall be subject to revocation or modification upon a finding of any one or more of the following:
a. The permit was obtained or extended by fraud.
b. One or more of the conditions upon which the permit was granted have been violated. c. The use for which the permit was granted is conducted so as to be detrimental to the public health, welfare or safety, or to be a nuisance.
d. A final judgment of a court of competent jurisdiction has declared one or more conditions to be void or ineffective or has enjoined or otherwise prohibited the enforcement or operation of one or more such conditions.

7. This permit is issued without a legal determination having been made upon the number, size or shape of parcels encompassed within the permit described boundaries. Should, at any time, a legal determination be made that the number, size or shape of parcels within the permit described boundaries are different than that which is legally required by this permit, this permit shall become null and void.

8. A two-year limitation applies to all coastal development, variance, conditional use, design review, planned residential development, or comprehensive development plan permits. If development has not commenced within two years from the granting of a permit, the permit shall be void, except where construction and/or use of the property in reliance on such permit has been initiated prior to its expiration. To remain valid, progress toward completion of the project must be continuous. On or before the date of expiration of a coastal development permit, variance, conditional use permit, design review, planned residential development, or comprehensive development plan, the person holding the permit shall apply for a renewal of said permit if the use is to be continued beyond the date of expiration or the development cannot be initiated prior to expiration. A renewal could be processed under Administrative review by the City, on a cost-recovery basis, for a renewal period of two years.

NOW, THEREFORE, BE IT RESOLVED, that this Resolution shall become effective immediately upon its passage and adoption.
