I CALL TO ORDER & ROLL CALL

II APPROVAL OF THE AGENDA
Motion to approve agenda by Vice Mayor Doyle , Second by Councilmember Dobbins. Motion passed unanimously 5-0.

III PUBLIC HEARING
A) Proposition 218 Public Hearing and Adoption of Wastewater Service Rates for Fiscal Years 2026-27 Through 2030-31
Mayor Burkey announced the public hearing on the proposed adoption of wastewater service rates for Fiscal Years 2026/27 through 2030/31.

Utility Rate Consultant Allison Lechowicz presented the rate study, explaining that the sewer fund currently has a negative fund balance of approximately $66,000 and that rate increases are necessary to maintain operations, repay interfund obligations, and fund future capital improvements and equipment not covered by grant funding. She noted that sewer rates were last adjusted in 2021 and that the proposed single-family residential rate would increase from $69.12 to $91.85 per month. She also reported that the proposed rates remain comparable to neighboring agencies.

Ms. Lechowicz reviewed the Proposition 218 protest process, stating that 82 written protests would be required to prevent adoption of the proposed rates. At the time of the hearing, the City had received 15 protests, including returned notices. She also explained that the noticed rates represent the maximum allowable rates, and the Council may adopt lower rates in future years if appropriate.

The Mayor opened the public hearing at 6:10 p.m.

Lauren Sinnott expressed support for the proposed rate increase, recognizing the challenges of maintaining the City's wastewater system and encouraging continued progress on related infrastructure projects.

Jim Soldani acknowledged the Council's difficult position, encouraged the City to continue pursuing grant funding to offset future costs, and urged the Council to keep future rate increases as low as possible.

There being no further comments, the public hearing was close at 6:15pm.

He added that, based on discussions with City Planner Marie Jones, pursuing a Coastal Development Permit for a campground would preserve the option for future consideration without obligating the City to construct one. Assistant City Manager/City Clerk Andersen presented Ordinance No. 247, which would place a measure before voters to increase the City's Transient Occupancy Tax (TOT) from 12% to 14%, effective April 1, 2027, if approved by a majority of voters at the November 3, 2026 General Election. He explained that April 1 aligns with the beginning of a new TOT reporting quarter and noted the election is estimated to cost approximately $3,000, with the increase projected to generate approximately $35,000 annually in additional revenue.

During public comment, Tracy DuPont asked the Council to review how revenues from the previous TOT increase had been allocated, noting that funding for tourism promotion had been discussed when the prior measure was approved. Lauren Sinnott expressed support for the proposed increase, stating that the additional tax would have minimal impact on visitors while providing additional revenue for the City.

The City Attorney advised that Council Member Hansen should recuse himself from consideration of the ordinance due to his ownership of a lodging business. Council Member Hansen recused himself from discussion and voting.
