RESOLUTION NO. 2022-21
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, PROCLAIMING A LOCAL EMERGENCY DUE TO THE WINDSTORM ON JANUARY 21 AND 22, 2022 WHEREAS, Ordinance No. 3180 of the City of Pomona empowers the City Council to proclaim the existence or threatened existence of a local emergency when the City of Pomona is affected or likely to be affected by a public calamity; WHEREAS, the City Council has been requested by the City Manager of the City of Pomona to proclaim the existence of a local emergency therein; WHEREAS, conditions of disaster or of extreme peril to the safety of persons and property have arisen within the City of Pomona as a result of the severe windstorm on January 21 and 22, 2022; WHEREAS, the windstorms included custs of up to 39 miles per hour and caused significant damage including but not limited to fallen trees and tree limbs; damaged fences, walls, cars, and houses; blocked streets and sidewalks; and power outages; WHEREAS, the City of Pomona’s ability to mobilize local resources, coordinate interagency response, accelerate procurement of vital supplies, use mutual aid, and seek future reimbursement by the State and Federal governments will be critical to successfully respond to the damage caused by the windstorm; and WHEREAS, said City Council does hereby find that conditions of extreme peril to the safety of persons and property have arisen within the City of Pomona, caused by the windstorm on January 21 and 22, 2022; and that the aforesaid conditions of extreme peril warrant and necessitate the proclamation of the existence of a local emergency.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pomona as follows:
SECTION 1. The City Council hereby proclaims that a local emergency now exists through the City of Pomona.
SECTION 2. During the existence of said local emergency the powers, functions, and duties of the City Manager and the emergency organization of the City of Pomona shall be those prescribed by state law, by ordinances, and resolutions of this city and approved by the City Council on January 24, 2022.
SECTION 3. A copy of this proclamation be forwarded to the Director of California’s Office of Emergency Services requesting that the Director find it acceptable in accordance with State law; that the Governor of California, pursuant to the Emergency Services Act, issue a proclamation declaring an emergency in the City of Pomona; that the Governor waive regulations that may hinder response and recovery efforts; that recovery assistance be made available under the California Disaster Assistance Act; and that the State expedite access to State and Federal resources and any other appropriate federal disaster relief programs.
SECTION 4. Said local emergency shall be deemed to continue to exist and that the need for continuing the local emergency will be reviewed at least once every 60 days, pursuant to California Government Code Section 8630 until the emergency’s termination is proclaimed at the earliest possible date by the City Council of the City of Pomona, State of California.
SECTION 5. The City Clerk shall attest and certify to the passage and adoption of this Resolution, and it shall become effective immediately upon its approval.
