To: Honorable Mayor and Members of the City Council
From: James Makshanoff, City Manager
Submitted By: Linda Matthews, Human Resources/Risk Management Director SUBJECT: APPROVAL OF SALARY INCREASE FOR THE CITY MANAGER AND ADOPTION OF RESOLUTIONS AMENDING CITYWIDE SALARY SCHEDULE AND COMPENSATION PLAN FOR EXECUTIVE GROUP A AND B EMPLOYEES RECOMMENDATION:

It is recommended that the City Council take the following actions:

Approve a four percent (4%) pay increase effective January 16, 2022 for City Manager James Makshanoff in accordance with his employment contract; and Adopt the following resolutions:

RESOLUTION NO. 2022-22 – A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA AMENDING THE CITY OF POMONA’S SALARY SCHEDULE FOR FISCAL YEAR 2021-22 TO MEET THE REQUIREMENTS OF CALIFORNIA CODE OF REGULATIONS TITLE 2, SECTIONS 570.5 AND 571 TO MODIFY THE SALARY OF THE CITY MANAGER RESOLUTION NO. 2022-25 – A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, AMENDING APPENDIX A OF THE COMPENSATION PLAN FOR EXECUTIVE MANAGEMENT GROUP A AND B EMPLOYEES BY MODIFYING THE SALARY FOR THE CITY MANAGER EXECUTIVE SUMMARY:

Under the Pomona City Charter, the City Manager is appointed directly by and serves at the pleasure of the City Council. The City Council recently conducted a performance evaluation for City Manager James Makshanoff. After conducting the evaluation, the City Council has authorized a four percent (4%) salary increase effective January 16, 2022 for the City Manager in accordance with the terms of his employment contract approved on December 16, 2019. The actions herein implement that direction from the City Council.

FISCAL IMPACT:

The estimated cost for the remainder of Fiscal Year 2021-22 is $5,988 for all funds and will be paid from existing appropriations within the Fiscal Year 2021-22 Operating Budget.

DISCUSSION:

Under the Pomona City Charter, the City Manager is appointed directly by and serves at the pleasure of the City Council. The contract for City Manager James Makshanoff was approved on December 16, 2019 and included a four percent (4%) increase in the pay period including January 21, 2022, assuming satisfactory performance. After completing the performance evaluation, the City Council has determined that the City Manager is eligible for the four percent (4%) increase as negotiated in his employment contract upon his hire. With approval of this increase, the City Manager’s salary will increase from $286,000 to $297,440. This new salary is comparable or less than the maximum posted salary for several nearby cities, including Ontario ($355,392), Pasadena ($301,932), and Santa Ana ($343,224).

Attachment 1 is a resolution approving the change to the Citywide Salary Schedule for Fiscal Year 2021-22, which includes all job classifications and pay ranges for all represented and unrepresented employee groups and reflects the change to the City Manager’s salary as proposed herein. In accordance with the requirements of the California Code of Regulations, Title 2, Sections 570.5 and 571, the City must adopt and publically post a consolidated Salary Schedule for all City classifications. Attachment 2 is a resolution amending the Compensation Plan for Executive Group A and B Employees. Currently the salary listed in Appendix A of this Plan reflects $286,000 for the City Manager. The proposed salary reference reflects that the salary is determined by the contract. This will streamline the process in the future so that the Compensation Plan does not have to be modified each time the City Manager’s salary is modified. The salary will be reflected in the citywide salary schedule.

This action includes compensation changes for a local agency executive. Pursuant to California Government Code 3511.1, the City is required to “orally report a summary of a recommendation for a final action on the salaries, salary schedules, or compensation paid in the form of fringe benefits of a local agency executive, as defined in subdivision (d) of Section 3511.1, during the open meeting in which the final action is to be taken.” Consistent with this requirement, this item is being placed on the discussion calendar for consideration.
