CITY OF POMONA

COUNCIL REPORT
February 7, 2022
To: Honorable Mayor and Members of the City Council
From: James W. Makshanoff, City Manager
Submitted by: Chris Diggs, Water Resources Director
SUBJECT: AWARD A BID FOR UTILITY PAVEMENT AND SIDEWALK CUT REPAIRS TO G.M. SAGER CONSTRUCTION COMPANY, INC.

RECOMMENDATION:

It is recommended that the City Council take the following actions:

Approve the categorical exemption from CEQA pursuant to Section 15301; Award a bid to G.M. Sager Construction Company, Inc. for permanent pavement and sidewalk repairs, at the prices bid, for a term of three-years, with two additional one-year extension options; and Authorize the City Manager to execute the contract and any amendments on behalf of the City, subject to review by the City Attorney.

EXECUTIVE SUMMARY
The recommended actions will award a three-year contract, with the option for two additional one year extensions, that will result in the permeant repair of over 2,000 temporary pavement and sidewalk utility patches.

FISCAL IMPACT:

Funding is available for the proposed contract in the Water Resources Department (Department) Operating budget (571-8124-52936-00000). During the remainder of FY 2021-22, staff anticipates that approximately $400,000 is needed based on the current backlog of temporary utility pavement patches. It is anticipated that approximately $300,000 will be required annually. The number of patches will be assessed annually and funding for future years will be included in each respective annual budget submission.

PUBLIC NOTICING REQUIREMENTS:

In accordance with Section 2-993.1 - Formal Procurement Procedure of the City’s Purchasing Ordinance, an Invitation for Bid for “Utility Pavement and Sidewalk Repair”, IFB NO: 2021-1026 was posted on the City’s electronic bidding platform on November 29, 2021.

PREVIOUS RELATED ACTION:

None.

ENVIRONMENTAL IMPACT:

The proposed work is categorically exempt from CEQA pursuant to Section 15301 and needing no further environmental review as the work is a repair of existing utility infrastructure involving no expansion of the existing use.

DISCUSSION:

The Department maintains hundreds of miles of water, sewer, and stormwater pipeline and other infrastructure. Through the course of normal maintenance operations, asphalt, sidewalks and curbs are removed to access underground utility infrastructure. City staff install temporary patches with cold-mix asphalt to make the surface safe and useful again. At this juncture, the Department proposes to hire a pavement contractor to complete permeant repairs of the pavement and sidewalks.

Department staff regularly document each utility repair and any associated pavement or sidewalk repair. This data is uploaded to the City’s geographical information system (GIS) and will be used to systematically complete the necessary permeant repairs.

On November 29, 2021, an Invitation for Bid (IFB) No. 2021-1026 – “Utility Pavement & Sidewalk Repair” was issued on the City’s electronic bidding platform. The solicitation notified 944 potential proposers, of which 26 potential proposers downloaded the IFB, resulting in the City receiving two bids. The two proposers are G.M Sager Construction Company, Inc. and Hardy & Harper, Inc. These bids identified seventy-nine possible pavement and sidewalk repair items for unit cost definition. For comparison purposes the 79 items listed in the bid were combined. G.M. Sager Construction Company, Inc. submitted the lowest responsible combined cost bid.
