SUBJECT: ADOPT A RESOLUTION APPROVING AND ACCEPTING THE CORRIDORS SPECIFIC PLAN (CSP) IN-LIEU PAYMENT FOR CERTAIN PUBLIC IMPROVEMENTS ALONG GAREY AVENUE AND AMENDING THE CIP BUDGET RECOMMENDATION: It is recommended that the City Council adopt the following resolution:
RESOLUTION NO. 2022-34 – A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, APPROVING AND ACCEPTING THE CORRIDORS SPECIFIC PLAN IN-LIEU FEE PAYMENT OF $286,710 FROM GREYSTAR FOR CERTAIN PUBLIC IMPROVEMENTS ALONG A PORTION OF GAREY AVENUE; AND Amending the Capital Improvement Program (CIP) Budget by INCREASING REVENUE ESTIMATES AND appropriating the $286,710 in-lieu fee payment to “Garey Avenue Rehabilitation - Aliso Street to Monterey Avenue,” Project No. 428-2590-XXXXX-68573 EXECUTIVE SUMMARY: Under the Corridors Specific Plan (CSP), developers of projects that front designated streets are required to construct specific public improvements/enhancements along the street frontage of designated corridors where their projects are situated. Developers have the option to construct the required public improvements or make an “in-lieu payment” that will fund the improvements, which will then be constructed by the City of Pomona (City). The CSP in-lieu payment of $286,710 by Greystar (“The Gabriel”) will cover the cost of a portion of public improvements along Garey Avenue.
FISCAL IMPACT: The CSP in-lieu payment of $286,710 for public improvements will be appropriated to “Garey Avenue Rehabilitation - Aliso Street to Monterey Avenue,” Project No. 428-2590-XXXXX-68573. The table below summarizes the impact of the recommended actions:

PREVIOUS RELATED ACTION: On December 6, 2021, the City Council created a new CIP Project entitled “Garey Avenue Rehabilitation – Aliso Street to Monterey Avenue,” Project No. 428-2590-XXXXX-68573. On December 13, 2017, Planning Commission Resolution No. 17-053 approved the Development Plan Review (DPR 5953-2016) for the construction of 647 multi-family residential units and 3,700 square feet of commercial space in two buildings at 2771 North Garey Avenue along the CSP. The Resolution set forth the conditions of approval, including an estimate for in-lieu CSP fee to be paid by the developer for public improvements on a portion of Garey Avenue.
DISCUSSION: Pursuant to Planning Commission Resolution No. 17-053 and the design standards set forth in the Corridors Specific Plan, Staff advised Greystar of public improvements that must be constructed within the public right-of-way. The developer has the option to either construct the required improvements or pay an in-lieu fee to the City and have the City construct the improvements in the future. The in-lieu fee is based on a cost estimate for the required improvements and the lineal footage of the project’s street frontage.
The CSP improvements in front of the project frontage along Garey Avenue were recently completed by the City. Subsequently, the CSP in-lieu fee to be paid by Greystar is appropriated to “Garey Avenue Rehabilitation - Aliso Street to Monterey Avenue,” Project No. 428-2590-XXXXX-68573. This new CIP project is expected to extend the North Garey Avenue CSP improvements further south towards Downtown Pomona.
Staff believes the CSP in-lieu fee is justified and equitable. Staff plans to present a resolution in the future that will provide a mechanism for assessing CSP costs for future developments.
COUNCIL PRIORITIES & GOALS: This item supports the June 21, 2021 City Council Priority 5: Infrastructure – Goal P: Improve conditions of streets, alleys, and associated sidewalks.
