March 21, 2022
To: Honorable Mayor and Members of the City Council
From: James Makshanoff, City Manager
Submitted By: Chris Diggs, Water Resources Director
SUBJECT: APPROVE AMENDMENT NO. 1 TO THE AGREEMENT WITH ENSAFE, INC. FOR ENGINEERING SERVICES FOR THE “WATER RESOURCES BUILDING” PROJECT RECOMMENDATION:
It is recommended that the City Council take the following actions:
Approve Amendment No. 1 to the agreement with EnSafe, Inc. in the amount of $78,432, (for a total of $146,292 for professional Civil Engineering Services; SUSMP & Grading Plans for 198 N. Hamilton Boulevard), for the CIP Project “Water Resources Building” Project No. 575-8125-XXXXX-93135; and Authorize the City Manager, or designee, to execute any agreements necessary to complete the EnSafe, Inc. amendment, contingent upon City Attorney review.
EXECUTIVE SUMMARY:
The requested actions will amend an agreement (Attachment No. 1) with EnSafe, Inc. (EnSafe) to complete Professional Civil Engineering Services (SUSMP & Grading Plans for 198 N. Hamilton Boulevard) for the “Water Resources Building” CIP Project.
FISCAL IMPACT:
The original agreement with EnSafe is for $67,860. The proposed action will amend the agreement by adding $78,432, for a total amount of $146,292 for professional Civil Engineering Services (SUSMP & Grading Plans for 198 N. Hamilton Boulevard). Funding for the services is available in the “Water Resources Building,” Project No. 575-8125-XXXXX-93135, in the adopted 2021-22 CIP budget. Table 1 on the following page summarizes the fiscal impact for the recommended actions:

Amendment 1 to EnSafe agreement for SUSMP & Grading Engineering Services ($78,432)
Balance Remaining for Construction Contract, Construction Contingency, Internal and Miscellaneous Costs $3,901,529
ENVIRONMENTAL IMPACT:
On September 20, 2021, Council approved the design and construction of the Water Resources building and the associated Addendum to the 2017 Final Mitigated Negative Declaration for the “Pomona Corporate Yard Facility” Project (State Clearinghouse Number 2017051029). The action associated with this report is to complete necessary design elements associated with water quality and parking lot design for the already approved project and associated California Environmental Quality Act (CEQA).
DISCUSSION:
As part of the design of the Water Resources building, the parcel at 198 N. Hamilton Blvd. is required to have a Standard Urban Stormwater Mitigation Plan (SUSMP) completed. This parcel is included in a current Department of Toxic Substances (DTSC) voluntary cleanup agreement. Along with the SUSMP, a grading plan compliant with the existing DTSC Removal Action Workplan (RAW) is required. This effort initially included designing the parking lot and stormwater infrastructure for the Water Resources building that meets the DTSC RAW requirements. The Pomona Stables building will be relocated onto this same parcel.
On September 16, 2020 an informal Invitation for Bid (IFB) No. 2020-1027 Professional Services Consultant – SUSMP and Grading Plan was issued on the City’s electronic bidding platform. The solicitation was sent to 35 bidders on the Master On-Call Consultants list, of which nine (9) downloaded the bid, resulting in one (1) proposal. The bidder that obtained the contract was EnSafe. As per City Code 2-1002 (d), award of informal contracts are delegated to the City Manager.
In 2021, DTSC included additional unforeseen design requirements for the site that necessitate an amendment to the original agreement with EnSafe. Due to the additional design requirements by DTSC, the amendment for this project exceeds 25% and now requires City Council approval to proceed.
