(Restaurant) Authorizes the sale of beer and wine for consumption on or off the premises where sold. Distilled spirits may not be on the premises (except brandy, rum, or liqueurs for use solely for cooking purposes). Must operate and maintain the licensed premises as a bona fide eating place. Must maintain suitable kitchen facilities, and must make actual and substantial sales of meals for consumption on the premises. Minors are allowed on the premises.

Type 20 - Off-Sale Beer & Wine
(Package Store) Authorizes the sale of beer and wine for consumption off the premises where sold. Minors are allowed on the premises.

B. Operations

The business currently operates with ten employees and is open Monday through Sunday from 8am to 9pm and is not anticipating any change in business hours (Attachment 3).

For the type 41 on-sale beer & wine license, all products will be stored behind the food counter in a small refrigerator as indicated on the floor plan (shaded in purple). For this license patrons would be required to order from the lunch counter and all products would be provided by staff from behind the counter with zero accessibility given to patrons (Attachment 4).

For the type 20 off-sale beer & wine license, all products for sale to customers will be located within a refrigerator located along the back wall of the convenience market (shaded in orange), allowing a direct line of site from the refrigerator to the register for staff. Inventory for both licenses that is inaccessible to the public will be stored on two shelves on the back wall of the walk-in cooler.

Additionally, in an effort to prevent the sale of alcohol to minors and prevent consumption of alcohol on premise, Mi Mercadito market staff will be fully trained in ID verification for any patron appearing under 40 years of age, on site security staff will be implemented as needed, and the market is fully equipped with existing surveillance cameras.

C. Property History

According to Building & Safety permit records, the existing 4,000 square foot commercial structure containing the convenience market and ancillary restaurant was constructed following the demolition of a two-story residential structure in 1962. According to City business license records beginning in 1977 the structure served as a fresh produce wholesale business for J & G Produce and has served as a neighborhood convenienc e market since 1997, with Mi Mercadito taking over operations in 2001.

The existing market is considered the one of t wo convenience markets with fresh produce within in the neighborhood. With Stater Brothers Market as the nearest large scale General Retail Market at .7 miles on Garey Avenue and the second nearest being Cardenas Markets at 1.5 miles on Holt Avenue.

The building façade remains largely in its original state based on building permit history, with the exception of signage and some interior remodeling to accommodate the ancillary restaurant use . The applicant is not proposing any interior tenant improvements to accommodate the proposed alcohol use and intends on operating in the same capacity.

STAFF ANALYSIS

SPECIFIC PLAN AMENDMENT

A. Applicable Code Sections

Pursuant to Pomona Zoning Ordinance (PZO) Section .584-J, a specific plan may be amended in the same manner that it was adopted. Specific Plan amendments are subject to the same findings as those that pertain to initial specific plan approval.

1. The proposed plan systematically implements and is consistent with the general plan;

2. The proposed plan will not be detrimental to the public interest, health, safety, convenience, or welfare of the city;

3. The subject property is physically suitable for the requested land use designation(s) and the anticipated land use development(s);

4. The plan provides for the development of a comprehensively planned project that is superior to development otherwise allowed under conventional zoning classifications; and5.The proposed plan will contribute to a balance of land uses so that local residents may work and shop in the community in which they live.

B. Proposed Amendment

The proposed Specific Plan Amendment would amend Section 2.3.2. Table 2 -5 Land Use Matrix of the DPSP (Page 55), the rows proposed for change are Convenience Markets, Alcohol Sales (On-sale) and Alcohol Sales (Off-sale) within the Residential Multi-Family District column.

C. Tribal Consultation

In accordance with Senate Bill 18 (Burton 2004) (Government Code §6532.3(a)(1)) Planning Division staff contacted the California Native American Heritage Commission for a list of Tribes with ancestral lands in Pomona and offered consultation on the propo sed specific plan amendment. None of the California Native American Tribes requested consultation regarding the proposed amendment.

D. General Plan Conformance

The project site is designated as General Plan Place Type Transit Oriented District:

Neighborhood, which contemplates commercial uses, as well as Transect Zones T4 -A, which allows residential densities of up to 70 dwelling units per acre. The proposed use is consistent with the sites’ designated General Plan Place Type. The project is consistent with the following General Plan goals:

Goals 6B.G4: Ensure that transit oriented districts are walkable, active, and well integrated into surrounding City districts and neighborhoods.

Goals 6B.G6: Cultivate Downtown as the “Heart of the City,” whe re residential, shopping, employment, entertainment, educational, art, cultural, and SPA-16021-2021

civic activities are supported by transit, parks, parking, and a walkable environment.

Goals 7B.G10: Encourage expansion of existing businesses and extend efforts at business retention.

The proposed specific plan amendment to allow convenience markets by -right within the Residential Multi-Family District will positively affect the general welfare of the community as it will enable the property owners to establish needed c onvenience markets with fresh produce at a small scale within residential neighborhoods assisting with food access and promoting walkability within the Downtown area.

Allowing alcohol licenses by Conditional Use Permit within the Residential Multi-Family District through the proposed amendment will reinforce the aforementioned General Plan goals pertaining to walkabil ity, expansion of the Downtown a rea, and the economic support of existing businesses. In addition, as of 2021, the Conditional Use Permit application contains an annual inspection fee in which the Planning Division may inspect the property to ensure the issued Conditional Use Permit is satisfying all issued conditions of approval. Should the permit conditionals of approval not be satisfied or the permit with correlation prove to contribute to crime rates in the area, the permit may be revoked by the Planning Commission.

E. Environmental Review

The California Environmental Quality Act (CEQA) requires analysis of agency approvals of discretionary “projects.” A “project,” under CEQA, is defined as “the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment” (State CEQA Guidelines Section 15378). The proposed project is considered a “project” under CEQA.

In 2014, the City of Pomona adopted a Final Environmental Impact Report (EIR) associated with the discretionary project, which analyzed the environmental impacts of the Cit y of Pomona’s General Plan Update (GPU), Corridors Specific Plan, Active Transportation Plan, and Green Plan. In conjunction with the certification of the GPU and PCSP EIR, a Mitigation Monitoring and Reporting Program (MMRP) was adopted. The proposed proj ect site was previously studied under this Certified Final EIR.

In compliance with Section 15061(b)(3), the proposed project is covered by the general rule exemption which exempts activities that can be seen with certainty to have no possibility for causing a significant effect on the environment. The project may be considered for the general rule exemption in that the proposed project only includes the amendment of text of an adopted document to permit uses by discretionary review or permit uses by -right previously studied in the 2014 Pomona G PU Final EIR. The proposed project described ab ove hereby meets the guidelines. Therefore, no further environmental review is required.

CONDITIONAL USE PERMIT

With the approval of the proposed Specific Plan Amendment (SPA -16021-2021) by the Planning Commission and City Council, the subject request may be considered.

A. Applicable Code Sections

The DPSP, Residential Multi-Family District permits convenience market and ancillary eating establishments by-right and alcohol sales (On -sale & Off -sale) within the Residential Multi- Family District by Conditional Use Permit. Pursuant to the DPSP, Chapter 2 Section 2.3.3(B)(i), uses subject to a Conditiona l Use Permit shall be approved, approved with conditions, or disapproved by the Planning Commission, and are subject to the regulations and procedures pertaining to Conditional Use Permits contained in Section .580 of the Pomona Zoning Code.

Section .580.J and .5809.4 of the PZO establishes criteria for approval of a Conditional Use Permit for the On-sale and 0ff-sale as follows:

1) Off Street Parking: For On-sale one parking space shall be provided for each four persons of occupancy load as defined in the Uniform Building Code, City of Pomona. For Off -sale one parking space shall be provided for 100 square feet of gross floor area.
2) Parking Lot: Parking lots, including landscaping and lighting, shall be installed and maintained per city standards.
3) Area Compatibility: The proposed on -sale liquor establishment shall be compatible with existing development in the area.
4) Proximity: The proposed location shall be sufficiently removed from any existing residential development or zoning and any church, school, park, or playground so as not to be detrimental to that use.

B. Code Compliance

Staff has evaluated the proposed project and has determined that the request is in compliance with the PZO and DPSP, as it provides sufficient parking ratios for the existing use as outlined by the DPSP, maintains lighting of the parking area, and is not proposing any exterior or interior tenant improvements thus conforms to all development and operational standards and, as a result, the granting of this Conditional Use P ermit, subject to conditions, will not adversely affect the subject site or surrounding area.

Conditions of approval have been drafted to reflect similar conditions brought fo rth by the staff for other bona fide restaurants serving alcohol. These conditions include regulations related to hours of operation, security, graffiti abatement, the sale of alcohol, advertisement, and noise.

C. Undue Concentration

The State Department of Alcoholic Beverage Control (ABC) defines undue concentration if either the threshold of available licenses in the designated census tract is exceeded or if the crime- reporting district is designated as “high crime.” The threshold for number of licenses is based on a ratio of the number of alcohol licenses to population within the Census Tract, in relation to the Los Angeles County average. The threshold for designating a district high crime is twenty percent higher than average number of arrests per reporting district (average number of arrests x 120%).

According to the guidelines established by ABC, a total of five on-sale licenses are allowed and a total of four off-sale licenses are allowed in the subject Census Tract No. 4088.00 before the tract is deemed to have undue concentration of either on-sale or off-sale licenses.

The high number of on -sale licenses within census tract 4088.00 (outlined in black) may be attributed to the General Plan Designations of this tract . As depicted in Figure 4, this tract predominantly consists of 3 designations; Transit-Oriented District: Core(brown), Transit Oriented District: Neighborhood (light brown-orange), and Activity Center (red). These designations are catalyzed by retail, promote walkability, contain a mix of building types & commercial uses and support the highest housing densities ranging from 70 units an acre to over 100 units . This census tract also contains the entirety of the Downtown Pomona Specific Plan (with the exception of a single parcel), and the downtown Activity Center (red T) which are intended to be the premier activity center “center of the center” of Pomona’s retail and entertainment core. In addition, this census contains parcels within the Pomona Corridors Specific Plan and parcels regulated by the Pomona Zoning Ordinance.

According to 2021 Police Reporting District Data, the threshold for designating a district “high crime” is 98 crimes. The subject site is located in Police Reporting District No. 6, which experienced a total of 140 Part I Offenses and Part II Arrests (Table 3). Therefore, the district is considered a “high crime” district. Beginning in 2022, the Pomona Police Department will begin to categorize crimes directly related to alcohol consumption (i.e. alcohol related vehicular accidents, public intoxication, etc.).

Both the on-sale and off-sale licenses proposed exceed the number allowed licenses and are located within a police-reporting district identified as “high crime”. As such, a finding of Public Convenience or Necessity (PCN) is required for both licenses with the on-sale findings of PCN to be made by ABC and off-sale findings of PCN to be made by City Council.

Area Compatibility & Proximity

Pursuant to PZO Section .5809 (4)(e), the proposed location shall be sufficiently removed from any existing residential development or zoning and any religious facility, school, park or playground so as not to be detrimental to that use. The Planning Division has outlined the nearest fresh produce markets, residential, religious, school, and park uses as they relate to the proposed licenses.

The proposed use currently serves as a convenience market for the existing residential uses within 200 feet to the north along Monterey Avenue . The existing market i s considered the one of two convenience market with fresh produce within in the neighborhood. With the Stater Brothers Market as the nearest large scale General Retail Market at .7 miles on Garey Avenue and Cardenas Markets being the second at 1.5 miles on Holt Avenue.

The subject site is within 200 feet of a house of worship (Iglesia Cristiana Segvidores De Cristo) located at 315 S Park Avenue and within 500 feet of another house of worship (Foursquare Church of Pomona) located at 480 W Monterey Avenue.

The subject property is approximately 1,300 feet from the nearest educational institution (the School of Arts and Enterprise) located at 295 N Garey Avenue and 1,400 feet from the nearest park (Memorial Park) located at 655 W 3rd Street.

Though the proposed use may be considered to be within close proximity to residential uses and hou ses of worship, the proximity to those uses is also what has allowed the existing convenience market to be economically viable since 2001 and provide access t o fresh produce since 1977, thus the proposed use may be deemed compatible with conditions of approval and annual inspections.

Goals 6B.G6: Cultivate Downtown as the “Heart of the City,” where residential, shopping, employment, entertainment, educational, art, cultural, and civic activities are supported by transit, parks, parking, and a walkable environment.

Goals 7B.G10: Encourage expansion of existing businesses and extend efforts at business retention.

Allowing the proposed use by Conditional Use Permit supports the aforementioned General Plan goals pertaining to walkability, expansion of the Downtown Area, and economic support of existing businesses. In addition, the C onditional Use P ermit now contains an annual inspection fee in which the Planning Division may inspect the property to ensure the issued Conditional Use Permit is satisfying all issued conditions of approval. Should the permit conditionals of approval not be satisfied or the p ermit with correlation prove to contribute to crime rates in the area, the permit may be revoked.

E. Environmental Review

The City of Pomona, as lead agency, has conducted an environmental review on the proposed project per the California Environmental Quality Act (CEQA). Pursuant to the provisions of CEQA (Public Resources Code, Section 21084 et. seq.), the guidelines include a list of classes of projects which have been determined not to have a significant effect on the environment and which shall, therefore, be exempt from the provisions of CEQA. The Planning Commission will consider adopting a Categorica l Exemption in compliance with Section 15301, Class 1 (Existing Facilities ) in that the project involves no expansion of the existing commercial structure. The proposed project described above hereby meets the guidelines for a Categorical Exemption. Therefore, no further environmental review is required.

PUBLIC COMMUNICATION

A copy of the public hearing notice was published in the Inland Valley Daily Bulletin on January 28, 2022 and was sent to the owners and occupants of properties within a 400-foot radius of the subject site on January 27, 2022 (Attachment 6). As of the date of this report, staff has not received any comments in opposition to the proposed project.

SECTION 3. In accordance with Section .584(I) of the Zoning Ordinance, the Planning Commission must make findings in order to approve Specific Plan Amendment (SPA 16021- 2021). Based on consideration of the whole record before it, including but not limited to, the staff report, public testimony received at the public hearing on this matter, and evidence made part of the public record, the Planning Commission hereby finds as follows:

1. The proposed Specific Plan Amendments systematically implement and are consistent with the General Plan.

The project site is designated as General Plan Place Type Transit Oriented District:

Neighborhood, which contemplates commercial uses, as well as Transect Zones T4 -A, which allows residential densities of up to 70 dwelling units per acre. The proposed use is consistent with the sites’ designated General Plan Place Type and is consistent with the following General Plan goals:

Goals 6B.G4: Ensure that transit oriented districts are walkable, active, and well integrated into surrounding City districts and neighborhoods.

Goals 6B.G6: Cultivate Downtown as the “Heart of the City,” where residential, shopping, employment, entertainment, educational, art, cultural, and civic activities are supported by transit, parks, parking, and a walkable environment.

Goals 7B.G10:Encourage expansion of existing businesses and extend efforts at business retention.

2. The proposed Specific Plan Amendments will not be detrimental to the public interest, health, safety, convenience or welfare of the City.

The proposed Specific Plan Amendment to allow convenience markets by-right within the Residential Multi -Family District will positively affect the general welfare of the community as it will enable the property owners to establish needed convenience markets with fresh produce at a small scale within resid ential neighborhoods assisting with food access and promoting walkability within the Downtown area.

Allowing alcohol licenses by Conditional Use Permit within the Residential Multi-Family District through the proposed amendment will reinforce the aforeme ntioned General Plan goals pertaining to walkability, expansion of the Downtown area, and the economic support of existing businesses. In addition, as of 2021, the Conditional Use Permit application contains an annual inspection fee in which the Planning Division may inspect the property to ensure the issued Conditional Use Permit is satisfying all issued conditions of approval.

Should the permit conditionals of approval not be satisfied or the permit with correlation prove to contribute to crime rates in t he area, the permit may be revoked by the Planning Commission.

Thus, the proposed Specific Plan Amendment will not be detrimental to the public interest, health, safety, convenience, or welfare of the City.

3. The subject property is physically suitable for the requested land use designations and the anticipated land use developments.

The subject property is has not requested a change in land use designation. The proposed project amendment only includes the amendment of text of an adopted document to permit uses by discretionary review or permit uses by-right previously studied in the 2014 Pomona General Plan Final Environmental Impact Report.

4. The Specific Plan Amendments provide for the development of a comprehensively planned project that is superior to development otherwise allowed under conventional zoning classifications.

The Specific Plan Amendment will not supersede development requirements outlined in the Downtown Pomona Specific P lan and only effects uses permitted by -right and by Conditional Use Permit.

5. The proposed Specific Plan Amendments will contribute to a balance of land uses so that local residents may work and shop in the community in which they live.

The proposed specific plan amendment to allow convenience markets by-right and alcohol sales (On-Sale & Off-Sale) by Conditional Use Permit will contribute to a balance of land uses so that local residents may work and shop in the community in which they live in that it will assist with walkability, expansion of the Downtown area, economic support of existing businesses, food access, and local job creation.

SECTION 3. Based on consideration of the whole record before it, including but not limited to, the staff report, public testimony received at the public hearing on this matter, and evidence made part of the public record, the Planning Commission hereby finds that the proposed Code Amendment is in the public interest and in the interest of the furtherance of the public health, safety, and welfare and is, as a matter of law, consistent with the Pomona General Plan pursuant to Government Code Section 65852.2(a)(1)(c).

SECTION 4. The Planning Commission of the City of Pomona hereby recommends the City Council approve Specific Plan Amendment (SPA 16021-2021) to amend Section 2.3.2.

the City of Pomona, California:

SECTION 1. The Planning Commission exercising their independent judgm ent has determined that pursuant to the Guidelines for Implementation of the California Environmental Quality Act (CEQA), the project is Categorically Exempt under Section 15301, (Class 1 – Existing Facilities) in that the proposed project is an existing convenience market and ancillary eating establishment.

SECTION 2. If any part, provision, or section of this resolution is determined by a court or other legal authority with jurisdiction over the subject matter of this resolution to be unenforceable or invalid, the remainder of the entirety of this resolution shall not be affected and shall continue in full force and effect. To this end, the provisions of this resolution are severable.

SECTION 3. In accordance with Section .580.B of the Pomona Zoning Ordinance, the Planning Commission must make findings in order to approve Conditional Use P ermit ( CUP 16022-2021). Based on consideration of the whole record before it, including but not limited to, the staff report, public testimony received at the public hearing on this matter, and evidence made part of the public record, the Planning Commission hereby finds as follows:

1. That the proposed use at the particular location will contribute to the general well being of the neighborhood or community.

The sale of alcoholic beverages for a Type 41 (On -sale) and Type 20 (Off -sale) beer and wine alcohol sales will enhance the operation of the convenience market and eating establishment by providing a service and convenience to the public . The sale of alcohol will be incidental to the primary use, which is a convenience market and eating establishment. Furthermore, the addition of alcohol to the services provided will help ensure the economic viability of the convenience market which offers fresh produce, thus increasing the likelihood that the business will continue operating and providing commercial opportunities and food access to local residents. The subject alcohol licenses will not negatively affect the general welfare of the neighborhood , with the appropr iate conditions.

2. That such use will, under the circumstances of the particular case, not be detrimental to the health, safety, peace, or general welfare of persons residing or working in the vicinity or detrimental to the use, valuation or enjoyment of p roperty or improvements in the vicinity.

As conditioned, the applicant’s request will not be detrimental to the health, safety, peace, or general welfare of persons residing or working in the vicinity in that the project is in conformance with the development standards and use requirements of the Pomona Zoning Ordinance and Downtown Pomona Specific Plan and has been conditioned appropriately.

3. That the site for the proposed use is of adequate topography, size, and shape to PC Resolution No 21-031
CUP-16022-2021(269 N. Park Avenue)

Page 3 of 9 ends

accommodate said use, as well as all yards, spaces, walls, fences, parking, loading, landscaping, and any other features necessary to allow said use in the neighborhood.

According to Building & Safety permit records, the existing 4,000 square foot commercial structure containing the convenience market and ancillary eating establishment was constructed following the demolition of a two -story residential structure in 1962.

According to City business license records beginning in 1977 the structure served as a fresh produce wholesale business for J & G Produce and has served as a neighborhood convenience market since 1997.

4. The site abuts streets and highways adequate in width and improvements to carry traffic generations by the proposed use.

The subject site takes access from Park Avenue which is capable of handling any additional vehicle trips generated by the proposed use as reviewed by the City Traffic Engineer.

5. That granting of such conditional use permit will not adversely affect the General Plan of the City and conforms to the provisions of the zoning ordinance.

The project site is designated as General Plan Place Type Transit Oriented District:

Neighborhood, which contemplates commercial uses. The proposed use is consistent with the sites’ designated General Plan Place Type and conforms to the provisions of the Pomona Zoning Ordinance and Downtown Pomona Specific Plan. The project is consistent with the following General Plan goals:

Goals 6B.G4: Ensure that transit oriented districts are walkable, active, and well integrated into surrounding City districts and neighborhoods.

Allowing the proposed use by Conditional Use Permit supports the aforementioned General Plan goals pertaining to walkability, expansion of the Downtown Area, and economic support of existing businesses. In addition, the Conditional Use Permit now contains an annual inspection fee in which the Planning Division may inspect the property to ensure the issued Conditional Use Permit is satisfying all issued conditions of approval. Should the permit conditionals of approval not be satisfied or the permit with correlation prove to contribute to crime rates in the area, the permit may be revoked.

Thus, the Conditional Use Permit will not adversely affect the General Plan of the City.
