ORDINANCE NO. 4313
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, AMENDING SECTION 30-753 of Chapter 30, ARTICLE XII OF THE Pomona City Code REGARDING THE SCHEDULE FOR CITYWIDE YARD SALES WHEREAS, Article XII of Chapter 30 of the Pomona City Code establishes rules and regulations for the conducting of Citywide Yard Sales; and Whereas, the Pomona City Council wishes to amend the schedule for Citywide Yard Sales; and WHEREAS, to facilitate the proposed schedule change and any potential future amendments to the scheduling of Yard Sales, the City desires to amend the City Code to provide for scheduling of such sales by Council Resolution; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Pomona as follows:
SECTION 1. That Pomona City Code, Chapter 30 – Licenses, Permits and Miscellaneous Regulations, Article XII – Yard Sales is hereby amended by adding and amending the following:
Sec. 30-753. - Time limits.
(a) The City Council shall adopt, by resolution, a schedule for the conducting of occasional sales. Except as provided in subsection (c) herein, occasional sales may only be conducted on the first weekend of the months of March, June, September and December. For the purposes of this subsection, the term weekend means the first consecutive Friday, Saturday and Sunday of said months. (b) Occasional sales shall only be conducted between the hours of 8:00 a.m. and 6:00 p.m. (c) If rainy weather conditions exist on either Friday or Saturday of the first weekend of the designated months, occasional sales may be conducted on the following consecutive Saturday and Sunday. In the event rainy weather conditions exist on Friday or Saturday of the first weekend of the designated months and on the subsequent Saturday or Sunday, an alternate Saturday and Sunday may be designated by the city council.
SECTION 2. The City Clerk shall certify to the passage of this Ordinance, and shall cause same to be posted as required by law, and this Ordinance shall take effect thirty (30) days after its adoption.
