SAN ANTONIO AVENUE, ASSESSOR PARCEL NUMBERS 8327-005-007 AND -008; and Authorize the City Engineer to sign the Tract Map TM No. 74367 on behalf of the City.
EXECUTIVE SUMMARY: Shahram Tork, with Tork, Inc., property owner, submitted two development applications to the Pomona Planning Division for Tentative Tract Map TRACTMAP-004947-2016, TM No. 74367, and Conditional Use Permit CUP-004607-2016 related to the subdivision of two lots totaling approximately 1.07 acres and development of a 14-unit residential condominium project at 1198-1236 S. San Antonio Avenue, Assessor Parcel Numbers (APNs) 8327-005-007 and -008. Due to the Planning Commission’s non-decision regarding the subdivision and development applications, the owner filed an appeal of non-action with the Pomona City Council and was granted approval on both applications. The approval of Tract Map TM No. 74367 (Attachment No. 1 - Exhibit “A”) will allow the property owner to meet the project’s tentative tract map requirements as established by the City Council. The proposed Tract Map TM No. 74367 has been prepared in accordance with the approved tentative tract map, and has been submitted for approval.
PREVIOUS RELATED ACTIONS: On April 12, 2017, the Planning Commission considered the applications for Tentative Tract Map TRACTMAP-004947-2016, TM No. 74367, and Conditional Use Permit CUP-004607-2016 related to the subdivision and development of a 14-unit residential condominium project at 1198-1236 S. San Antonio Avenue, APNs 8327-005-007 and -008, and was unable to gather the affirmative votes necessary to pass the approval resolutions.
On August 7, 2017, the City Council adopted Resolution Nos. 2017-121 (Attachment No. 2) and 2017-119 approving TRACTMAP-004947-2016 and CUP-004607-2016, respectively, for the proposed subdivision and development of the real property located at 1198-1236 S. San Antonio Avenue, APNs 8327-005-007 and -008. The initial Tentative Tract Map expiration date was August 7, 2019.
On April 24, 2019, the Planning Commission approved Time Extension EXT-011704-2019 and extended the Tentative Tract Map expiration date to August 7, 2020.
On October 29, 2020, the Planning Division issued a Decision Letter to extend the tentative map expiration date to February 7, 2022, in compliance with California Assembly Bill 1561. AB 1561 extends the validity of the housing entitlements by an additional eighteen (18) months that were: (a) issued and in effect prior to March 4, 2020 and (b) set to expire prior to December 31, 2021..
On January 12, 2022, the Planning Commission approved Time Extension EXT-017495-2022 and extended the Tentative Tract Map expiration date to February 7, 2023.
ENVIRONMENTAL IMPACT: Pursuant to the provisions of the California Environmental Quality Act (CEQA), the proposed project meets the criteria for Class 32, Section 15332 Categorical Exemption in that the project involves development of a project less than five acres in an urbanized area that can be served by all required utilities and public services, and that would not result in any significant effects relating to traffic, noise, air quality, or water quality.
DISCUSSION: The development applications submitted by the property owner for TRACTMAP-004947-2016, TM No. 74367, and CUP-004607-2016 were approved by the City Council to allow the land subdivision and development of a 14-unit residential condominium project on the property addressed as 1198-1236 S. San Antonio Avenue, APNs 8327-005-007 and -008. The approximately 1.07-acre site is located on the east side of San Antonio Avenue, north of Grand Avenue, and south of Ninth Street (Attachment Nos. 3 and 4). The project consists of fourteen new two-story, three- and four-bedroom units ranging in size from 1,548 to 1,930 square feet of living space. The development includes attached two-car garages, private and common open spaces, guest parking, walkways, landscape improvements, and recreational amenities. All common areas within the project boundaries will be owned and maintained by a homeowner’s association. The public street vehicular access to the site is provided by a new driveway along S. San Antonio Avenue.
Approval of Tract Map TM No. 74367 and its subsequent recordation will allow the owner, Tork, Inc., (i) to meet the conditions of approval for Tentative Tract Map TRACTMAP 004947-2016, and (ii) to facilitate the completion of the proposed construction and the issuance of the Certificates of Occupancy for the development.
