MISSION BOULEVARD, POMONA, CA, AND APPROVAL OF QUITCLAIM DEED FOR THE VACATED EASEMENT (COUNCIL DISTRICT 2) RECOMMENDATION: It is recommended that the City Council take the following actions:

Adopt the following Resolution:

RESOLUTION NO. 2022-62 – A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, ORDERING THE SUMMARY VACATION VU2-2021 OF THE CITY’S UNUSED SEWER EASEMENT WITHIN BLOCK 83 OF THE POMONA TRACT M.R. 03/90-91, FOR THE PROPERTY LOCATED AT 508 W. MISSION BOULEVARD, ASSESSOR PARCEL NUMBER 8341-010-050, AND APPROVING QUITCLAIM DEED FOR THE VACATED EASEMENT; and Authorize the City Manager to execute the quitclaim deeds on behalf of the City.

EXECUTIVE SUMMARY: Adoption of Resolution No. 2022-62 (Attachment No. 1) will approve: (i) the summary vacation of the existing public sewer easement that is unused and unnecessary for the proposed residential development located at 508 W. Mission Boulevard, and (ii) the Quitclaim Deed (EXHIBIT 1 attached to the Resolution) requested by the owner for the vacated easement.

FISCAL IMPACT: No fiscal impact at this time.

PREVIOUS RELATED ACTION: On May 19, 1986, the City Council adopted Resolution No. 86-96 (Attachment No. 2) ordering the vacation V-207 of the public alley located south of Mission Boulevard, between Parcels Street and Park Avenue, and reserving a ten-foot easement on behalf of the City of Pomona.

On December 2, 2019, the City Council adopted Resolution No. 2019-192 approving Lot Merger LM8-2019 of the properties previously known as Assessor Parcel Numbers 8341-010-914 to -921 and located within Block 83 of the Pomona Tract M.R. 03/90-91, to facilitate the completion of the West Mission Apartments residential project proposed by the Jamboree Housing Corporation-Acquisitions, LLC.

On February 27, 2020, the Development Services Director adopted DPR Resolution No. 20-001 approving Development Plan Review DPR 13212-2019 for the development of a multi-family, affordable housing project at 508 W. Mission Boulevard.

ENVIRONMENTAL IMPACT: None.

DISCUSSION: The West Mission Housing Partners, LP, a subsidiary of Jamboree Housing Corporation and owner of the real property addressed as 508 W. Mission Boulevard, Assessor Parcel Number (APN) 8341-010-050, has submitted a request to the Public Works Department for the summary vacation of the ten-foot easement reserved on behalf of the City of Pomona as part of the recorded vacation V-207 of the public alley located within Block 83 of the Pomona Tract M.R. 03/90-91. The easement was necessary to provide access for the maintenance of an existing public sewer main and it is legally described in EXHIBIT “A” and depicted on EXHIBIT “B” attached to the Resolution.

As a result of the 2020 recordation of Lot Merger LM8-2019 (Attachment No. 3) of the properties located within the referenced Block 83 of the Pomona Tract M.R. 03/90-91 and approval of Development Plan Review DPR 13212-2019 (Attachment No. 4), West Mission Housing Partners, LP submitted development plans for the construction of two buildings, Buildings A and B, with fifty-seven (57) one-, two-, and three-bedroom apartments. The residential units range in size from 629 to 974 square feet. The development of the approximately 1.43-acre real property (Attachment Nos. 5 and 6) is currently under construction, and will include an at-grade parking lot, private and tandem garages, and public and private open spaces.

In accordance with the approved project site plan (Attachment No. 7), which depicts the proposed residential buildings being constructed over the subject public sewer easement, the property owner is required to abandon the public sewer main and construct a new sewer alignment (Attachment No. 8) within the adjacent public streets (Park Avenue, Sixth Street, and Rebecca Street). Subsequently, the owner is requesting (i) the summary vacation of the City easement as being no longer needed, and (ii) the approval of the Quitclaim Deeds associated with the vacated easement.
