CITY OF POMONA

COUNCIL REPORT
May 2, 2022
To: Honorable Mayor and Members of the City Council
From: James Makshanoff, City Manager
Submitted By: Rene Guerrero, Public Works Director
SUBJECT: APPROVE AMENDMENT NO. 1 WITH PINNACLE ENVIRONMENTAL TECHNOLOGIES FOR THE “UNDERGROUND STORAGE TANKS – WORK AND REMOVAL PLANS” PROJECT RECOMMENDATION: It is recommended that the City Council take the following actions:

Approve Amendment No. 1 to Purchase Order #203250 with Pinnacle Environmental Technologies in the amount of $18,054 (for a total of $72,879) for professional services to abandon and install new monitoring wells at the Brackett Field Pomona Police Heliport for CIP Project “Underground Storage Tanks – Work and Removal Plans,” Project No. 428-2590-XXXXX-71061; and Authorize the City Manager, or designee, to execute any documents necessary to execute Amendment No. 1.

EXECUTIVE SUMMARY: The requested actions will amend the purchase order for Pinnacle Environmental Technologies to replace four groundwater monitoring wells and install two additional groundwater monitoring wells for “Underground Storage Tanks – Work and Removal Plans,” Project No. 428-2590-XXXXX-71061 (Project), as identified in the work plan approved by the Los Angeles Regional Water Quality Control Board (LARWQCB). This will ensure continued protection of human health, safety, and the environment.

FISCAL IMPACT: There is available funding in the Project account 428-2590-XXXXX-71061. The table below summarizes the fiscal impact of this action:

PREVIOUS RELATED ACTION: On March 16, 2020, City Council adopted a resolution to create CIP Project “Underground Storage Tanks – Work and Removal Plans,” Project No. 428-2590-XXXXX-71061 and appropriated $50,000 of General Funds to the Project.

DISCUSSION: On December 19, 2019, the LARWQCB met with City Staff to discuss mandatory corrective actions necessary for underground storage tanks at four identified locations. The City was directed to take corrective action to ensure protection of human health, safety, and the environment (pursuant to Health and Safety Code section 25296.10). Any person who violates any corrective action requirement established by, or issued pursuant to, Health and Safety Code Section 25296.10 is liable for civil penalty of not more than ten thousand dollars ($10,000) for each underground storage tank for each day of violation.

On January 19, 2022, an informal Invitation for Bid (IFB) No. 2022-04 was issued on the City’s electronic bidding platform, Planet Bids. The solicitation was sent to 297 vendors, with twelve (12) prospective bidders, resulting in five (5) proposals. The lowest responsive bidder was Pinnacle Environmental Technologies (Pinnacle), as per City Code 2-1002 (a), award of informal contracts by purchase order.

Approval of this amendment is required due to the cost exceeding the original purchase order amount by greater than 25%. During the initial stages of work, Pinnacle did not encounter sufficient groundwater at the original planned depth of 45 feet below ground surface to complete the well for sampling as required by LARWQCB. To avoid additional costs for the re-mobilization and re-drilling of wells, staff recommends and concurs with Pinnacle’s recommendation to deepen all the wells to a total depth of 65 feet Prepared by:
