MISSION BOULEVARD, POMONA, CA, ASSESSOR PARCEL NUMBERS 8349-002-047, -048, AND 8349-003-057, INCLUDING THE VACATION OF A PORTION OF A PUBLIC ALLEY, RELATED TO THE SUBDIVISION AND DEVELOPMENT OF A 24-UNIT RESIDENTIAL CONDOMINIUM PROJECT (COUNCIL DISTRICT 5) RECOMMENDATION: It is recommended that the City Council take the following actions:

Adopt the following Resolution:

RESOLUTION NO. 2022-80 – A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, APPROVING TRACT MAP TM NO. 82522 FOR THE PROPERTY LOCATED AT 1626-1630 W. MISSION BOULEVARD, INCLUDING THE VACATION OF A PORTION OF A PUBLIC ALLEY ASSESSOR PARCEL NUMBERS 8349-002-047, -048, AND 8349-003-057; and Authorize the City Engineer to sign the Tract Map TM No. 82522 on behalf of the City.

EXECUTIVE SUMMARY: Golden Ticket Mission 71, LLC, initial property owner, submitted three development applications to the Pomona Planning Division for Tentative Tract Map TRACTMAP 11889-2019, TM No. 82522, General Plan Conformity GPC 11890-2019, and Development Plan Review DPR 11888-2019, related to the subdivision of five lots totaling approximately 0.88 acres, the vacation of a portion of a public alley, and development of a 24-unit residential condominium project at 1626-1630 W. Mission Boulevard, Assessor Parcel Numbers (APNs) 8349-002-047, -048, and 8349-003-057. The approval of Tract Map TM No. 82522 (Attachment No. 1 - Exhibit “A”) will allow the current property owner, Pomona Missian, LLC, to meet the project’s tentative tract map requirements as established by the Planning Commission. The proposed Tract Map TM No. 82522 has been prepared in accordance with the approved tentative tract map, and has been submitted for approval.

FISCAL IMPACT: The City will no longer be responsible for the pavement maintenance costs of approximately $7,500, every ten to fifteen years, for the portion of the public alley proposed for vacation.

PREVIOUS RELATED ACTIONS: On July 24, 2019, the Planning Commission adopted Resolution No. 19-033 (Attachment No. 2), approving Tentative Tract Map TRACTMAP 11889-2019 and TM No. 82522 for a residential subdivision consisting of 24 condominium units at 1626-1630 W. Mission Boulevard, APNs 8349-002-047, -048, and 8349-003-057. The Tentative Tract Map expiration date was July 24, 2021.

On July 24, 2019, the Planning Commission adopted Resolution No. 19-034 (Attachment No. 3) approving General Plan Conformity GPC 11890-2019 for the vacation of the westerly 100 feet of the 30-foot wide public alley located south of Mission Boulevard (Brea Canyon Road) and west of Curran Place. The Resolution also made a finding of General Plan Conformity Assessment that (i) the proposed alley vacation would not adversely impact its surroundings and is consistent with the General Plan of the City, (ii) the alley will no longer be needed by the City to provide public access as the abutting parcels are under the ownership of the project applicant for the proposed development and (iii) the project will further the goals and policies of the General Plan by revitalizing the neighborhood.

On August 23, 2021, the Planning Division issued a Decision Letter to extend the tentative map expiration date to January 24, 2023, in compliance with California Assembly Bill 1561. AB 1561 extends the validity of the housing entitlements by an additional eighteen (18) months that were: (a) issued and in effect prior to March 4, 2020 and (b) set to expire prior to December 31, 2021.

ENVIRONMENTAL IMPACT: Pursuant to the provisions of the California Environmental Quality Act (CEQA), the proposed project meets the criteria for Class 32, Section 15332 Categorical Exemption. The project is consistent with the applicable General Plan designation and policies, with the applicable zoning designation and regulations, occurs within city limits on a site of no more than five acres substantially surrounded by urban uses, has no value as a habitat for endangered, rare or threatened species, can be served by all required utilities and public services, and would not result in any significant effects relating to traffic, noise, air quality, or water quality.

DISCUSSION: The development applications submitted by Golden Ticket Mission 71, LLC, initial property owner, for TRACTMAP-11889-2019, TM No. 82522, and DPR 11888-2019 were approved by the Planning Commission to allow the land subdivision and development of a 24-unit residential condominium project on the property addressed as 1626-1630 W. Mission Boulevard, APNs 8349-002-047, -048, and 8349-003-057. The approximately 0.88-acre site is located on the south side of Mission Boulevard (Brea Canyon Road), west of Curran Place (Attachment Nos. 4 and 5). The project consists of four new two- and three-story buildings with a total of 24 one- and two-bedroom condominium units ranging in size from 1,392 to 1,935 square feet of living space. The development includes attached one- and two-car garages, private and common open spaces, guest parking, walkways, landscape improvements, and recreational amenities. All common areas within the project boundaries will be owned and maintained by a homeowner’s association. The primary public street vehicular access to the site is provided by a new Mission Boulevard (Brea Canyon Road) driveway approach. There will also be a vehicular egress only point provided along the easterly property line for access to Curran Place via the remainder of the existing public alley.

Approval of Tract Map TM No. 82522 and its subsequent recordation will allow the owner, Pomona Missian, LLC, (i) to meet the conditions of approval for Tentative Tract Map TRACTMAP 11889-2019, and (ii) to facilitate the completion of the proposed construction and the issuance of the Certificates of Occupancy for the development.
