A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA APPROVING THE FISCAL YEAR 2022-23 TO FISCAL YEAR 2026-27 FIVE-YEAR CAPITAL IMPROVEMENT PROGRAM AND ADOPTING A CAPITAL IMPROVEMENT PROGRAM BUDGET FOR FISCAL YEAR 2022-23 WHEREAS, on May 9, 2022, the City Council held its Fiscal Year 2022-23 Budget Study Session; WHEREAS, a notice was published on May 20, 2022 in the Inland Valley Daily Bulletin advising of a public hearing to be held on June 6, 2022, and inviting the public to provide comments and express views and objections on City’s proposed budget for Fiscal Year 2022-23; WHEREAS, the City Manager has prepared and presented to the City Council of the City of Pomona the proposed Fiscal Year 2022-23 to Fiscal Year 2026-27 Five-Year Capital Improvement Program and a proposed Capital Improvement Program Budget in the amount of $25,579,448 for Fiscal Year 2022-2023, as set forth in Exhibit A; WHEREAS, the City Council desires to change the Proposed CIP Document published for the May 9, 2022 study session by adding appropriation of ARPA funding to and revising the description of 1 existing CIP project (Exhibit B) and creating a new CIP project with additional ARPA funding (Exhibit C), as well as reducing the appropriation of Gas Tax funding for 1 CIP project (Exhibit D) and reducing the appropriation of SB1/RMRA funding for 1 CIP project (Exhibit E) the proposed Fiscal Year 2022-23 CIP Budget document as set forth in Section 4 below; and WHEREAS, after conducting the public hearing on June 6, 2022, and receiving public comments and views, the City Council desires to adopt the proposed Fiscal Year 2022-23 to Fiscal Year 2026-27 Five-Year Capital Improvement Program (CIP) and the Fiscal Year 2022-23 CIP Budget, as amended, including any amendments that may have been approved at the conclusion of the public hearing.
WHEREAS, the Finance Department has savings within it’s General Fund Budget and wishes to appropriate these savings to fund improvements to the basement floor within City Hall as part of the City Hall Complex Remodel and Flooring,” Project No. 428-2590-XXXXX-74115.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pomona, as follows:
SECTION 1. That the City Council has considered the proposed Fiscal Year 2022-23 to Fiscal Year 2026-27 Five-Year Capital Improvement Program and Capital Improvement Program Budget for Fiscal Year 2022-23 at a duly noticed public hearing on June 6, 2022.
SECTION 2. That the proposed Fiscal Year 2022-23 to Fiscal Year 2026-27 Five-Year Capital Improvement Program is hereby approved, in substantially the form submitted, and incorporated herein by this reference, a copy of which is on file in the Office of the City Clerk.
SECTION 3. That funding for the Fiscal Year 2022-23 Capital Improvement Program Budget in the amount of $25,579,448 is hereby approved, as set forth in Exhibit A, attached hereto.
SECTION 4. That changes to the Proposed CIP Budget document presented on May 9, 2022 are as follows:
Adding an appropriation of ARPA funding to and revising the description of 1 existing CIP project as detailed in Exhibit B, attached hereto; Creating a new CIP project and appropriating ARPA funding as detailed in Exhibit C, attached hereto; Reducing the appropriation of Gas Tax funding for 1 CIP project, with new amount as detailed in Exhibit D, attached hereto; Reducing the appropriation of SB1/RMRA funding for 1 CIP project, with new amount as detailed in Exhibit E, attached hereto.
SECTION 5. That any subsequent Council action prior to June 30, 2022 that has the effect of amending the approved Fiscal Year 2022-23 CIP Budget will be reflected in the final Fiscal Year 2022-23 CIP Budget documents without additional or separate Council action.
SECTION 6. That any non-substantive errors or discrepancies in the adopted Five-Year CIP Program or Fiscal Year 2022-23 CIP Program Budget, subsequent to adoption, but no later than June 30, 2022, shall be corrected administratively and incorporated into the final CIP Program and CIP Program Budget documents with no additional Council action required. Any changes, amendments or corrections to the approved Program or Program Budget after June 30, 2022, shall require approval by City Council resolution.
SECTION 7. The City Council amends the FY 2021-22 Capital Improvement Program (CIP) Budget by appropriating $18,350 of General fund funding to “City Hall Complex Remodel and Flooring,” Project No. 428-2590-XXXXX-74115 (428-2590-80701-74115, 428-2590-66196-74115) and revises the project description to reflect the changes to the Print and Mailing Services Division space which provides internal services to City Departments.
SECTION 8. The City Clerk shall certify to the passage and adoption of this resolution and it shall thereupon be in full force and effect.
