To: Honorable Mayor and Members of the City Council
From: James Makshanoff, City Manager
Submitted By: Michael Ellis, Chief of Police
SUBJECT: INTRODUCTION OF AN ORDINANCE AMENDING THE POMONA CITY CODE TO ADD “LARGE-VEHICLE PARKING REGULATIONS” TO CHAPTER 58 OF THE CODE RECOMMENDATION:
It is recommended that the City Council introduce, waive further and give first reading to the following ordinance:
ORDINANCE NO. 4315 – AN ORDINANCE OF THE CITY OF POMONA, CALIFORNIA, AMENDING CHAPTER 58, ARTICLE V, OF THE POMONA CITY CODE TO ADD DIVISION 2.5 “LARGE-VEHICLE PARKING REGULATIONS” EXECUTIVE SUMMARY:
The City of Pomona has received complaints regarding the stopping and parking of large vehicles, such as recreational vehicles, on residential and other City streets. This purpose of this Ordinance is to ensure that there is adequate parking for residents of the City, to increase the safety of public streets, and to regulate the parking of vehicles that are actively used as sleeping accommodations.
Proposed Ordinance No. 4315 (Attachment No. 1) was first introduced and given first reading at the May 2, 2022 Council meeting. Ordinance No. 4315 was scheduled to be adopted at the May 16, 2022 Council meeting. However, due to a discrepancy found by staff in Section 58-304 (Tow-Away Authority), this section was amended to allow the Pomona Police Department to tow unpermitted large-vehicles from any street within the city. Staff is re-introducing Ordinance No. 4315 (Attachment No. 2) to reflect this amendment and in the spirit of transparency.
FISCAL IMPACT:
The fiscal impact of the implementation of this ordinance would create a cost for the signage required prohibiting the parking of any recreational vehicle within city limits with limited exemptions. This signage would be posted at the entry to the city limits and other locations deemed necessary by the City Engineer. Cost per sign is estimated at $130 per sign including installation. There are 10 signs that will be required to be installed at the city boundaries creating a fiscal impact of $1,300. Funding for the signs are available in the Public Works Department, Gas Tax Fund Operating Budget (208-2562-52750-00000).
DISCUSSION:
California Vehicle Code section 22507 and California case law interpreting this section expressly authorize cities to adopt an ordinance or resolution that prohibits or restricts the stopping, parking, or standing of certain vehicles, including, but not limited to, vehicles that are six feet or more in height. The parking of large vehicles on public streets creates a safety hazard for both motorists and pedestrians as these tend to block lines of sight, impair motorist and pedestrian visibility, and reduce the travel widths along City streets.
