CITY OF POMONA
COUNCIL REPORT
June 6, 2022
To: Honorable Mayor and Members of the City Council
From: James Makshanoff, City Manager
Submitted By: Michael Ellis, Chief of Police
SUBJECT: APPROVAL OF A ONE-YEAR AGREEMENT WITH THE DOWNTOWN POMONA OWNERS’ ASSOCIATION FOR SUPPLEMENTAL POLICE PATROLS IN THE DOWNTOWN POMONA BUSINESS IMPROVEMENT DISTRICT RECOMMENDATION:
It is recommended that the City Council take the following actions:
Approve a one-year Agreement between the City of Pomona and the Downtown Pomona Owners’ Association (DPOA); and Authorize the City Manager, or designee, to execute the Agreement on behalf of the City, in substantially the form submitted, subject to review and approval by the City Attorney.
EXECUTIVE SUMMARY: Action on this item is to approve a one-year agreement with the DPOA to continue providing two (2) Police Officers for supplemental police patrols in the downtown Pomona Business Improvement District (PBID). The contract has a one-year extension option which, if executed, would fund the officers for an additional year through June 30, 2024.
FISCAL IMPACT:
The total FY 2022-23 cost to provide enhanced police services in the PBID under this agreement is $397,380. Of this amount, $179,928 is funded by the DPOA. The remaining amount of $217,452 is funded by the City’s General Fund. Any costs in excess of the city’s $217,452 contribution shall be the responsibility of the DPOA. The entire cost of $397,380 has been included in the Police Department’s FY 2022-2023 proposed budget which is concurrently on this same agenda for approval. A one-year extension option is built into the contract for FY 2023-2024, which includes a rate increase of up to 2% to the DPOA, should the cost of the program increase with the adopted FY 2023-2024 budget.
PREVIOUS RELATED ACTION:
The City Council approved the renewal of the Police Services Agreement between the City of Pomona and the DPOA for FY 2020-21 on June 15, 2020. A one year extension option of the Police Services Agreement between the City of Pomona and the DPOA for FY 2021-22 was exercised and approved July 1, 2021.
DISCUSSION:
The DPOA’s core purpose is to manage the PBID and make Downtown Pomona a desirable and economically vibrant place to be. In furtherance of that goal the DPOA entered into a contract with the city to create a new Downtown Patrol Unit (DPU). At the time, the DPU consisted of one (1) Police Corporal and two (2) Police Officers. In addition, the DPOA contracts separately for private security guard services. The combination of police and security guard services provides 24-hours a day, seven days a week safety coverage in the Downtown Area.
DPU staffing in the past has been two (2) full-time Police Officer positions and will remain at this level through the FY 2022-2023 contract period and the optional FY 2023-2024 extension period.
Police Officers assigned to the DPU program are operationally assigned to the Police Department’s Operations Division and they are directly supervised by a Police Lieutenant. The Operations Division Captain is designated as the unit's administrative manager and is responsible for facilitating communications with the DPOA, ensuring attending at meetings and coordinating coverage for special events.
The new DPOA “Agreement for Supplemental Police Patrol Services” covers the period beginning July 1, 2022 through June 30, 2023 (Attachment No. 1), with a one-year extension option covering July 1, 2023 through June 30, 2024.
