SIDE LETTER TO THE 2021-2023 MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF POMONA
AND
POMONA CITY EMPLOYEES’ CHAPTER OF THE TEAMSTERS LOCAL 1932 (TEAMSTERS)
RELATED TO PUBLIC SERVICES MAINTENANCE WORKER I/II AND PAINT AND SIGN TECHNICIAN I/II CLASSIFICATION CHANGES
PREAMBLE
This Side Letter to the Memorandum of Understanding (MOU) on wages, hours, and working conditions is entered into between the Pomona City Council (hereinafter referred to as the "City") and the Pomona City Employees' Chapter of the Teamsters Local 1932 (hereinafter referred to as Teamsters), collectively referred to as "Parties”.
The purpose of this Side Letter is to document specific provisions related to the reclassification and merger of Public Services Maintenance Worker I/II, Paint and Sign Technician I/II and Stormwater Maintenance Worker I/II.
SIDE LETTER TERMS AND CONDITIONS
The Public Works Department desires to eliminate the Paint and Sign Technician I/II classification and reclassify the two incumbents to Public Services Maintenance Worker I/II classification. To accomplish this, the classification of Public Services Maintenance Worker I and II will receive a 2 range increase, to be equal to Paint and Sign Technician I/II and then the incumbents will be reclassified.
The paint and sign duties will be added to the Public Services Maintenance Worker I/II responsibilities and job description. It is anticipated that employees will be rotated through the different Public Services Maintenance Worker assignments periodically, both to meet the needs of the department and to provide job variety and skill enhancement to employees. In addition, probationary employees will typically be rotated through each assignment during their probationary period to ensure they have the skills and abilities to perform each type of assignment.
The Public Services Maintenance Worker I/II position requires a class B license and Paint and Sign Technician I/II does not require a Class B license. Upon the reclassification of the Paint and Sign Technician I/II, the incumbents will be required to obtain a Class B license. The following provisions will apply to the incumbents being reclassified that do not possess a Class B license:
The reclassified incumbents will be required to obtain a Class B license as soon as possible and no later than two (2) years from the date of reclassification.
The City will pay for the cost of the medical exam, training, and license fee associated with obtaining the license for these two incumbents.
Employees must demonstrate good faith efforts to obtain the Class B license within two (2) years. Good faith includes, but is not limited to:
Taking the written test, and continuing to retake if fail; Participating in any training offers;
Taking the medical examination in a timely manner and cooperating with any administrative follow-up required; Taking the driving test and retaking if fail.
If after demonstrating a good faith effort to obtain the Class B license, the incumbent is unable to qualify for the license within the two years, the incumbent will be demoted to Step 5 of Public Services Maintenance Worker I and will not be required to serve a new probationary period. The demotion is not considered disciplinary and is not subject to disciplinary or other appeals. If the failure to qualify for a Class B license is due to a reason that could be corrected (such as failure to pass a written test), the employee will continue to attempt to attain the Class B license and the City will continue to pay for such attempt, unless otherwise mutually agreed by the parties.
This specific provision only applies to the two incumbents who are reclassified from Paint and Sign Technician I/II to Public Services Maintenance Worker I/II in 2022. All newly hired employees must obtain their Class B license within the timeframes specified in the job description. It is acknowledged that a few employees may have previously been grandfathered into Public Services Maintenance Worker I/II without a Class B license and this Side Letter does not change any prior agreement.
Stormwater Maintenance Worker I/II. There are two Public Services Maintenance Worker I/II positions assigned to Water Resources performing duties primarily related to the maintenance of the stormwater system. A new classification of Stormwater Maintenance Worker I/II will be created at the same range as Public Services Maintenance Worker I/II. It is not anticipated to require a Class B license. The job description will reflect the stormwater maintenance duties; and some lower level wastewater duties that do not require certification. In addition, the job description may reflect that incumbents in the Stormwater classification may also be required to perform other public services maintenance worker duties that do not require a Class B license, although this is not expected to be a primary responsibility and only implemented due to unusual workload issues or emergencies. Similarly, the stormwater maintenance duties will be maintained in the Public Services Maintenance Worker I/II classification and incumbents may be asked to assist as needed due to workload or emergencies, although it is not anticipated to be a regular duty. This paragraph is to provide an understanding of the initial job description and requirements; nothing in this agreement precludes future changes to salary relationships or job duties in the future.
APPROVAL AND IMPLEMENTATION
This Side Letter shall be effective July 18, 2022 and shall continue in force and effect until no longer applicable to the implementation of this reorganization.
