Beth Brooks Mayor and Members of the Pomona City Council:
At a Councilmeetinga few weeksagoa commentwas madethat Pomonais notthe same Pomona it was in the 1960' s. He was right... it is not.
Inthe 1966's, myfamilyusedtowalkaroundDowntownPomona, visitingourfavoritejewelry and record stores. During that era you did not see people sleeping on the sidewalks surroundedbystolenshoppingcarts. Myparentsneverhadto worryaboutmyseeingthe private parts" of people walking down the street. Curing that decade all of our shopping needs could be met by businesses in Pomona.
In the 1960's, Pomona's City Managerandfamilywere involvedwith all things Pomona. City council members might have had their favorite constituents, but would have never publically excluded others from their representation.
Yes, Pomona is not the same as it was in the 1960's. This is unfortunate for all of us.

Pomona Mayor and Members of the Pomona City Council:
I was under the impression the members of the Pomona City Council were going to meet with housingprovidersto brainstormsolutionsfor the perceivedcrisisthe city's tenantsare experiencing.. What happened?
Byyourdefinition, housingprovidersarebusinessownersintheCityof Pomona. I haveyet to understandwhatmy businesslicensefee paysfor, yet I faithfullyremitthefundsevery year.
Pomona does not need to pass a Ment Stabilization Resolution or draft an Urgency Ordinance. What needs to happen is that landlords and tenants need to be allowed to enforce the rentalagreementsthat all consentingadultsapprovedand signed. Contractsshouldnot be allowed to be voided by an outside entity.
I respectfully request that you vote dowryany sort of regulation regarding residential rentals.
It is not up to you to decide what goes on between contractual parties..
Michael Simonds Mayor and Members of the Pomona City Council:.
I began an eviction in March and amufinally being granted legal possession of my property this week.
Mytenantsallowedfriendsto movein. Whenthe tenantsvacated, the friendsrefusedto follow suit. Because of this, I had to file a formal eviction.
My house was completely destroyed. Who is going to pay the $ 20, 610. 00 in damages these squatters left behind?
Therentalhousingindustrydoesnotneedanymoreprotectionsforthetenants. It is notup to PomonaCityCouncilmembersto interferewith free enterprise.
You all were electedto overseethe businessof the city. Howcan you possiblyexpect City Fall to take on additional responsibilities when there is a failure to maintain your own common areas?
I respectfullyrequestthatyoudonotpassa HousingResolutionor UrgencyOrdinance.
Sharon Willis, on dear Mayor and Members of the Pomona City Council:
You havenobusinessinterferingwiththerightsof propertyowners. Youhavefailedmiserably in making Pomona a vibrant, safe and beautiful city, as per your city stationery.
Vibrant? The streetsare lined with street vendors. Brickand mortarbusinessare leaving. li heard of two more this week. What are your plans for our future? The city needs a balance.
You have voted for more rental units... where are these residents going to shop? Safe? We need more police officers. My church has spent thousandsof dollars repairing damages caused by intruders. Look at Facebook. Need I say more? Beautiful? Have you driven down. Garey and Holt Avenues recently? TheCityis in urgentneedof yourattention. The rentalindustryis not. Pleasevote "ISO" regardinganyResolutionor UrgencyOrdinanceregardingrentalpropertyinPomona.
Pari Morse Mayor and Members of the Pomona City Council:
The time was right for me to consider, selling my rental housein Pomona, but I havebeen unableto do so due to restrictionsplaced by the Los Angeles Board of Supervisors. The tenantsand I approvedand agreed on terms when the rentalagreementwas signed. The government had no right to void the terms of this contrast.
Nor does the PomonaCity Councilhave the right to put restrictionson the propertyI have worked hard to own and maintain. I have accepted all the responsibility for paying the mortgage, insurance, gardener and property taxes. I have efficiently taken care of all repair requests. I do not need to be told hoveto be a good housing provider. urgeyouto votedownany Resolutionor UrgencyOrdinance. Theyare notneeded. The rental moratorium placed because of Covid- 19 has cost property owners thousands (perhaps millions) of dollars in lost revenue. This industry needs to stabilize itself.
Laura Alvarez Mayor and Members of the Pomona City Council:
I would like to see concreteevidencethat the proposedResolutionand UrgencyOrdinance documentsare goingto havepositiveresultsin the Cityof Pomona.
I haveyet to see one articleor editorialthat states that rent controlis good for a city. I have read that rent control actuallycausesa shortageof availableunits. Anyonewhoisinthis businessdeservesrespectandshouldbe allowedto makea profitfromthe servicesthatthey provide.
As a rental owner, I have a business license. Why were business owners not given a seat at the table before such an aggressive document was drafted? What happened to transparency?
Dawn O' Neill Mayor and Members of the Pomona City Council:

These tenants are months behind on their rent. I have already spent$ 3,750 in attorney's fees.
Howe is this right?
I no longer wish to support someone else's family. It is only fair that I am allowed to receive possession of my property in a timely manner.
It is importantthat you do notvotefor a HousingResolutionor UrgencyOrdinance.
Dennis Quedo Mayor and Members of the Pomona City Council.
You do not have the manpower or leadership to tape on any more responsibilities. I encourageyou to forgetany Resolutionsor OrdinancesregardingRent Stabilization.

Linda Hallman Mayor and Members of Pomona City Council:
It iswrongtotry andrestricthousingprovidersto pleasetenantsto obtaintheirvotes. If you wantto controlrentalunits, thenyou can payfor that controlby becomingan investor.
Please reverse the course of the thought of passing a Resolution or Urgency Ordinance regarding Rent Stabilization.

Ann Brand Mayor and Members of Pomona City Council:
Certainlyyourtime wouldbe betterspenttakingcareof the entirecity insteadof micro- managing property owners.
I haverentedmy homefor overten yearsand amveryhappywith my situation. My rent increases have been minimal and the property manager has been attentive.
I amwellawareof rulesalreadyin placefor residentialpropertyowners. If therearea few abusingthe system, thentheyshouldbe addressedindividually.
While driving aroundthe City, it is obvious you have more importantthingsto worry about then restricting an essential industry.
I encourage you to leave rental concerns to property managers.
Pleasevote "no" on any HousingResolutionor UrgencyOrdinance.
Greg Estel Mayor and Members of the Pomona City Council:
u
I was under the impression there was going to be dialog with housing providers before anythingwas broughtto the Pomona City Council regardingrent control. I would like to understand why this did not happen.
It is illogical for you to put restrictions on a certain industry in the city. If you are going to try and control housing providers, then you need to reach out to grocery stores, gas stations, restaurants and all businesses that serve the public.
There are many issues in the communitythat deserveyour time and attention. Stability in housing is not one of them.
Please discourage any further discussion on rent stabilization restrictions.
Natalie Ford- Brown Mayor and Members of the Pomona City Council:
Puttingrestrictionson housingprovidersis notthe answerto Pomona's housingcrisis.
Our quality of life is beingimpactedby the homelesspopulation. It would be appreciatedif you would concentrate efforts towards this issue instead of trying to micro- manage rental propertyowners. Myneighborsand I havebeennegativelyimpactedbythoseallowedto run amuck in our neighborhood park. Please put your efforts into supporting more police protection. We aretiredof beingscreamedat, our utilitiesusedwithoutpermissionand items stolen off our property. Your stealing control from property owners is not going to solve anything. I encourageyouto concentrateon moreimportantissuesthanhousingstabilization concerns. That industry can take care of itself.
Beth Brooks Mayor and Members of the Pomona City Council:
I was informed there would be dialog between the City and housing providers before anything concrete was addressed on the City Council level. It was extremely disappointing to hear this item was being presented without input from those of us who have state and local licenses to be in the property management business. Your interference is not needed or appreciated.
There are already rules in place that govern residential rental properties. Additional restrictions are not needed. Are you going to cap our business license fees, water fees, electric and gas charges? What about food and gasoline? I encourage you to take care of the City's business and leave housing to those who have chosen that career path.
Dylan Querio Mayor and Members of the Pomona City Council:
I amagainstany Resolutionsor UrgencyOrdinanceregardinghousinginthe Cityof Pomona.
Between Section-8 housing units and the many rentals being offered below market level, therearemanyrentalsthataresubsidizeddueto a normalcourseof business. Pleasedo not try and fix a systemthat is perceivedto be brokenby only a few out-spokenactivists. It has been proven that rent control does not work. Housing providers offer a valuable service.
Tenants who do not honor the contracts they signed upon possession need to own up to the consequences. No owner ever wants to start an eviction. They are expensive and time- consuming. Ownersshould, however, be allowedthis courseof actionwhen needed. The rental business is hard enough without government interference. Please vote " no" on Item
22. Richard Alvarez Mayor and Members of the Pomona City Council:
Howcanyou possiblyconsidertaking on somethingof the magnitudeof RentalStabilization when you are failing miserably with the tasks you have already been given? It is important that you get your house in order before you think about controlling others. In California, tenants have more rights than the owners. The amount of risk and responsibility an owner has compared to a tenant's is vastly disproportionate. Government regulations continue to increase the rights of tenants and take away rights from property owners to the point that ownersare gettingoutof the business. Ihave not heardof ownershavinginputwiththis Resolutionor UrgencyOrdinance. Whatitsthe reasoningfor makingthispubliconlydays before the City Council Meeting? Why was this kept sucha secret?Whywasthe community not askedfor their involvement? Pleasevote "no" on any itemsregardingrentstabilization. It will be detrimental to our city.

Scott Chamberlain, San Gabriel Valley Consortium ( seg: attached letter) San Gabriel Tenant Alliance re ITEM 22-- , July 18, 2022— Letter of support for rent stabilization and PUSH recommendations
Lear Pomona City Council,
San Gabriel 'ValleyTenants` Alliance, foundedin 2020 to build tenanteducationand power intheSanGabrielValley, submitsthisletterofpubliccommenttoexpressurgencyinpassing rent stabilization and stronger tenant protections. Pomona is showing great leadership in the San Gabriel Valley with this measure.
We also support Pomona United for Stable Housing ( PUSH)" s recommendations:
A rent board with tenant representation with the power and the resources necessary to set maximumrentadjustments, investigatecomplaints, hearpetitionsfromtenants, enforce the provisionsof the ordinanceand state housinglaws, and hold landlordsaccountablefor violations of those laws and violations,
A mechanism for tenants to petition for rent decreases ( the current proposal only has a mechanism for landlords in petition for rent increases), Inclusion of "trigger" language that would go into effect upon the reform or repeal of the Costa-Harkins Rental Housing Act to allow for the protection of the maximum number of tenants possible,
The appropriationof city funding for legal defense for tenants facing eviction proceedings in court,
Properpromotionandpublicityof thetenantprotectionsin all appropriatelanguages„ and that
The cost of administering the rent stabilization and just cause eviction protection not be disproportionately shouldered by the tenant community.
As noted in our previous letter, The 6th Cycle Housing Element is indeed the best documentationofwhyNOWisthetimetoprotecttenants, notthreeyearsfromnow. Tenants cannotwait! We knowfrom the data in the housingelementthat those beingpushedto the street are seniors, families, and tenants already burdened with housing costs.
The 6thCycle HousingElementlays out the best casefor the city to enact rent stabilization and just cause ordinances immediately. Pomona United for Stable Housing and SGV Tenants Alliance have a working relationship, and we have heard first hand of legal rent increases that jeopardize housing and stability for tenants. The legal, increase are still too high! That instabilityhas implicationsfor all of the communitysuch as schooldistrict enrollment; employeeretention; abilityto participatein democracy; moretents and humans on the streets of Pomona. Those implications cost the community and only add to the urgencyof immediateactionnovofor Pomonatenantsand residents.
Thank you for considering our comments. We strongly urge Pomona.. City Council to act to immediatelytothoughtfullyenactlocalrentstabilizationandjustcauseprotections.

ReginaWang-Goodevening. MynameisReginaWang. AsabusinesspersoninPomona, whoalsolivesin Pomona, I supporta moratoriumonwarehouses, asdescribedin Urgency Ordinance Dumber 4319. l don't believe that warehouses represent the best and highest use for Pomona. Warehouses and Trucking Hubs coming into Pomona without proper regulationswill adverselyaffectmy business, andthe health, safetyandquality, of life of myself, my neighbors, and those with whom I work. Please approve this urgency ordinance tonight. Thank you.
Lisa ngdahl- Good evening. My nameis Lisa Engdahl, I'm a Pomonaresidentin District 2 and President of Clean& Green Pomona.
accordingtotheairdistrict (AQMD), thewarehousegoodsmovementindustryisthebiggest polluter of any industry in our region. A warehouse moratorium is essential to give our city time to set sensibleregulationsto protectthe health, safety and quality of life of Pomona residents. There is nothing more important than people.
On May 2nd Clean&Green Pomona approached the city council about the need for a. warehousemoratorium. We presentedthe researchwe had done over severalweeks. On tune
61h
Clean& Green, ICON ( the Inland Community Organizing Network), and Cone ibn de Padres Por la Educaci6n together urged you to enact a moratorium on warehouses and trucking hubs. The excellent staff report and presentation by Mr. Khan and Ms. Gutierrez supported our proposed moratorium. Thank you for voting that evening to move this process forward.
I urge you to approvea warehousemoratoriumin Pomonaas proposedby the city staff in UrgencyOrdinanceDumber4319. Yourdecisiontonightwillhaveamajorimpactonfuture generations in Pomona.
David Holmes- Goodevening. My name is David Holmes, and I am the President of Commercial Door Company. I have been a Pomona businessman for more than 25 years. I am a board member of Clean& Green Pomona. I support a warehouse moratoriumin the City of Pomona, as proposedin UrgencyOrdinanceNumber 4319.. During my years in Pomona, the city has improved. To continue in a positive direction, the city needs to plan well for the future. We need proper regulations in place for the buildingand operationof warehousesand truckingfacilities..
The lackof properstandardsforthis, industryadverselyimpactsbusinesseslikemine, and is harmful for residents who are entitled to a good quality of life.
As you know, the logistics industry is not a major job creator, and has several undesirable impacts. The numerous Leavy diesel trucks that go with warehousing damage our roads, pollute the air„ and increase traffic and accidents. It would be unwise for Pomona to continue to add more warehouses without first establishing thoughtful regulations, particularly restricting their size and hours of operation.
Iurge you to enact a warehouse moratorium for the benefit of both businesses and residents.
Sincerely, David 0. Holmes, Commercial Door Company Inc.

Mark McReynolds Greetings, I am a new residentof Pomona, on Willow St, and I am in favor of a moratorium on warehouses. I recently went to assist a friend pick something up aroundSouthArchibaldbelowthe OntarioAirport, I was amazed, dismayedreally, at all the monstrouswarehousesand the numberof big trucks on the roads. I waited alongsidethe roadfor myfriendandnoted, truckaftertruckrumblingby. I felt sorryfor the folkson that street. At least someone thought ahead and made some of that area's roads really wide - we don't havethat luxury here. We needthe moratoriumto think long and hard aboutthe very best use of the undeveloped land we have in Pomona, That may is some warehouses,, but after the moratorium, we'll know what we are doing.
Thank you for your consideration.

Please vote yes to keep on the positivepath of cleaning our city.
HughWireMynameisHughWireandIamamemberofICONandattendFirstPresbyterian Church of Pomona. I support a moratorium on warehouses in Pomona. There is something better for Pomona. Warehouses are not good neighbors, generating air pollution and uncompensateddeteriorationof roadways, and fail to providejobs with livingwages. There are better uses for Pomona's availableland. The city's zoningcode has not been updated since 1949. RonaldCobas MynameisRonCobas, I ama 35yearresidentofPomonaandVPof Clean Green Pomona. I am writing in support of a moratoriumon warehousesin the city of Pomona. This moratorium provides the much needed time to complete a thorough study of this issue and consider the views of all the stakeholders including those who will become Pomona residents in the future. Health and quality of life in Pomona are just two of the issues at stake. The decisions that this council makes will have long lasting affects.
Whilecurrent memberswill eventuallydepart, warehousesare long term. Warehouses, like few other industries, present a daily influx of conditionsthat affect the lives of Pomona residents. Truck traffic, air quality and safety are just a few. 1)Warehouisesprovide only short-term revenue and employment. Even if contractorsare requiredto hire local labor, it is onlytemporary. Also, tax revenueis not significant. It's also a short term benefit.
2) Warehouses bring heavy( diesel ) truck traffic on a daily basis. These emissions cause cancer, asthma, and other air quality related issues. Pomonais alreadycloseto the top in asthma( as reportedby LACountyHealthDept.) relatedconditions, no onedisputesthis. 3) Warehouses and zoning-- this city has not updated zoning codes since 19 Zoning codes are complex. A moratoriumwill allowthe time to considerotheruses of the a"adAs Clean & Green has reported, Pomona lacks 'green' space. We are at 1.3 acres per 1,000 residents compared to 5 acres in Los Angeles. There is also a housing crisis. A warehouse will never become a space for a home.
I ask the city to supportthe moratorium. Not so muchto restrictthese concretemonstersor amend their existence, but the time needed to consider the beautiful and healthy spaces they can become.
Amy Donner DearPomonaCityCouncil, MynameisAmyDonner. Iama Pomonaresident for 9 years and member of Pomona Presbyterian Church. I write in support of a moratorium on warehouses in the city of Pomona. There are

Paul Deibel Dear City Council Members:
Mynameis PaulDeibelandI ama memberof theInlandCommunitiesOrganizingNetwork ICON). I am also a practicing urban planning consultant and member of the American Institute of Certified Planners, I urge you to adopt a moratorium on warehouses in Pomona.
Large warehouse uses do not contribute to the economic base of the community since they do not provide stable well- paying jobs; and soon they will provide scarcely any employment atalloncetheyarefullyautomatedwithrobots. Therearemuchbetterusesthatwillenhance the economic growth of the community if we plan more strategically. A moratorium on warehousing uses at this time will allow for such thoughtful planning, particularly in, conjunctionwith an updatingof the city's zoningcodewhich I understandis in the works.
Let's builda city that benefitsits residentsandthat protectsthe environmentratherthan accommodatingtheinterestsoflandspeculatorsandofcorporationsbasedelsewhere.

SUBJECT, Rent Control ( Oppose)
Dear Mayor Sandoval and city council,
The LosAngelesCountyBusinessFederation, alsoknownas BizFedi, is a grassrootsallianceof morethan 220 business organizations that represent 450,000 employers with over 5 million employees in LA County. Since 2018, BizFedis on a mission to lift one million people out of poverty in the next decade.
Housingproductionand: housingaffordabilityis anareathatourmembersbelievewill lift peoplefrom homelessness and prevent poverty throughout LA County.
Price controls do not work and are counterproductive. We learned that the City of Pomona is consider implementing: rentcontrolthroughanurgencyordinance. Weurgethecityto opposeitem22and considerationof policiesthat are provento makehousingmoreunaffordable, harderto find andof lesser quality.
Thecityis alreadycoveredbyAB1482, a comprehensivestatewidelawthatestablishesrentincrease limitations and institutes " for cause" eviction protections statewide. This robust law balances price and eviction regulations while striving to maintain market dynamics to incentivize housing production and upkeep.
SouthernCaliforniais facinga housingcrisisandwe needa variety of housingtypes in citiesthroughout the region. Increasinghousingsupplyis the solutionthat can bestaddressandremedythe long-term needsfor the Cityof Pomonaandthe surroundingcommunities. BizFedhasworkedactivelyto spur housingproductionandpromoteordinanceswhichtakeasensibleandcarefulapproachto housing issues.
A severe rent control ordinance coupled with tighter eviction controls are counterproductive housing policies. Theywill not producea singlenew unit andwill, makethe Citymoreexpensiveoverthe long term. It will hinderupgradesand rehabilitationof olderhousingstock, whileevictioncontrolsmakeit unreasonably difficult to remove disruptive renters within the community.
The unintended consequence of price controls is well documented. It will not only affect the livelihoods of the thousands of individuals that work, supply and operate rental housing in the community, it will also have a disproportionate impact on the economically disadvantaged.
Werequestthat you reject item 22 andwork with rental housingprovidersin the processto develop sensible alternatives that can help address the City' s concern.
Welookforwardto workingwith the Cityto addressthis issue. If you haveanyquestions, pleasecontact Chris Wilson atchi r, s-,wi son@bJzf' ed,, or 9

RE: Public Comment for Item # 28 (45-Day Warehouse Moratorium) July 18, 2022PomonaCity Council Agenda
Mayor F± Member of the Pomona City Council:
Weare writing to expressconcernaboutthe proposed45-daymoratoriumon warehouse and related uses ( item # 28 on the July 18, 2022 City Council Agenda). We ask that the moratorium and its analysis be modified to address the following issues:
1 The draft urgency ordinance No 4319 is written too broadly.
Asone of the council memberssaid during the June 6, 2022City Council meeting, " the issue is not so much the buildings, as it is the trucks".
This proposed ordinance, including its definition of " warehouse", is too broad and will have the unintended consequence of the termination or delayof industrialand/or manufacturingprojectsthat generatelow truck traffic and create substantial jobs and local revenues for Pomona' s residents. On page 3 of the July 18, 2022staff report for this item, staff indicates: " All other industrial uses, such as manufacturing, are exempt from this moratorium"; however, the definition of " warehouse" in the moratorium restricts " any use for the conduct, businessor management of warehousing, storing,..., handling, keeping inventory and or distribution activities for any product or component...". This broad definition has the unintended effect of halting all industrial projects including low- truck- generating industrial uses such as manufacturers that fall under this definition. Evenmanufacturing usesrequire keeping inventory and having some distribution activities to operate. 2) Contrary to the staff report, the fiscal-impact on the City of the moratorium is significant. The staff report indicates " the adoption of a moratorium will not, result in any direct financial impact." The moratorium, as written, will result in developments in the City of Pomona not moving forward or, at best, being delayed. This will result in lost or deferred revenues to the City of Pomona which should be
considered before entering into the moratorium. For example, the City has been provided a third- party consultant' s evaluation of the proposed Veterans ' Park industrial development projecting the project will create 1,260,000 per year of revenues to the City of Pomona, Pomona Unified SchoolDistrict EtCommunity Colleges, LasAngelesCounty and other local public agencies. . Additionally, the consultant' s report projects one- time fiscal revenues of $ 13,200,000 to the City of Pomona to be used for improvement of Pomona ' Parks. Employment from that single project is projected to be 296 permanent full- time jobs and 112 one- time construction jobs. These job generation numbers are more than four times the ratio cited by planning staff at the June 6, 2022meeting for large logistics buildings ( which this project is not). 3) CitVhasan obligation to honor its obligations under the PSAfor Veterans Park. On October 7, 2019, the Pomona City Council approved a resolutionto conveythe VeteransParkpropertyto SeventhStreet Development under the terms of a Purchase and Sale ,Agreement ( PSA) attached to the resolution. This PSA includes a site plan for four small industrial buildings ( Exhibit ! B-1 of the PSA,) which is substantially the sameplan that was recently submitted to the City for CUPApproval.
The City hasbeen delayed in its conveyanceof the property becauseof delays in receiving a required approval from the USDepartment of the Interior. Seventh Street has worked in good faith for over 2. 5 years on this project spending over $ 100,000 and submitting a full CUPapproval package this month to the City. The PSA requires the City to " promptly cooperate... in all reasonable respects in obtaining the Approvals" for the project. ( See Section 7. 2 and 7. 4 of the PSA,). This moratorium conflicts with that duty.
Thecity alreadyhasa rigorousapprovalprocessfor anybuildingover20,000 square feet. That process requires a CUP with public hearings, site plan review, CEQA analysis, and conformance with California Green Code. We understand the need to restrict truck intensive uses in Pomona, especially when they are near residences and other sensitive receptors like schools. This can be achieved through the CUPand public hearing process that Pomona already has in place.
We appreciate your consideration of these points asyou makeyour decision on whether and how to move forward with the moratorium on warehouse uses in Pomona.
Sincerely
