CITY OF POMONA

COUNCIL REPORT
August 15, 2022
To: Honorable Mayor and Members of the City Council
From: James Makshanoff, City Manager
Submitted By: Rene Guerrero, Public Works Director
SUBJECT: RATIFY AN EMERGENCY AGREEMENT WITH BRIGHTVIEW LANDSCAPE SERVICES, INC. FOR FUEL MODIFICATION RECOMMENDATION: It is recommended that the City Council take the following actions:

Ratify an emergency professional services agreement with Brightview Landscape Services, Inc. in an annual amount not to exceed $159,504 for a one-year term.

EXECUTIVE SUMMARY: Approval of the above-recommended actions will allow the City to enter into a contract with Brightview Landscape Services, Inc. (Brightview) to address fuel modification and vegetation management needs throughout the open spaces locations of the Phillips Ranch area.

FISCAL IMPACT: Although there is sufficient appropriation in the FY 2022-23 Weed Abatement line item in the Phillips Ranch Assessment District (256-4073-52920-00000), the Assessment District is forecasted to be insolvent by the end of FY 2022-23. The FY 2022-23 estimated beginning fund balance is $91k, while estimated FY 2022-23 revenues and appropriations are $941k and $1.4M respectively. This will bring the estimated ending FY 2022-23 fund balance to ($512k). To address this matter, Public Works staff will present a mitigation plan with the 1st Quarter Budget review at a council meeting in November 2022.

ENVIRONMENTAL IMPACT: Award of this contract will assist the City in addressing fuel modification and vegetation management needs throughout the Phillips Ranch open space areas to decrease the risk of fire throughout the District, while enhancing health and safety.

DISCUSSION: On May 24, 2022, per City Code 2-998 the Purchasing Officer authorized the emergency procurement of fire abatement services for the Phillips Ranch area of Pomona due to a present, immediate and existing emergency and the need for immediate preservation of health, safety and welfare of the citizens of Pomona. The agreement was executed by the City Manager on June 6, 2022 and the action now needs to be ratified by the City.

The Public Works Department approached Brightview to obtain services and negotiated a one year agreement that began on June 13, 2022 and will expire on June 12, 2023. It is the intention of the City to release these services back out to bid by January 2023 to obtain a longer contracted services for fuel modification.

Fuel modification will be conducted at 32 open space locations throughout Phillips Ranch. Each location will receive fuel modification once during the term of the contract.
