CITY OF POMONA

COUNCIL REPORT
October 17, 2022
To: Honorable Mayor and Members of the City Council
From: James Makshanoff, City Manager
Submitted By: Chris Diggs, Water Resources Director
SUBJECT: APPROVE FIRST AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT WITH DUDEK, IN THE AMOUNT OF $36,250 FOR THE “WATER RESOURCES BUILDING” PROJECT RECOMMENDATION:

It is recommended that the City Council take the following actions:

Approve the first amendment to professional services agreement with Dudek, in the amount of $36,250 (for a contract total of $233,370) for the “Water Resources Building” project; and, Authorize the City Manager, or designee, to sign the attached agreements.

EXECUTIVE SUMMARY:

Approval of this amendment with Dudek is for the design of a soil vapor barrier and the associated plans of the Water Resources Building. The proposed soil vapor barrier is to be constructed beneath the building due to the volatile organic compounds (VOCs) in the soil within the vicinity of the proposed building. The proposed soil vapor barrier is an additional mitigation measure intended to ensure the health and safety of city staff and visitors.

FISCAL IMPACT:

The total fiscal impact for the recommended action is $36,250. The original agreement with Dudek was approved for $197,120, and by amending the agreement and adding $36,250, the new total amount will be $233,370. Since this exceeds the PCC threshold of $200,000 for CIP professional services contracts, approval of the City Council is required. Funds are available in the approved Fiscal Year 2022-23 Capital Improvement Program (CIP) “Water Resources Building”, Project No. 575-8125-XXXXX-93135. The funds available for this project are detailed in Table 1, on the following page:

Remaining balance available for: construction, construction management, contingencies, and inspection costs, etc. $3,065,870
PREVIOUS RELATED ACTION:

On April 6, 2020, City Council approved an agreement with Dudek in the amount of $197,120 for the preparation of the California Environmental Quality Act (CEQA) analysis for the project.

DISCUSSION:

Dudek has been contracted to perform a CEQA study at the Water Resources Administration and Operations Facility and the City Stable. Upon completion of the study it was determined that a soil vapor barrier will be needed to address VOC in the soil. Approval of this amendment will increase the contract to allow Dudek to design the soil vapor barrier for the project.

City Code 2-1005 (4) requires City Council approval of the amendment and delegation of authority when an amendment exceeds the threshold of the Public Contracting Code 22032 (b), which is currently $200,000.

City staff has been working with architects at Sillman since September 2021 for the design of the new Water Resources building. Part of that process has involved working to ensure the building is a safe place to work. This is especially important for this project as there are VOCs in the vicinity of where the building is being constructed.
