CITY OF POMONA

COUNCIL REPORT
October 17, 2022
To: Honorable Mayor and Members of the City Council
From: James Makshanoff, City Manager
Submitted By: Benita DeFrank, Neighborhood Services Director SUBJECT: AWARD A CONTRACT TO R DEPENDABLE CONSTRUCTION FOR TENANT IMPROVEMENTS TO 2040 N. GAREY AVENUE, POMONA, CA RECOMMENDATION:

It is recommended that the City Council take the following actions:

Approve an award of a contract to R Dependable Construction Inc. for the tenant improvements for 2040 N. Garey Avenue, Pomona, CA in the amount of $209,972; and, Authorize the City Manager to execute the contract and any subsequent change orders on behalf of the City, upon City Attorney approval.

EXECUTIVE SUMMARY:

The property, located at 2040 N. Garey Avenue, will serve as an Emergency Day Shelter and Resource Center for families with high barriers to housing with linkages to permanent housing interventions and other supportive services. Before the property may be used as emergency shelter, renovations are necessary.

FISCAL IMPACT:

Funding for the rehabilitation of this property is currently appropriated in the FY 2022-23 City Operating Budget in Emergency Solutions Grant CARES Act (ESG-CV) for $209,972 (193-1791-52584-63224).

PUBLIC NOTICING REQUIREMENTS:

In accordance with Section 2-1003 of the City’s Purchasing Ordinance, a public notice inviting bids was posted on the City’s website on June 2, 2022.

PREVIOUS COUNCIL RELATED ACTION:

On September 20, 2021, the City Council amended the Consolidated Plan, the FY 2021-22 Annual Action Plan, and the FY 2021-22 City Operating Budget by allocating $1,000,000 in ESG-CV funds in Emergency Shelter – Family Resource Center for tenant improvements and program expenditures.

DISCUSSION:

Approval of this award will assist the City of Pomona (City) in the rehabilitation stages of converting the rear portion of the 2040 North Garey Avenue into a Family Day Shelter and Resource Center (Center) for Pomona families. The purpose of the Center is to provide Pomona-based families who are either homeless or at-risk of homelessness secure rental assistance and other essential resources from local onsite family service providers. The Center shall provide a centralized and coordinated point of services with the ultimate goal of diverting homeless families away from the crisis housing system and assisting them with securing or maintaining permanent housing as rapidly as possible.

Before families may be served in the Center, renovations are necessary. The repairs and improvements will address health and safety concerns, bring the facility up to the Universal Building Code standards, and address deferred maintenance. Related work includes installing GFCIs and smoke detectors, new water heaters, texturing and re-painting, new flooring, new lighting fixtures, bathroom upgrades and extermination.

The project is subject to the requirements of the Davis-Bacon Act (40 U.S.C. 3141 et. seq.) as amended, which requires that federally assisted construction projects over $2,000 must pay workers on-site no less than the locally prevailing wages and benefits paid on similar projects.

To complete this renovation, in accordance with Section 2-1003 – Formal Procedure of the City’s Purchasing Ordinance, Request for Proposal (RFP) No. 2022-38 was released on Planet Bids on June 2, 2022. The solicitation noticed 120 potential bidders of this opportunity, of which 33 bidders downloaded the RFP, and five (5) bidders submitted a bid.

The bid submitted by R Dependable Construction of $209,972 was determined by staff to be a price-reasonable bid. A 10% contingency was added to the bid price to cover unexpected costs that may arise during the rehabilitation. The total contract price is $230,969. It is anticipated that it will take 90 calendar days to complete the rehabilitation work.

COUNCIL PRIORITIES & GOALS:

This item supports 2022 City Council Priority #3 – Increased Opportunity and Housing Stability and Goal K – Reduce the unsheltered homeless population by 10% annually and take actions to mitigate the impacts of homelessness in the community.
