RESOLUTION NO. 2022-204
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, APPROVING TRACT MAP TM NO. 82889 FOR THE PROPERTY LOCATED AT 2115 S. GAREY AVENUE, ASSESSOR PARCEL NUMBERS 8344-033-046 to -050 WHEREAS, on August 25, 2021, the Planning Commission adopted Resolution No. 21-023 approving Tentative Tract Map TRACTMAP 13327-2020, TM No. 82889, for a residential subdivision consisting of 156 residential units at 2115 S. Garey Avenue, APN 8344-033-046 to -050; and WHEREAS, pursuant to the Guidelines for Implementation of the Environmental Quality Act (CEQA), the proposed project meets the criteria for an exemption under Section 15183 (Projects Consistent with a Community Plan, General Plan, or Zoning) of CEQA. The proposed project (i) is consistent with the City's General Plan; (ii) will not result in any peculiar impacts that were not identified as a significant impact under the 2014 General Plan Update EIR (GPU EIR); (iii) the project site has no value as habitat for endangered, rare or threatened species, (iv) will not have any significant effects upon the environment that were not identified as significant in the GPU EIR, (v) will not result in a potentially significant offsite impact or cumulative impact not discussed in the GPU EIR, (vi) will not result in a more severe impact due to substantial new information that was not known at the time the GPU EIR; and (vii) the site can adequately be served by all required utilities and public services. Therefore, no further action is required, and a Notice of Determination (Section 15094) was filed indicating that the project is eligible for an exemption under CEQA Guidelines Section 15183; and WHEREAS, Melia Homes, initial applicant and developer, has submitted Tract Map TM No. 82889 for the property located at 2115 S. Garey Avenue, Pomona, CA, to the Public Works Department-Engineering Division for review and approval; and WHEREAS, all conditions of approval related to Tentative Tract Map TRACTMAP 13327-2020 and TM No. 82889 have been met.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pomona as follows:
SECTION 1. The foregoing recitals are true and correct.
SECTION 2. The City Council hereby finds, based on the evidence submitted, that the Tract Map TM No. 82889 for property located at 2115 S. Garey Avenue is hereby approved, as depicted in EXHIBIT “A” of this Resolution.
SECTION 3. The City Council hereby authorizes the City Engineer to sign the Tract Map TM No. 82889 on behalf of the City.
SECTION 4. The City Clerk shall attest and certify to the passage and adoption of this Resolution, and it shall become effective immediately upon its approval.
