RESOLUTION NO. 2022-213
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, AMENDING the FY 2022-23 CAPITAL IMPROVEMENT PROGRAM (CIP) BUDGET BY APPROPRIATING $1,660,000 OF refuse fund reserves to THE “CITY LOT REMEDIATION,” PROJECT NO. 418-2590-XXXXX-71021 WHEREAS, the City Council is prescribed the authority the by Charter of the City of Pomona to adopt Capital Improvement Program (CIP) budgets; and WHEREAS, the project “City Lot Remediation,” Project No. 418-2590-XXXXX-71021 is included in the adopted FY 2022-23 CIP budget; and WHEREAS, the appropriation funding is necessary to cover the costs for EnSafe, Inc. to continue with mandated site cleanup as per the Department of Toxic Substance Control (DTSC) approved Remedial Action Workplan (RAW); and WHEREAS, the additional funding is also needed for payment of oversight by DTSC as well as the additional City and legal staff efforts which will be required as a result.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pomona as follows:
SECTION 1. That the City Council hereby amends the FY 2022-23 CIP budget by appropriating $1,660,000 from the Refuse Fund Reserves to the “City Lot Remediation,” Project No. 418-2590-XXXXX-71021 (418-2590-66196-71021, 582-2590-89922-71021 and 418-2590-80722-71021), leaving the project fully funded.
SECTION 2. That the City Clerk shall attest and certify to the passage and adoption of this resolution and it shall become effective immediately upon its approval.
