RESOLUTION NO. 2023-04
A Resolution OF THE CITY COUNCIL OF THE CITY OF POMONA, california, ESTABLISHING A PREFERENTIAL PARKING DISTRICT ON AMERICAN AVENUE BETWEEN MILLS AVENUE AND COLLEGE AVENUE, AND FINDING OF EXTREME HARDSHIP AND WAIVER OF PERMIT FEE WHEREAS, American Avenue, between Mills Avenue and College Avenue, is a residential street that runs east-west, and the centerline of the street is also the city boundary between Pomona (south side) and Claremont (north side); and WHEREAS, Claremont’s parking restriction prohibiting overnight on-street parking on the north side of American Avenue causes Claremont residents to park on the south side of American Avenue for convenience or to avoid a potential citation; and WHEREAS, this additional parking of vehicles on the south side of American Avenue, between Mills Avenue and College Avenue, by Claremont residents living on the north side is causing extreme hardship among the residents of Pomona and negatively impacting their quality of life; and WHEREAS, the additional vehicles parked on American Avenue between Mills Avenue and College Avenue have resulted in increased litter, incomplete street sweeping, and incomplete trash pickup services; and WHEREAS, pursuant to City Code Section 58-239, the prerequisites for the establishment of a preferential parking district are as follows: 1) residents in the area shall provide a petition signed by residents living in at least 75 percent of adjacent dwelling units; or 2) City Council, on its own motion, after a duly noticed public hearing, may commence the consideration of a preferential parking district; and WHEREAS, the City mailed notices to the affected residents in advance of the Public Hearing as required by Pomona Municipal Code Section 58-239; and WHEREAS, to avoid an undue burden and financial hardship on residents within the Preferential Parking District, the City Council has authority pursuant to City Code Section 2-4 to waive the permit fees.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pomona as follows:

SECTION 1. The City Council hereby establishes the Preferential Parking District on American Avenue between Mills Avenue and College Avenue.

SECTION 2. Because the City Council has initiated the formation of the District, which then imposes a permit requirement for on-street parking, along with permit fees, the City Council hereby makes a finding of extreme hardship and waives the permit fee for this Neighborhood Preferential Parking District.

SECTION 3. The City Clerk shall attest and certify to the passage and adoption of this Resolution, and it shall become effective immediately upon its approval.

PASSED, APPROVED AND ADOPTED this 23rd day of January, 2023.
