CITY OF POMONA

COUNCIL REPORT
January 23, 2023
To: Honorable Mayor and Members of the City Council
From: James Makshanoff, City Manager
Submitted By: Rene Guerrero, Public Works Director
SUBJECT: PUBLIC HEARING AND ADOPTION OF A RESOLUTION TO ESTABLISH A PREFERENTIAL PARKING DISTRICT ON AMERICAN AVENUE RECOMMENDATION:

It is recommended that the City Council adopt the following resolution:

Open the public hearing regarding the establishment of a preferential parking district on American Avenue, after receiving comments and testimony, close the public hearing; and Adopt the following resolution:

RESOLUTION NO. 2023-04 – A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, ESTABLISHING A PREFERENTIAL PARKING DISTRICT ON AMERICAN AVENUE BETWEEN MILLS AVENUE AND COLLEGE AVENUE, AND FINDING OF EXTREME HARDSHIP AND WAIVER OF PERMIT FEE EXECUTIVE SUMMARY:

Adoption of the Resolution (Attachment No. 1) to establish a preferential parking district on American Avenue between Mills Avenue and College Avenue will result in improved quality of life for the neighborhood residents that are negatively impacted by overnight parking from the neighboring city. Parking by residents of the neighboring city has resulted in an increase of trash, incomplete street sweeping services, and incomplete trash pickup services. These issues should be rectified with the creation of the overnight preferential parking district.

FISCAL IMPACT:

All costs associated with the new sign fabrication and installation is estimated to be $1,000. These costs will be paid from the FY 22-23 Operating Budget with State Gas Tax (208-2562-52750-00000) and Measure R (128-2562-52530-00000) Funds. It is expected that Parking Enforcement revenues will see a slight increase, especially upon initial enforcement of the parking restrictions.

PUBLIC NOTICING REQUIREMENTS:

City staff mailed notices on January 11, 2023 (Attachment No. 2). Notices were mailed to the owners and/or occupants of properties within the proposed parking district, as indicated in the map on Exhibit A to the Resolution. In addition, notice was posted in City Hall, near the doors of the City Council Chamber and the Chuck Bader Conference Room, as well as on the City’s website.

PREVIOUS RELATED ACTION: None.

DISCUSSION:

American Avenue, between Mills Avenue and College Avenue, is a residential street that runs east-west. The centerline of the street is also the city boundary between Pomona (south side) and Claremont (north side). The parking concerns have been on-going due to Claremont’s parking restriction the prohibits overnight on-street parking. Said restriction causes Claremont residents on the north side of the street to park on the south side of American Avenue where there is currently no parking restriction. Many Claremont residents often park their vehicles on the south side of the street either for convenience or to avoid a potential citation. As such, the parked vehicles on the south side are causing hardship for the Pomona residents on American Avenue, impacting their quality of life. The parked vehicles also resulted in increased littering, incomplete street sweeping services, and incomplete trash pickup services.

Per Pomona Municipal Code Section 58-239, the prerequisites for the establishment of a preferential parking district are as follows: 1) residents in the area shall provide a petition signed by residents living in at least 75 percent of adjacent dwelling units; or 2) City Council, on its own motion, after a duly noticed public hearing, may commence the consideration of a preferential parking district. If the City establishes the District, then only vehicles owned by Pomona residents with on-street parking permits may park in the District. City staff anticipates that the City will receive a slight increase in parking citation revenue after the restricted parking signage is posted and enforced.

City Staff has received a petition (at least 75%) signed by Pomona residents on american Avenue, and recommends the establishment and implementation of a preferential parking district on American Avenue (between Mills Avenue and College Avenue).

Staff also recommends a finding of extreme hardship and waiving the permit fee. Per Pomona Municipal Code Section 58-239(k), the applicant shall pay a fee which shall cover the cost of administering the preferential parking program. Pomona Municipal Code Section 2-4 allows for waiver of application fees by the City Council if evidence presented to the City Council is sufficient to support that the payment of such fee would pose an extreme hardship on the applicant, and that waiving the fee would be in the best interest of the public in order to permit the applicant to proceed in the processing of the application.
