CITY OF POMONA

COUNCIL REPORT
February 6, 2023
To: Honorable Mayor and Members of the City Council
From: James Makshanoff, City Manager
Submitted By: Chris Diggs, Water Resources Director
SUBJECT: APPROVE FIRST AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT WITH GRIFFIN STRUCTURES, INC. FOR THE “WATER RESOURCES BUILDING” PROJECT RECOMMENDATION:

It is recommended that the City Council take the following actions:

Approve the first amendment to the professional services agreement with Griffin Structures, Inc. (Griffin) for the “Water Resources Building” project; and, Authorize the City Manager, or designee, to execute the agreement amendment with Griffin for professional services, contingent upon City Attorney review.

EXECUTIVE SUMMARY:

Amend professional services agreement with Griffin to include funding for additional special inspection services for the Water Resources Building construction project.

FISCAL IMPACT:

The total fiscal impact for the recommended action is $210,332. The original agreement with Griffin was approved for $340,500, and by amending the agreement and adding $210,332, the new total amount will be $550,832. Funds are available in the approved Fiscal Year 2022-23 Capital Improvement Program (CIP) Budget for “Water Resources Building”, Project No. 575-8125-XXXXX-93135. The funds available for this project are detailed in Table 1:

Griffin First Amendment
($210,332)
Remaining balance available for: construction, construction management, contingencies, and inspection costs, etc. $2,992,209
PREVIOUS RELATED ACTION:

On September 17, 2018, City Council approved a professional services agreement with Griffin to perform construction management services.

DISCUSSION:

On September 17, 2018, City Council approved a contract with Griffin to perform oversight assistance during the design and construction of the Water Resources building. This effort included design review, cost estimating, inspections, payment verification and review.

As construction on the buildings has now started, there is now the need for special inspection for geotechnical and materials testing. This special inspections and testing includes concrete testing, steel rebar inspection, and grading compaction testing, which will all last throughout the construction phase. As Griffin is performing other inspections and will be on-site regularly throughout construction, staff requested a proposal to perform said special inspection services. At this juncture staff is seeking approval of a contract amendment to include the additional necessary special inspection services. City Code 2-1003(1) (l) requires City Council approval for contract increases that exceed twenty-five percent of the original CIP professional services contracts. Upon completion of the agreement amendment, staff will seek approval as to form for the City Attorney prior to execution by the City Manager.
