GAREY AVENUE, ASSESSOR PARCEL NUMBER 8371-011-052; and Authorize the City Engineer to sign the Tract Map TM No. 83474 on behalf of the City of Pomona.
EXECUTIVE SUMMARY:
Efrem Joelson with MLC Holdings, Inc., applicant on behalf of 12131 Western, LLC, initial landowner, submitted an application to the City of Pomona Planning Division for Tentative Tract Map TRACTMAP 15421-2021, TM No. 83474, related to an aerial subdivision for a 73-unit residential development. The Planning Commission recommended approval of the application for the proposed project on a 3.11-acre site located at 2769 N. Garey Avenue, Assessor Parcel Number (APN) 8371-011-052. The approval of Tract Map TM No. 83474 (Attachment No. 1 - Exhibit “A”) will allow the current landowner, Pomona Gold TH-Pomona, L.P., to meet the project’s tentative tract map requirements as established by the Planning Commission. The proposed Tract Map TM No. 83474 has been prepared in accordance with the approved tentative tract map, and has been submitted for approval.
FISCAL IMPACT:
No fiscal impact at this time.
PREVIOUS RELATED ACTION:
On August 25, 2021, the Planning Commission adopted (i) Resolution No. 21-026 (Attachment No. 2) approving Tentative Tract Map TRACTMAP 15421-2021, TM No. 83474 and (ii) Resolution No. 21-025 approving Development Plan Review DPR 15420-2021, for a residential subdivision consisting of 73 condominium units at 2769 N. Garey Avenue, APN 8371-011-052. The Tentative Tract Map expiration date is August 25, 2023.
ENVIRONMENTAL IMPACT:
Pursuant to the Guidelines for Implementation of the California Environmental Quality Act (CEQA) Section 15182 and based upon the facts and information contained in the Tentative Tract Map and Development Plan Review applications, the proposed project is exempt from further environmental review based on the following findings of fact: (1) In March 2014, the City Council certified and approved the Environmental Impact Report (EIR) for the General Plan Update and Pomona Corridors Specific Plan; (2) The proposed project is a residential project consisting of 73 units and is undertaken pursuant to and in conformity with the Pomona Corridors Specific Plan. The proposed residential units were contemplated in the EIR and were evaluated as part of that environmental analysis; (3) None of the conditions listed in California CEQA Guidelines, Section 15162 are present, more specifically: (a) Substantial changes are not proposed in the project that would require major revisions of the EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; (b) Substantial changes with respect to the circumstances under which the project is undertaken that would require major revisions to the EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of the previously identified significant effects have not occurred; (c) New information of substantial importance that was not known and could not have been known with the exercise of reasonable diligence at the time the EIR was certified or adopted, as applicable, showing any of the following, has not come to light: (i) that the project would have one or more significant effects not discussed in the earlier environmental documentation; (ii) that significant effects previously examined would be substantially more severe than shown in the earlier environmental documentation; (iii) that mitigation measures or alternatives previously found not to be feasible would in fact be feasible and would substantially reduce one or more significant effects, but the applicant declined to adopt such measures; or (iv) that mitigation measures or alternatives considerably different from those previously analyzed would substantially reduce one or more significant effects on the environment, but which the applicant declined to adopt.
DISCUSSION:
The subdivision application submitted by MLC Holdings, Inc. on behalf of 12131 Western, LLC, initial landowner, for TRACTMAP 15421-2021, TM No. 83474, was approved by the Planning Commission to allow for the aerial subdivision for a 73-unit residential development constructed on the property addressed as 2769 N. Garey Avenue, APN 8371-011-052. The approximate 3.11-acre currently undeveloped site is located 400 feet north of the Pomona North Metrolink Station, south of Bonita Avenue, west of Garey Avenue, and adjacent to Whistler Street, a private drive serving the recently opened “The Gabriel” Apartment Complex (Attachment Nos. 3 and 4). The development consists of eleven buildings, each containing from three to nine units, for a total of 73 units, private drives, private open spaces, attached garages, guest parking spaces, and landscaping improvements. The floor plans include two and three bedrooms ranging between 1,210 and 1,801 square feet (Attachment No. 5). All common areas within the project boundaries will be owned and maintained by a homeowner’s association. The site does not have direct access to a public street (Bonita or Garey Avenues), but the vehicular access will be provided thru two private streets (Whistler Street and Breckenridge Street), based on a recorded reciprocal access agreement with the adjacent property owner at 2771 North Garey Avenue. This access agreement is a requirement of Los Angeles County Fire Department, and has also been conditioned by the City of Pomona Planning Division.
Approval of Tract Map TM No. 83474, and its subsequent recordation, will allow the current owner, Pomona Gold TH-Pomona, L.P. (i) to meet the conditions of approval for Tentative Tract Map TRACTMAP 15421-2021, and (ii) to facilitate the completion of the proposed construction and the issuance of the Certificates of Occupancy for the development.
