CITY OF POMONA

COUNCIL REPORT
March 20, 2023
To: Honorable Mayor and Members of the City Council
From: James Makshanoff, City Manager
Submitted By: Chris Diggs, Water Resources Director
SUBJECT: APPROVE SECOND AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT WITH AECOM FOR THE “WATER RESOURCES BUILDING” PROJECT RECOMMENDATION:

It is recommended that the City Council take the following actions:

Approve the second amendment to the professional services agreement with AECOM Technical Services, Inc. (AECOM), in the amount of $27,895 (for a contract total of $59,501) for the “Water Resources Building” project; and Authorize the City Manager, or designee, to sign the attached agreement amendment.

EXECUTIVE SUMMARY:

A second amendment (Attachment 1) is required for additional geotechnical inspection services that are necessary to complete the construction of the new Water Resources Department building.

FISCAL IMPACT:

The total fiscal impact for the recommended action is $27,895. The original agreement with AECOM was for $28,106, which was amended by adding the first $3,500 agreement amendment. This second amendment will add $27,895, for a total contract amount of $59,501. Since the second amendment is more than 25% of the initial contract amount, City Council approval is required. Funds are available in the approved Fiscal Year 2022-23 Capital Improvement Program (CIP) “Water Resources Building”, Project No. 575-8125-XXXXX-93135. The funds available for this project are detailed in Table 1 on the following page.

PREVIOUS RELATED ACTION:

March 16, 2022: City Manager approved the award of a professional geotechnical engineering consulting services contract to AECOM in the amount of $28,106.

July 18, 2022: The first agreement amendment was executed for additional scope related to geotechnical plan review for a cost of $3,500, generating a total contract amount of $31,606.

DISCUSSION:

On March 16, 2022, the City and AECOM entered into the first agreement amendment for professional geotechnical engineering consulting services for the new Water Resources Department building project. In order to complete the geotechnical confirmation of the building foundations and material acceptance, Consultant shall conduct geotechnical testing and monitoring, collect and analyze soil samples, review construction drawings, and prepare a final report. The additional work is required due to contaminants found onsite and the need to comply with environmental regulations. To complete this additional work, staff is recommending that City Council approve a second amendment to the contract with AECOM. If approved, staff will execute the second amendment to have AECOM complete the geotechnical and materials work necessary to complete the project.
