SUBJECT: AWARD OF PROFESSIONAL SERVICES AGREEMENT TO CUMMING CONSTRUCTION MANAGEMENT, INC. IN THE AMOUNT OF $284,970 FOR PROJECT MANAGEMENT SERVICES FOR “POMONA LIBRARY FACILITY IMPROVEMENTS,” PROJECT NO. 428-2590-XXXXX-74120 RECOMMENDATION:
It is recommended that the City Council take the following actions:
Award a professional services agreement to Cumming Construction Management, Inc. for Project Management Services, in the amount of $284,970, for “Pomona Library Facility Improvements,” Project No. 428-2590-XXXXX-74120; and Authorize the City Manager, or his designee, to execute the agreement, and any amendments or related documents, subject to approval as to form by the City Attorney.
EXECUTIVE SUMMARY:
Approval of the recommended actions will result in the award of a professional services agreement, in the amount of $284,970, to Cumming Construction Management, Inc. to provide project management services as part of “Pomona Library Facility Improvements,” Project No. 428-2590-XXXXX-74120 (Project). The Project will provide for the following proposed improvements: heating, ventilation, and air conditioning (HVAC) system replacement, roof and carpet replacement, and interior/exterior lighting replacement/retrofit to LED.
FISCAL IMPACT:
Approval of the recommended actions will award a funded professional services agreement in the amount of $284,970 to Cumming Construction Management, Inc. The fiscal impact is summarized in the table below:

PUBLIC NOTICING REQUIREMENTS:
In accordance with Section 2-1005 – Professional Services for All Capital Improvement Plan of the City of Pomona’s (City) Purchasing Ordinance, an Invitation for Bids (IFB #2022-70) for Project Management Services, As-Needed for “Pomona Library Facility Improvements,” Project No. 428-74120 was posted on the City’s electronic bidding platform, Planet Bids, on December 15, 2022. Bids were opened on February 1, 2023.
PREVIOUS RELATED ACTION:
On June 6, 2022, City Council adopted Resolution No. 2022-94 adopting the City’s FY 2022-23 Capital Improvement Program budget that included “Pomona Library Facility Improvements,” Project No. 428-2590-XXXXX-74120. On December 19, 2022, City Council adopted Resolution No. 2022-228 appropriating $6,014,328 of California Budget Act of 2021 (SB 129) grant funding to the Project.
DISCUSSION:
Approval of an award to Cumming Construction Management, Inc. will provide project management services for the Pomona Library Facility Improvements. Included in the scope of work are the design, preparation of plans, specifications, and estimates, pre-bidding, and pre-construction, as well as for construction, recommissioning, occupancy, and project closeout.
City Staff submitted an application requesting funding from the State of California Budget Act of 2021 (SB 129) to renovate the Pomona Public Library. On October 19, 2022, the City received notification of an award of $6,014,328. Proposed improvements to the Library include:
- Roof replacement
- HVAC replacement
- Carpet replacement
- Interior LED troffer retrofit kits
- LED exterior lighting
On December 15, 2022, IFB No. 2022-70 for the Project was issued on the City’s electronic bidding platform, Planet Bids. The solicitation notified 669 potential bidders, of which 49 bidders downloaded the IFB, resulting in the City receiving two (2) proposals, one from Cumming Construction Management, Inc., and one from Ledesma and Meyer, Inc. An evaluation committee, made of City Staff, reviewed the proposals and deemed that the lowest responsive and responsible bid for the total base bids work, in the amount of $284,970, was submitted by Cumming Construction Management, Inc.
