CITY OF POMONA

COUNCIL REPORT
May 1, 2023
To: Honorable Mayor and Members of the City Council
From: James Makshanoff, City Manager
Submitted By: Anita D. Gutierrez, AICP, Development Services Director SUBJECT: CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT (HCD) ANNUAL PROGRESS REPORT (APR) FOR THE 2021 AND 2022 REPORTING PERIODS RECOMMENDATION:

Staff recommends the City Council review and accept the 2022 APR and receive and file the 2021 APR and direct staff to submit the report to HCD and the Governor’s Office of Planning and Research (OPR).

EXECUTIVE SUMMARY:

As part of compliance with the City’s Housing Element, the California Department of Housing and Community Development (HCD) requires the submittal of an Annual Progress Report (APR), showing progress towards meeting the Regional Housing Needs Assessment (RHNA) allocation as identified in the Housing Element. The 2021 and 2022 reports represent the fourth and fifth report submitted to HCD by the City.

PREVIOUS RELATED ACTION:

On October 9, 2020, the City submitted its first APR to HCD for the 2013-2021 Housing Element. The City Council has previously approved submittals of APR reports on March 16, 2020 (second report) and March 11, 2021 (third report).

FISCAL IMPACT:

There is no fiscal impact associated with this item.

DISCUSSION:

The Housing Element is a State-required component of the General Plan that addresses present and future housing opportunities for Pomona residents. The Housing Element provides the primary policy guidance for local decision-making related to housing and is the only General Plan Element that requires review and certification by HCD. Additionally, State law requires local jurisdictions to update the Housing Element every eight years. Each eight year outlook is called a “cycle.” The City of Pomona is in the “sixth cycle” of its Housing Element, covering the time period of 2021 to 2029. The Sixth Cycle Housing Element was certified by HCD on September 30, 2022.

State law also requires local jurisdictions to file a Housing Element progress report to HCD and OPR each year, known as an Annual Progress Report, or APR, and requires the City Council to consider these progress reports during a public meeting so that members of the public may provide oral testimony or written comments.

The Development Services Department successfully submitted the 2021 APR to HCD in Spring 2022, but did not bring that progress report formally to City Council, as it was dedicating staff resources to pursuing certification of the Housing Element itself. Therefore, both the 2021 completed report, and the draft 2022 report, are included in this item.

The APR report has been standardized by HCD in recent years and is intended to report out housing activity related to the number of applications submitted, number of permits issued, levels of affordability, ownership versus rental tenure, and qualitative reporting on goals and policies identified in the Housing Element.

It is important to note that each APR asks for a status update on implementing all Programs identified in the Housing Element (Table D of the report). The City is reporting Fifth Cycle programs for 2022, and not Sixth Cycle, as the Sixth Cycle was not certified until September 30, 2022, and it would therefore be premature to report out on those programs. Staff expects to begin reporting out on Sixth Cycle programs starting in the 2023 APR, as this will be the first full calendar year of program implementation within the Sixth Cycle.

COUNCIL PRIORITIES & GOALS:

Submittal of the APR supports the 2020-2021 City Council Priorities and Goals; Priority 3: Increased Opportunity and Housing Stability; Goal J: Encourage the development and maintenance of quality housing opportunities for all.
